US SPLM urges world leaders to pressurize NCP to honor Sudan’s peace

SUBJECT: VIOLATION OF THE COMPREHENSIVE PEACE AGREEMENT BY (NATIONAL CONGRESS PARTY) OF PRESIDENT OMAR EL- BASHIR.

First of all we the chapter leaders of the Sudan Peoples Liberation Movement (SPLM) – USA condemned in the strongest terms the NCP of El-Bashir for intentionally derailing the comprehensive Peace Agreement (CPA) implementation, which is the only internationally recognized document that will bring a long lasting peace in Sudan.

The recent suspension of SPLM Ministers, Advisors and State Minister, from the Government of National Unity, which we fully support as SPLM Chapter leaders in the USA, is a testimony to the lack of President Omar El- Bashir’s commitment to the implementation of the CPA.

Therefore, we the SPLM Chapter leaders in the USA, view these developments as total reversal and undermining of the efforts and progress made by the people of Nuba Mountains, Blue Nile, South Sudanese and the marginalized areas in Sudan as well as those of the international community in signing of the CPA.

Below are some of the clear examples of the CPA violations by the NCP of EL- Bashir, which directly led to the SPLM’s suspension of its Ministers, Advisors, and State Ministers from the Government of National Unity (GoNU).

The presence and reinforcement of Sudan Armed Forces (SAF) in South Sudan beyond July 9, 2007.

According to the CPA, the Sudan Armed Forces should have redeployed its forces from the South by July 9th, 2007. While the SPLA have withdrawn completely from the North, this has not been reciprocated by SAF. Instead SAF dug in and re-enforced its positions in the oil producing states of Upper Nile and Unity.

Lack of transparency in the role of joint SPLM-NCP National Petroleum Commission as stipulated in the CPA.

The NCP has systematically stalled the formation of a number of commissions of the CPA, and maintained a complete political control over the north of the country by legal and legislative manipulations, manifested in its selective avoidance of the bodies that oversee the implementation of the CPA, such as the Assessment and Evaluation Commission. It has successfully avoided the democratic reforms it signed on in the CPA, while paying lip-service everywhere to justify its position.

Lack of Transparency in Sharing of the Country’s Oil Wealth.

After insisting on retaining the Energy & Mining Ministry of the country, the NCP has so far failed to bring transparency into the Ministry. SPLM representatives in the so-called National Petroleum Commission have no powers or access to pertinent information on contract agreements.

The Abyei Protocol.

The NCP has so far refused to implement the Abyei Protocol. It has also refused to implement the Abyei Boundary Commission (ABC) Report, which was carefully and thoroughly researched and written by experts of impeccable credentials, endorsed from the outset by NCP itself. The refusal appears to be because the report does not favor the perceived position of the NCP.

The South-North Border Demarcation.

The NCP has intentionally avoided implementing the CPA provisions on issues pertaining to the South – North border demarcation. This is a very sensitive issue in its own right, given the fact that successive northern regimes in Khartoum have encroached on the territories that have been part of the south since the colonial era, and the NCP will not want to let go of these areas.

NCP’S Continuous Support of Militia in the South.

Despite clear stipulation in the CPA that any militia must either join the SPLA or the SAF, the NCP continues to support militia in the South with intention to create havoc and therefore, discrediting the GOSS for failing to provide security for its citizens, hence strengthening its (NCP’s) drive for involuntary unity of the country on the pretext that South cannot govern itself. The SPLM and GOSS have concrete evidences of these NCP malpractices.

Bashir’s Rejection of Kiir’s Proposal to Reshuffle Ministers in the GONU.

Being by far the most blatant violation of the CPA is El-Bashir’s refusal to the proposal of his 1st Vice President, President of the Government of Southern Sudan (GOSS) and the Chairman of the SPLM, Lt. Gen. Salva Kiir Mayardit to reshuffle SPLM ministers at the GoNU level. As a coalition government, each side decides who represents it at the federal level and while the SPLM never question the NCP representatives in the GoNU, the NCP feels the need to choose who to represent the SPLM in its rights. If this is not the mother of all hypocrisy, we don’t know what is.

Given the above record of violation, inaction and counter-actions by NCP, it has become evident to us that the NCP has not, and will never develop a relationship of trust between the South and the North. Instead, it will continuously engage in acts of sabotage and planting hatred, which will surely lead to the complete abrogation of the CPA.

Such blatant acts by NCP seriously worry us as leaders of the SPLM chapters in the USA. They imply that Sudan is entering a dangerous period, which if left unchecked, could easily slip into a full-scale civil war. We therefore call on the international community, especially the United Nations Security Council, IGAD Countries, IGAD Partners Forum, International Community, United States, United Kingdom, Italy, France, Norway, the Netherlands, China and concerned countries to:-

1. Put pressure on the NCP to implement the CPA to the letter and follow the road map provided in the CPA because the Comprehensive Peace Agreement is the only frame work for long lasting solution for the South-North conflict as well as Darfur and Eastern Sudan.

2. Send envoys immediately to Sudan to oversee the CPA implementation.

3. Call an emergency meeting and call on SPLM and NCP to report on the CPA implementations.
