Lakes state passes interim constitution amid MP boycott

November 29, 2011 (RUMBEK) – Lakes state’s parliament passed its long awaited interim constitution on Monday despite some lawmakers boycotting the session.

Marial Amuom Malek the MP for Aluak-ALuak and Geer payam [districts] told Sudan Tribune he walked out of parliament in protest against the procedures, the lack of legal experts to guide discussions and the “self interest” of some the decisions.

He said that some of the laws were passed due to “self interest instead of public interest”, adding that some official appointments had been imposed on the assembly and this was affecting the performance of the parliament.

Marial said there was also controversy over who should chair the first sitting of the transformed assembly. According to the sub-article [2], he said, the oldest member of the parliament should chair the first meeting, not the incumbent speaker.

His second point of discontent was the process to elect the speaker and chairpersons of specialised committees and the appointment of the assembly’s clerk.

He said that he and others in South Sudan had fought the Khartoum regime for over 20 years to prevent laws being forced upon people in an undemocratic way so he was disappointed by the way the Lakes state parliament had acted.

Ater Jeremiah Telar the MP for Abang constituency in Yirol West County said he had boycotted the session was to demonstrate to the public what was wrong with the state’s interim constitution.

He said that this was the second mistake Lakes state had committed following the customary law that he said victimised the youth of the state.

The speaker of Lakes state’s assembly, John Marik Makur, objected to the boycott saying that the MPs had walked out as part of a power struggle to get committee positions.

Makur claimed that the MPs who walked out were fighting to get top seats in the parliament but the constitution had been passed by a simple majority on Tuesday evening.

He acknowledged that some members were not happy that he chaired the session and not an elderly MP, as it was the first session of the new sitting. However this procedure was voted against by the assembly, he said.

However, Marik said he recognised MPs had the write to boycott the assembly but called for representatives to harmonise their grievances and work for justice.

    Lake state authorities, don’t want true members of the SPLM/A, or a revolutionary who has a voice in their system, please just keep quiet and quench thirsty with huge money of MPS. You’re better than your colleagues who fought the war during those days of liberations, enjoy your chance of being MPS or otherwise they will create a confussion to kick you out

    what next? the constitution is passed by simple major that means tow heads are btter than one head. otherwise speaker may be true to say that both of Hon. marial and Ater are seeking for heads of specialized committees. never demonstrate your own interest pretending to be the interest of the community.

    Why judge the book by its cover before knowing what is wrong in the constitution that led the 2 members of the assembly to be the only people knowing that problem? I cannot say these 2 members are more educated than the rest in the assembly despite weak members. They did not specify an article of which they claimed to have been passed by mistake.

    Disability gets people even when you are at your present ages, both born, physically and accidently. Please I beg your pardon not to ask such questions any time because such things can happens to you at any time. Another thing is that members of the assembly are not elected by the governor but by the people at their own constituencies.

    “No smoke without fire”something must be wrong in the parliament,boycotting is agood way of protesting, it proof that u are not the part of what happen.I appreciate those Mps but my Mp Hon.Martin Mayor Achiek are u ok with that constitution.please do not make yourself silence you better shout like the rest.

    You are right Honorable Marik to say that it was a power struggle which forced them to boycott the sitting but mind you! it was not a mere power struggle but they were trying to follow the constitution as I can see that they quoted the ACT which says the meeting should be chaired by the oldest MP.

    Secondly you the Lakes State MPs will make those laws and break them a lone only the poor will suffe
