South Sudan’s Kiir talks tough on oil, Abyei

July 19, 2011 (KHARTOUM) – The president of the Republic of South Sudan (RSS) Salva Kiir on Wednesday threatened to stop using the pipelines running through Sudan if the latter insists on sharing oil revenue as opposed to receiving transit fees.

The oil-rich South Sudan became an independent state on July 9th after a whopping 99% of registered Southerners voted in favor of seceding from the North. The referendum was part of the 2005 peace accord that ended more than two decades of civil war between the North and South.

“I am saying that we will rent the North’s oil pipelines and we will give them money for our oil to be transported, and we will of course pay and there is no problem,” Kiir told contingents of South Sudan armed forces at Bilpam military base.

“However, this offer is unaccepted by the North. We have agreed on one thing that the oil issue should not be disrupted. They [Sudan] need oil. But we fought for 21 years without oil and we can still go for 3 years until we build our own oil infrastructure” Kiir added.

Kiir’s unusually strong remarks sharply contrast those he made last June in which he suggested that the new state in the South could continue the oil sharing arrangement that has been in place since the Comprehensive Peace Agreement (CPA) was signed.

“We do not want to take all the oil revenues, we must leave something for the North to help them in facing the economic challenges,” Kiir told reporters following his meeting with German foreign minister Guido Westerwelle in late June.

Prior to secession the two sides evenly split the proceeds from exports of oil produced in the South.

In June Sudanese president Omer Hassan al-Bashir warned that he is prepared to shutdown oil pipelines if the landlocked South doesn’t pay usage fees or share revenue from crude proceeds following its independence.

“I give the south three alternatives for the oil….either the north continues getting its share, or we gets fees for every barrel that the south sends to Port Sudan,” Bashir told supporters at a rally in Port Sudan.

“If they [Southerners] don’t accept that, we’re going to shut down the pipeline,” he said.

On Tuesday it was announced that RSS shipped its first independently sold oil cargo from Port Sudan despite lack of agreement on the transit fees.

“We are still negotiating…nothing is yet clear,” Arkangelo Okwang, director general for energy in South Sudan, told the Financial Times (FT) but said he expects the north to bill the south for the use of its facilities, and added that South Sudan would ship a further 600,000 barrels on July 23.

Lead negotiator for South Sudan on oil, Pagan Amum, told the FT that the north had asked for “unfair and unreasonable” conditions of passage.

“They came with crazy ideas saying they are going to impose several transit fees – a usage fee, something called a normal transit fee, then something called a special fee – maybe $15 per barrel, even more – then maybe other charges, and they wanted revenue-sharing to continue,” Amum revealed.

Amum said the south was instead prepared to offer $3bn in “assistance” to the north and offered transit fees in line with international norms, citing 41 cents per barrel charged by the Chad-Cameroon pipeline, which is a similar-length. Despite receiving offers to build a pipeline to neighbors Ethiopia, Kenya or Uganda, Amum said he hoped that negotiations with the north would be successful.

“Our preferred choice is to use the pipeline that is already there, provided the north will not impose prohibitive, punitive tariffs and surcharges that are discriminatory and are imposed simply because South Sudan has become an independent landlocked country,” he stressed, adding it is illegal under international law to block exports.

Today the Sudanese finance minister Ali Mahmood Hassanein said they have received an official letter from RSS informing them officially that they are willing to pay transit fees and that a delegation would travel to Khartoum soon for discussion on how much it should be.

He added that Khartoum was in the process of crafting laws that sets the fees which contains three levels based on the fact that oil passes through Sudan which requires the imposition of sovereign fees.

Hassanein noted that the oil needs central treatment and purification from water as well as the use of the Bashayer port for exporting it.

Sudan has sounded the warning bell on the impact of losing control over the South’s oil fields. The government announced set of austerity measures that focuses on reducing public spending.

‘ABYEI BELONGS TO SOUTH SUDAN’

RSS president also addressed the issue of the disputed border region of Abyei stressing that it belongs to South Sudan.

“On 20th and 21st May, the Sudan Armed Forces [SAF] occupied Abyei by force, it was invasion. Their intention by occupying Abyei was to make us retaliate and counter attack by fighting them in Abyei, so that we could not celebrate the 9th of July as the independence of Southern Sudan. I ignored all these and ordered the SPLA not to go because we knew what they were up to,” Kiir said.

“The truth is here with us, Abyei belongs to us. Whether Omar al-Bashir likes it or not, one day Abyei will rejoin the South” he added.

Khartoum’s forces seized Abyei with tanks and troops, causing tens of thousands of people to flee and drawing an international outcry. Sudan claimed this was in response to an attack on SAF convoy by Southern forces in the area.

But both sides later agreed to withdraw their forces from the oil-rich region and allow Ethiopian peacekeepers to be deployed there.

Khartoum’s chief Abyei negotiator Al-Dirdiri Mohammed Ahmed told Agence France Presse (AFP) last month the government was satisfied with the arrangement because it had taken care of its main concerns about the bitterly contested region, primarily that it remain in the north.

“We think it is a sustainable solution, and that peace will prevail according to this formula,” Ahmed said.

    These pipelines were constructed by South Sudan’s oil revenues. South should have share on leasing fees that North Sudan charges. For example, if North is going to charge for 30% then South should request 15% back for pipelines fees, and pay North Sudan 15% as their net share for leasing.

    The oil apparatus were built by our wealth from the South. First – Khartoum must first include us into this existing oil infrastucture before they isolate us because we become different nation.

    We were a part – meaning they (North Sudan) owe us some portion on the property they call theirs. They must pay before we pay them too.

    Good, but we need action and tangible results. If the first cargo of our oil has been exported smoothly without reaching agreement with the GoS, the second one may be complicated or not possible. This file has to be closed as soon as possible, so we can concentrate on building the nation. We cannot leave this open-ended. The North may get mad and closes the facility unilaterally.

    As for Abyei, I think we need to fight each other. We need to talk. New set of negotiators from both sides + actual involvement of the local chiefs may reach to an agreement.

    War never solves problems. It deteriorates them. Even our independence has been gained through CPA. Remember that Mr. President.

    H.E President of the ROSS, You sound head up and truthful, and that is what we are and want, nothing to fear now, we are “set aside nation”. Whatever you said before we were not a nation should not be related to your current status and statement. Whatever you said before as a vice president of the Republic of the Sudan’s chapter was closed.

    Thanks for being very tactful and political being in the CPA and administering your people gently to the last. “We Honor you dearly” despite all the challenges a head of us.

    We can now reveal and mention openly what belong to us but Khartoum is trying to take by force.e.g Let us tell the truth all 1. Why should Khartoum talk of wealth sharing again? I wish we tell them even we can use the pipe line without charges because they use our own wealth for building it. 2. Why not both monetary and material expenses incurred for development and buying weaponry to fight South Sudanese for two decades by the North Sudan be calculated and they are charged to pay (indemnity) to the South Sudan. It is a petty for them but we will stripe them naked one after the other untill they bent low to us.

    I think this tiem around, North Sudan will not try any aggressiveness on the Abyei issue because they know very well South Sudan will fight to the end Kosti.

    Look like the SSAF/SPLA are ready to do anything possible if North Sudan SAF want to repeated the Abyei invaision.There are too many wars within Northern Sudan itself and I don’t think they will talks about Abyei issue any more.

    Mr. president Kiir, it is true the SPLA have spent two decades fighting with SAF without payroll and also without hoping for oil benefits if it take three years to built oil pipleline then, the SSSAF and the Southerners Sudanese will manage that period, but this Northern Sudan oil pipleline must be close immediately simply because they are became too arrogant thinking it will affect economic for South Sudan which is unlikely to happen and they will come back and asking ROSS and GOSS to give them any fee you woul demanding to pay them, because they will know, the less they will get from South Sudan’s oil is better than closing the whole oil pipleline which is another loser they were hoping.

    Kiir talked tough after Independent. We all like his speech and his wise strategic think on Abyei during that day when the SAF invaded Abyei on 21st May 2011.

    We were almost to make counter attack and recapture Abyei just because the land is ours. We accepted the position of our president until today as we are now fully Independent.

    However, bring Abyei back to the South Sudan need serious screening of the officers. Officers both in the SPLA and Organised forces have devastated the moral of the engertic and fighting forces. They have paralysed the Defence forces and Internal forces. The worst all is the internal forces being ministered by Gier Chuang Aluong.

    If Kiir want Abyei to be fully brought back to the South let him sack Gier Chuang Aluong. Gier has mess everything and has looted more money from the Government through his frequent trips to abroad. His decisions are always negative since from day 1 until this day. Up to now, Gier doesn not respect the President. All Minister were warned not to take major decision or any major contractual obligations but Gier has ignored that. Breaking News are always happening.

The GOSS has already agreed on 20-30% oil sharing with the North and is soon to be finalised in negotiations – As for abyei well they already signed that it is part of the North (until a referndum is done) – i,e never.     First let the President Identify and define what he want to do to develop the Nation which will then help the description of toughnes of his message when he talks.
    He can not jump to tackle issues beyond the boarder when people in WAU are dying day and night and sleeping in fear of sloughter by Dinga SPLA soldiers who robbs shops even at a broader day light at gun point, when you call Police they don’t respond to rescue the situation. So let the President show to the Nation that he is able to control security at home than wanting to alrm beyond the fench.
    I advice South to build their own piplines because Khartoum will emberase them one day after signing agreements for the exportation and it will bring another fighting sending cowards to Kakuma.
    Uganda is the nearest for this deals of the pipline than Kenya if not a special interest in Kenya unless otherwise!

    Now we have more than enough power to do whatever we want to.
    Base on massive reserve of oil in the South, the IMF (the International Monetary Fund) can loan/finance the South billions of dollars for the next five to ten years and we can shutdown the pipeline that is going north.

    We are not going relay on the north, we know the consequences, we will build our own pipeline, storages and refineries in the South, there are so many customers waiting on the line to buy it.

    Stop your nonsense of 20 to 30% deal. Who do you think will sign that without President Kiir approval?
    When it comes to Abyei, that’s just a wishful thinking, first of all solve the problem of Darfur and Nuba Mountain.

    Salva Kiir has surrendered Abyei to North Sudan on our back and yet he is entertaining us like small children that “one day” Abyei will come back. When is “one day” according to Salva Kiir? “One day” may mean 50 or 100 years from now.

    On oil Dr. Lual Achuek Deng said he had the blessing of Salva Kiir on that unfortunate sale of our oil that gave 48% illegally to North Sudan as revealed by Pagan Amum.

    The blind loyalists will just play to the tune of Kiir’s entertainment without seeing his real fruits. Abyei is gone.

    Salva Kiir fears Omer Al Bashir in face to face tough talks but shouts from a far. And with his divisive policy in government, even SPLA has no morale to fight a war over Abyei.

    And let me remind you that a war over Abyei can reach the doorsteps of Kiir in Juba given the current unfortunate situation we are in.

    Keep dreaming and daydreaming but Abyei will never come back under Kiir’s leadership.

    1.Are they (North Sudan) gonna rent the passing of their pipelines through South Sudan thousands of miles on South Sudan soil to the Norht Sudan or not?

    If not why not?

    2.Why are they complaining every now and then and they don’t considered the passing of their pipelines through South Sudan soil?

    3. How about we give them 30% of their pipelines rentals and ask them back for 15% of rental on passing on South Sudan soil to North Sudan..?

    The nascent East African nation of South Sudan sold its first oil earlier this week, heralding its appearance on the market and prompting US Treasury Department concerns that the proceeds could find their way into the hands of corrupt leaders and/or sanctioned parties. A Treasury official who spoke on condition of anonymity said U.S. financial institutions’ anti-money laundering regimes must be capable of identifying and avoiding transactions involving corruption proceeds and/or sanctioned parties.

    “Such programs should ensure appropriate controls to manage risk, which is undoubtedly high in the case of transactions and accounts associated with export of oil from the Republic of South Sudan,” the official said. “High money-laundering risks, especially in countries and regions with a history of conflict and corruption, and with the oil industry are not unusual, and U.S. financial institutions involved in that business should be familiar with controls that can mitigate these sorts of risks.”

    South Sudan, which is led by former guerrilla commanders who along with their families and associates live privileged lives, is not subject to the US sanctions that have targeted Sudan since 1997. Still, oil sector activity in the south “will continue to implicate sanctions with respect to Sudan,” the Treasury official said. For example, unless authorized by Treasury’s Office of Foreign Assets Control, a U.S. company cannot provide services to the petroleum industry in South Sudan if related products are transported through Sudan, the official said, citing OFAC guidance issued in April.

    “Further, should a revenue-sharing arrangement between Sudan and the new state result in a situation where the government of the new state makes payments to the Government of Sudan from the sale of Southern Sudanese petroleum, U.S. persons generally could not engage in transactions involving the oil industry in the new state unless authorized by OFAC,” the guidance stated.

    South Sudan, which is oil-rich but practically devoid of infrastructure, seceded from the north on July 9, the culmination of a 2005 peace deal that ended decades of civil war. North Sudan lost 75 percent of its 500,000 barrel-a-day oil production after the south became independent, but oil is still flowing through its territory to reach buyers.     Sudan on Thursday approved a law imposing fees on the south’s use of its oil infrastructure, in an effort to offset the loss of oil revenues following southern secession on July 9, Ali Mahmud, the finance minister,said.”We are imposing these fees to get back what we lost from oil revenues, and we will reach the figure with the south through negotiations,” Mahmud told reporters shortly after the law was passed by parliament alongside a new, post-secession budget.

    “They have no way to export their oil, except through the north,” he added.

    On Wednesday, Mahmud said he expected Khartoum to receive around $2.6 billion from the oil-producing south in annual transit fees.

    But negotiations on this, and other key outstanding issues that north and south have failed to resolve such as debt and borders, have yet to resume since they were suspended at the beginning of the month.

    South Sudan’s President Salva Kiir said on Tuesday that his government accepted the proposal of renting the north’s oil infrastructure, but he hinted that Khartoum would have to make an acceptable offer or they would pursue other export options.

The GOSS has already agreed on 20-30% oil sharing with the North and is soon to be finalised in negotiations – As for abyei well they already signed that it is part of the North (until a referendum is done) – i,e never. The dinka ngork have already been given citizens in the North and the Ethiopian troops are in abyei to make sure the SPLM dont come back – when kiir says Abyei will one day be part of the south he is keeping ignorant people like you wishful until he leaves office.
