SPLM distances itself from national security bill

September 11, 2009 (KHARTOUM) — The Sudan People’s Liberation Movement distanced its self from a National Security bill adopted yesterday by the Sudanese cabinet saying this version is different from what had been jointly discussed.

During the discussion on the bill of national security law the two parties disagreed over the power to arrest attributed to the security services. The former rebel movement considers it as not conform to the interim constitution and the 2005 peace agreement.

The national security bill which has been approved yesterday by the council of ministers is not the bill discussed by the joint political committee, said Yasir Arman who is the SLPM deputy secretary general and head of its parliamentarian group at the National Assembly.

The security apparatus in accordance with the constitution and the Comprehensive Peace Agreement has no right to arrest people, or search, confiscate and seize their funds; said Arman reaffirming the position of his party.

The spokesman of the Council of Ministers, Dr. Omer Mohamed Salih, on Thursday said that the draft National Security law will be referred to the parliament to ratify it in its new session which will begin next October.

Sudanese minister of Justice Abdel Basit Sabdarat told the cabinet yesterday that the draft law guarantees the arrested person many rights and protect him against torture.

However Arman stressed that attributions of the security apparatus should only be limited to collect and analyze information and provide counseling and advice. He added that the judge can order the arrest of a citizen when he has the necessary information filed by the prosecutor or competent authorities.

Divergences between the NCP and the SPLM on security law also include the appointment of the National Security Service Director and appointment of his deputies.

The SPLM believes that the president should appoint the Director of National Security after consultation with the First Vice President and approval by General Prosecutor but the NCP views this position as interference in the president’s exclusive authority.

The other point of divergence is that the SPLM proposed the appointment of only one deputy to the Director of National Security, while the NCP is demanding a number of deputies.

Arman said his party would lead a large campaign inside and outside the parliament involving political parties and civil society organizations to drop the disputed articles from the security law.

    This country will be at war forever. The stupid Arabs don’t realized that war is always avoidable only if there is decency and respect towards everybody. Preventing the South will just keep us killing each other.

    Apart from all those nonsense, Salva kiir need to stand against Bashir as CPA put it or render the power to Dr. Riak and pack hi lagguge and start his journey to his peaceful village.

    Dr. Riak, if you allow crazy tribalist to decieve you to accept this fake candidancy, man we will not listen to whatever you say again and again.

    I know very well that no Dinka would have selected Pagan or Malek Agar if Garang was a live, but because Salva Kiir knows that he will lose from Bashir, he with his tribalistic gangs need to push you to stand for them to cling on power. Please and please don’t accept it, truth or mess must come if Kiir and his stupid crooks don’t realize that Southsudan is not for them alone.

    Kiir must face Bashir or we call it that SPLA/M dishonored CPA and Kiir has to be pushed out by force whether he want it or not.

    Dr. Riak, never, never and never accept to stand and never accept any other person to stand Kiir must stand against Bashir if we want to honor CPA.

    It is ok for Kiir to give you power or somebody like Kuol Manyang, Pagan or somebody else otherwise don’t accept anything.

    Mundane citizens cannot freely exercise democratic right of expressing their political will in Khartoum due to fear of being arrested by regime’s security agents especially when citizen expresses dissatisfaction with the NCP. There are overwhelming signs that NCP has gone too in violation of their bipartisanship with SPLM stipulated by CPA.
    These tyrannical laws clearly infringe civil liberties of ordinary citizen especially nationals with opposing views. These measures to have bureaucratic security agents, which are unilaterally and undemocratically set up by NCP in absence of SPLA and other Parties show that regime is descending to extreme tyranny or military rule.

    The power to arrest, detain and bring suspect to court can only be carried out by police agents being regulated by clear Act relative to human right charter which say citizens shouldn’t be subjected to torture or state’s abuse. The only situation where citizen can be subjected to arbitrary arrest is found in the new terrorist controversial laws when there is convincing ground that the suspect is engaging or has engaged in terrorism, but police should seek court order before arrest.

    Amid of the deadlock between NCP and SPLM, I think SPLM should narrow its focus on referendum now because the South’s future clearly heads to secession. It’s quite apparent that regime is creating impossibilities to sabotage this democratic right. SPLM should suspend its participation in the government of national unity and be stricter than ever before. Because, NCP is currently trying with its claimed resources to infiltrate the South through unscrupulous and covert acts of bribery to thwart the South’s sole hope.

    Strategically, the economic vacuum which’ll be caused by the likely secession in the Northern economy sends trembling signal to North and it’s possible if bribery fails to thwart secession, they may risk their servicemen and women lives to enforce unity. In the South, violation of this right can lead to unilateral declaration of independence and the SPLA tasked to defend will in great degree defend South.war is inevitable and there is a great need for unity in the South in this delicate moment. South is governable, Northern rhetoric of ungovernability is to fool the foolish Southerners so that they can keep exploiting South resources.

    Current SPLM position is good, well-decided and it fits in the Vision of New Sudan. This is a cheapper elections compaign card for the SPLM and that’s how I can actually understand the different or distances between SPLM and other political parties with NIF on top.

    Not only that it’s good for the coming of change to Sudan, it clearly shown that SPLM’s traditional opponents are still pushing for thier dangerous system that will disintegret the country already thrown into doubt by Islamic Shari’a to whether there would be, or there will be no Sudan. SPLM leaders might be innocent victims if blamed for the reirruption of the suspended hostilities instead of blaming NIF and its Islamisation and Arabisation Programs the main sources for war in Sudan as well as North and Eastern African Regions.

    Creating laws that lay more barricades between citizens of one country by NIF leaders is not surprise to me, it is rather an expected move and this why most political forces formed alliances to isolate NIF the only strange party.

    I have one advice to the SPLM law makers; Bird with life-related eating of crops as primary source for survival always dies with grain on its mouth, I am afraid, this must be case with NIF party.

    The youths of Southern Sudan are with you and ready to die with you.

    Well done Mr.Yasir Arman.The Khartoum Government has already been defeated by the SPLA/M but people are not aware of that.They are just trying to blindfold you but there is no way out.You have to stand firm until 2011.Being a leader you have to face so many challenges from in and out.Though the citizens talk against you as leaders of the South then you have to turn deaf ears to them.
