SPLM rejects constitutional powering sharing with opposition parties

By Ngor Arol Garang

May 5, 2011 (ABYEI) – South Sudan’s ruling party, the Sudan People’s Liberation Movement (SPLM) on Friday said it has rejected consultative discussions with opposition parties over the interim constitution of the region, which will become independent on July 9 following a referendum earlier this year.

Five opposition political parties walked out of the two day consultative political parties leadership forum held in Juba, claiming the constitution was drafted to satisfy interest of the SPLM and gives more powers to the president without providing for power sharing with opposition parties.

John Luk Jok, a minister of Legal Affairs and Constitutional Development of the government of South Sudan dismissed the claims and described the political parties leadership forum as a consultative forum from which south political leaders consult among themselves on pressing political matters of the region. However, he said that suggestions made members of the forum could be passed or reject and any work done by the technical committee.

“The claims by some opposition political parties do not have grounds. They want the constitution to be amended so that it includes them in terms of power sharing. They need power sharing to be included in the constitution. They are also claiming the interim period is long and that it should be reduced to 2 years which is not acceptable,” said Jok, an interview with Sudan Tribune from the regional capital of South Sudan, Juba, on Thursday.

Jok further accused some of the opposition political parties of rejecting inclusion of the contested oil-producing region of Abyei into the interim constitution of South Sudan, arguing that the political parties’ leadership forum had no authority to amend the constitution or legal mandate to pass. The minister further said although some political parties walked out of the meeting.

“Although some political [parties] walked out of the meeting, 19 others including the SPLM remained behind to conclude consultation of the constitution and that the meeting did not end in complete disagreement but rather, one group walked out of the meeting”.

“These parties agreed on inclusion of Abyei as part of South Sudan in the transitional constitution, transitional period to be 4 years before we go for the next election and those south political parties will continue to negotiate with the president of the Republic of South Sudan on how best to form a broad base government. This was what was agreed by 19 parties who are the majority,” explained minister Jok who was the chairman of 54 member constitutional review committee.

Gabriel Changson Chang, the leader of the opposition political parties said in a separate interview his party was one of the 19 political parties which walk out of consultative political parties’ leadership Forum.

“Yes, some political [parties] walked out of the consultative political parties leaders forum because they have their own observations on the constitution. My party did not walk out of the political parties’ leadership forum. It was one of the 19 parties which remained behind to continuous with consultations with other political parties,” said Changson in a brief interview with Sudan Tribune on Thursday.

Bol Makueng, a Secretary of Information, Culture and Communications with the SPLM, said opposition political led by the splinter movement Sudan People’s Liberation Movement for Democratic Change – a group he termed as Kenana Alliance Political parties – walked out of the political parties’ leadership forum because they wanted powers sharing to be included into the constitution

“Some of the political parties walked out of the political parties’ leadership forum because they demanded that the power sharing be constitutional. The constitutional power sharing is always done between two warring parties but not with in a democratic setting,” said Makueng.

“The 19 political parties including SPLM agreed on inclusion of Abyei as part of South Sudan in the transitional Constitution, transitional period to be 4 years before we go for the next election and those Southern political parties will liaise with the president of the Republic of South Sudan to form a broad base government. The rest of the issues were to be submitted to the Council of Ministers of government of Southern Sudan and Southern Sudan Legislative Assembly for consideration because they are the only legal body mandated to discuss amend and pass the new constitution,” he explained.

Lam Akol, the leader of the Sudan People’s Liberation Movement for Democratic Change, in a separate interview with Sudan Tribune, said the parties walked out from the forum because the draft transitional constitution for the new nation of South Sudan was crafted to satisfy one political party, the SPLM.

“The political parties walked out of the consultative forum because there was no consultation. Their views were not respected so it was meaningless to stay in the forum,” said Akol.

“It is an exclusive constitution. It gives more power to president. It concentrates power in the hands of the president, such as the power to remove governors and dissolution of the state assemblies. The appointment of state ministers with approval of the president and failed to mention date on which next general elections would be held. This is a clear violation of the resolution of Southern Sudanese Political Parties Conference.”

“The constitution did not also mention presidential term limits and there is no provision for power sharing with political parties,” explained Akol saying there are a lot of things that needed to be amended in the constitution.

Ahahaa, the semi-illiterate Bol Makueng thinks that power sharing is always only between parties that killed themselves. (I hate his English accent, he really sounds a village man).

Power sharing can be between peacefully coexisting political parties. In another words, it is called coalition or broad-based government. Do you understand such terms, Mr. villager?

You talk in the constitution of forming an “inclusive broad-based government” from July 9. This is what is called power sharing, dude.

    South Sudanese,

The two words ‘power sharing’ is very confusing in Dinka language vocabulary because they don’t have it in their culture. They don’t share power in their villages. You are either a slave or a benydit, that is it. No equality!

Even in the CPA it was introduced by others because Garang was to take over total power from Bashir and make him a slave.

    BREAKING NEWS.

In Juba currently Dinka have resorted to climbing to the top of telecommunications masks and demand that the president pays them ransom to meet their family requirements lest they jump to their death.

Interestingly the president and his cronies condone such by paying them off.In fact, from October 2010 to date 4 people have successfully been paid off by Mr President.

The worst occurred yesterday around kololo where an SPLA major climbed the mask and asked the government to mediate for the return of his wife whom the in laws had taken for his failure to feed her and the children. The dude tabled for thousands of pounds from the government.

When will this people learn to be responsible?

The great African statesman Julius Kabarege Nyerere said one time that the fear drawn from excluding a section of citizenry from decision making is worse than leading a government that has no vision for its citizens. In the past when you mention Sudan it meant Jallaba country. The decisions of the government were basically Jallaba’s. Is South Sudan following Jallaba’s vice? Listen to the public cry when it comes to nation building. Leaders are servants of the people.

    CAUTION: WAR AHEAD

    To GOSS and everybody:

ref: Kiir and other future Presidents of South Sudan

There should be term limit in the constitution otherwise there will be waves of rebellions when one person becomes addicted to power like Museveni, Mubarak or Zenawi. The situation will be worst than being in a United Sudan. Those who are keen should realize that part of the reasons why we fought with north was power and lack of development. There was little or no hope that a southerner was ever going to rule in Sudan because of the way the constitution was set up. Yet we had the right to contest and become presidents just like anybody else in the north. Now South Sudan belongs to us all, everybody is equal, whether from a Minority or from a Majority tribe which is good according to the constitution. But this will not be cherish if few things are not straighten out in the constitution. The ball will play on half of the chord all the time like it was in the United Sudan. We all need to be open minded otherwise we will not get the best people that will steer our country in the right direction. The Arabs are gone but if we are not careful, our constitution will create an Arab among us. That Arab will be in the image of your brother and will oppresses you. Everything seems right when it is our turn, but I know that we will be the first to complain when somebody becomes the president for 20 years when there is no term limit.

Also the the constitution says that the incumbent president can select the electoral committee which supervises the election and announces the results of the election. This is is a dangerous clause. Members of the electoral committe will not be fair to other candidates during elections because they will always do what pleases the president or their lives will be in jeopardy. Along that road the gains are high, the glory is temporary, the damage is permanent and end is regrettable!. Think about it and ask Mubarak or Gadaffi if you have any doubts.
Our generation of Jesh-Amer should refuse to take this road of disaster.

    Wonderful!!! Wonderful!!! Wonderful!!!

I really appreciated the performance being done by the chairman of Technical Committee because the term limit for Presidential can be determine by the Constitutions that will be pass by the Parliament.

The opposition party cannot much out before conclusion of the draft constitution, exactly that is against law of the country.South Sudan is new nation of which there is no need to allow some Arabs to enter to our family affairs.

Let the SPLM continue with the constitutions and we are going to support them for the benefits of our nation.
SPLM is the ruling party and it has right to draft the constitutions even if the others parties refused to joint the Forum.

The questions beings asked by the opposition party are all incomplete and they are all meaningless to Southerners because they should have to accept the defeat otherwise let them come to the table and focus about the good way forward instead of being parallel to SPLM.

Go in peace and I wish you to come back in peace

Let SPLM learn to resolve issues when they are still in political stage than to come and make unnecessary noise when the entire issue turn militarily. It seems during the last 5yrs of the intrime period, the SPLM had learn alot of dirty political games from NCP (dishonouring agreements, buying time game.and above all listening to non except to those who hold guns).
It’s not enought to conduct elections every four years with the same candidate running for the presidency but rather it’s reasonable to determine terms of a sitting president like in America ( only two times). If we want a democratic country, we should execise democracy with it’s actual meanings and contain rather to be selective or skeptical about it.
Regarding the issue of power sharing,i really support the tray of the argument,we need the government with productive, creative and professional people from all the other political parties to constitute a functional government than this malfunctional government.I need the minister of defence to come from the opposition parties in order to dissolve what so called Kiir forces,Riek forces,Matip malitia and other militia groups that constitute the present SPLA nature. And form for us the national armies who are loyal to the state rather than to the individuals.
Finally southern sudan can not be let (not rule) by a single party or tribe but it can be let by democracy and consensus other than this rebllion will be the order of the day.

Dr. Machar is our South Sudan next president be it by election or by force. Whether Dinkas like it or not it is his time.

First, the system won’t allow anybody to bypass Dr. Machar because he is the second in line.

Second, every thinkable human being understand very well that the statehood that we are going to winnest was archestrated by Dr. Machar. Without him the South could have seen it’s doom day before the referrendum because Dr. Kiir, which is a fake Dr, does not see the light at the end of tunnel.

Third, Dr. Machar is internationally recognized and praised by all for his leadership quality. He always foresee things before they happens. He has condemn corruption and working days and nights to dismental the tribal system implanted long ago by the bunch of idiot the Dinka rulers.

Finally, Dr. Machar does not fear any walking human being on earth. His silent is not a sign of weakness but rather wanted to expose the Dinkas bad leadership in order to be known by all people.

Hence, those who beat the domination drum for years to come are blind folding themselves. Dr. Machar is on the verge to secure his presidential palace in Juba and would let every Southerner get his/her share in the government. That is why Mr. lizard minded known as Kiir is worrying alot and try to mess up the system but he doesn’t realize that his hands are tired up already. Bad luck to you all.

for the last six years and seven month U are telling Us Zero tolerance to corruption.

All the belame of this time will be up on U and Vice president Dr. Rieck. unless U set up inquiry commission to establish what every body who is accused of was having before CPA and what was his salaries, where did he get the cash, like that U can be given credit of not being with them.

Ya Truthteller, Ahmed Chol and the likes,

We’re not a war with southern Sudan opposition parties. Period. They have right to walk out because the constitutional review wasn’t meant to create a position of Prime Minister which Lam Akol is eying and longing for. If it’s done in Zimbabwe and Kenya it doesn’t mean it should also be done in the nascent country of South Sudan without considering its “unfinished political business” with Khartoum which Lam Akol and the other opposition party leaders are part and parcel of it.

Although CPA was signed in 2005, military and political war with Khartoum remained unfinished. The opposition parties are mainly interested in power sharing but not the unfinished political business that SPLM is going through on daily basis with Khartoum. They need to realize that SPLM/SPLA cannot be weakened at the expense of constitutional power sharing as if SPLM is still in Naivasha in 2002. Southerners know who, and who should lead them to the “Promised Land” and beyond not anyone who imposes his hidden agenda on SPLM.

To all Dinkas,Naath Nuer, and other Southernese, let us be carful for what we said on the media. This not about Dinkas or Nuer, its about southern Sudanese who have fought for so many years in our struggle. Now constitutional and power sharing fail to admitted in our government and people of south who are the keys or the foundations of our government and the goss denied their right, which mean that Goss is failure state befor they hold their flag for the new nation.

Luk Jok, need to understand the will of the people southern not what he get or the benefit of other tribe, sub-clan. This about the new nation whom has fought for years, and it not for them to go back to war again. When the war break again I myself I will condemn him, Salfa kir, Ping Deng, Ajack, Gathoth, and the rest of SSLA who are member of the SPLM that control the goss that may think what is right for them while there are a clue that cause difference among southern.

Sham…shame on him and lack of understanding… this not for Dinkas because those who suffer are not dinkas is all southern whom may need help now a day. We do need change without change our government will look like fish tank while there is some leaking hole that drain water out in the tanker.
