Sudan sentences eight JEM rebels to death for capital raid
July 29, 2008 (KHARTOUM) — A Sudanese court sentenced to death by hanging eight rebels captured following an attack on the capital by the Justice and Equality Movement on May 10.
After the raid, three special counter-terrorism courts were formed to try 39 arrested rebels, on June 18. JEM attack killed more than 220 people.
The suspects condemned to death by the Counter-Terrorism Court No. 1 are Mohamed Kamal Sapon, Musa Hamed Abdellah Younis, Adam Musa Hassan, Bahrreldin Bashir, Abdellah Bushara Issa, Ibrahim Nur Zakaria and Shamo Osman Isaac.
The judges of the special tribunal acquitted one defendant for lack of evidence against him and transferred another to the juvenile court due to his young age.
Under Sudanese law, any death sentence must be ratified by both an appeals’ court and the high court. Then all death warrants must be signed and approved by President Omar al-Beshir.
However, Defence lawyers have argued that the special courts are unconstitutional and do not guarantee their clients’ legal rights. They further described the special courts as political and not independent and pledged to appeal the decision of the court.
Further, the Justice and Equality Movement condemned the death sentences, saying it is unconstitutional and against the international law because the eight defendants are prisoners of war captured in the aftermath of a military operation.
In an opinion paper sent to Sudan Tribune, Mahmoud Suleiman, the Deputy Chairman of JEM General Congress, said “Execution of Prisoners of War (POWs) is a breach of the International Law and considered an act of assassination and another murder in cold blood.”
Also, the spokesperson of the Sudan Liberation Movement Unity Command, Mahgoub Hussein denounced the death verdict saying they consider it as desperate attempt by the regime to put pressures on the rebel movement.
He warned the Sudanese president, who is indicted by the International Criminal Court, of signing the sentences saying they would retaliate against the regime if any one of them killed.
The trial of a brother in law of JEM chairman, and senior rebel commander Abdel Aziz el-Nur Ashr is still going on.
Following the indictment of the Sudanese president by the ICC prosecutor on July 14 several political parties urged Omer al-Bashir to release the rebels captured following the attack on the capital and to invite all the rebel groups including JEM to take part in a national comprehensive conference on Darfur.

This is illegitimate ruling. To claim Dafur rebels are terrorists is another genocidal strategy for this govenment. Darfur rebels should be tried as soldiers of war and not terrorists.

This is another act of genocide and crimes against humanity. You fools, these are prisoners of war and they should be treated with due human rights respect according to Geneva Convention in regard to the treatment of those captured in the battle field.These courts created by the war criminal Bashir are illegal and have no basis to try anybody in the Sudan because they do not follow the constitutional order.The rush in which these people were tried proves the fact that the transitional constitution of the Sudan is not in operation. so these courts are terrorists run courts and must be condemned by the whole world.
On the other hand, those who support the sentencing of those innocent Darfuris are themselves war criminals for they are encouraging the genocidal regime to commit even more crimes against the people who are trying to stop genocide in Darfur.
You Bashir supporters, let me assure you of one thing: the days of your criminal regime are over, and your boss will go where he belongs, behind bars forever.
Long live the heros of Darfur and let you remember one thing, Bashir may kill your bodies, but you will remain as heroes in the memory of your people as long as this world exists, but Bashir will go down in history as a war criminal forever.

This is not justice. You are against humanity. These people are fighting for a right and just course for the people of Sudan. What do you think you are doing? This is tyranny and not really applying the rule of law.
SPLM should vitoed this rule of court. These gentlemen shouldn’t be denied the right to live. Life imprisonment should be the right verdict.
Bashir has no legal rights to kill these people. And SPLM must in this case demonstrate leadership by providing logical alternative to this political dilema.

I first of all wanted to send the message of condolences to the victims’ relatives, the JEM movement and Sudan in general. these eight victims who were sentences to death are not the only captive killed by the government but many have been killed silently since 1956 till now. dear compatriots, Sudan is lossing her own man power in so many ways; hunger, diseases, tuture, assassination and so on and so forth. but all in all it is a big loss to the country. don’t be suprise on the killing because this is the best way Bashir can secure his seat. his government lack the political agenda of keeping prisoners of war unlike SPLM/A who keeps prisoners of war even if Bashir was captured by the SPLM/A during the war he would have been kept safe. hopefully the bibol said you be treated the way you treat others lates waite where the political atrocities of our president are going to end.

The judges should be tried too, not in Sudan but by Hague for having totally failed to recognized POWs. What a useless court and Judges therein. The court in Khartoum has got no legal frame as it has shown it’s self to the World.
I still agree with some comments that, this issue of POWs, should be another counts on Genocide to Darfurians committed by Beshir and his family court in Khartoum. How did he expect to kill Darfurians and less expecting revolts from Darfurinas men?. Is Beshir really reasonable, or has read about revolts and seccesation in Africa and other sides of the World?. Beshir lacks political paradign in his brain.
God forgive the souls of the POWs, because they stood for their rights of protection. You said, ”yeah should first protect his self before God’s protection”. You know all about me. Bless these helpless sons of the suffering Darfurians.
Pows, we shall still remember you and all of us including Beshir will get you on the final judgement. The difference may be, the cleaned heavenly records which will separate Beshir and his Judges from you and us.Take caurage.
