S. Sudan’s Machar heads to The Hague for Abyei tribunal hearings

April 17, 2009 (JUBA) — The Government of Southern Sudan’s Vice President is heading to The Hague to attend the Abyei hearing in the International Court of Arbitration.

Dr. Riek Machar Teny, who is also the Sudan People’s Liberation Movement (SPLM) deputy Chairman, left Juba for The Hague on Friday to join the SPLM advance team that left two days ago, headed by the Minister for Presidential Affairs, Dr. Luka Biong Deng.

The two signatories of the CPA agreed on June 8, 2008, in a roadmap signed by the Vice President of Sudan, Ali Osman Taha, and Vice President of the Government of Southern Sudan, Dr. Riek Machar to resolve the Abyei disagreement by referring their dispute to an arbitration tribunal.

They formally referred their case to the Court of Arbitration on July 12, 2008.

Sudanese government and the Sudan People’s Liberation Movement will present their oral hearing on Saturday April 18 before the Abyei Arbitration at the The Hague based Permanent Court of Arbitration (PCA).

The pleading will last from 18 to 23 April. The two parties, their counsel, experts, observers and witnesses will take part at the hearings. Within 90 days of the close of the oral hearings, the arbitration will issue their final and binding decision.

The five judges have to determine whether or not the Abyei Boundary Commission (ABC) experts exceeded their mandate “to define and demarcate the area of the Nine Ngok Dinka Chiefdoms transferred from Bahr el Ghazal to Kordofan in 1905.”

The tribunal shall apply and resolve the dispute before it in accordance with the provisions of the Comprehensive Peace Agreement (CPA), particularly Abyei Protocol and Abyei Appendix.

Abyei Protocol provided to establish an Abyei Boundaries Commission tasked with defining the boundaries of the Abyei Area. But the National Congress Party rejected the findings of the commission which had been issued in July 2005.

    It is obvious the Khartoum regime will again lose this case.However,they will try as usual to do their malicious ploy to undermine the voice of justice.They will not be willing to loss grip at big chunk of oil since it is the only thing they use to blackmail the oil-hungry Chinese communists.I congratulate the GOSS for its effort to win Abyei back.

    Anything involving Dr. Riak Machar is a failure; believe me or not. This case will be lost by SPLM GoSS because Riak Machar is gonna blacken it. This is e the first time Riak travel to The Hague and the second time he goes there will be the last time he travels in plan across Europe.

    Guys,

    You know what,the criminal Riek Machar has been politically fooled to peacefully surrender himself to the ICC,forget the Abyei issue.This is to control the likes of Gatwech from getting mad and creat all sorts of mess in South Sudan when people are enjoying peace brought to them without Riek Machar`s knowldge.

    This is the beginnig of free drama.
