SPLM-DC to lodge constitutional complaint against South Sudan government

November 25, 2009 (KHARTOUM) — The opposition Sudan people’s Liberation Movement- Democratic Change (SPLM) announced it would lodge a constitutional complaint with the Constitutional Court demanding to cancel a directive by the president of southern Sudan government banning its activities in the south.

The announcement comes after a letter issued on November 9 by Dr Luka Monoja Tombekana,, GOSS minister of cabinet affairs ordering the governors of all the tens southern Sudan states requesting them to not hinder the political activities of the political parties “except the so called SPLM-DC”

The SPLM-DC leader Dr. Lam Akol said this presidential decision violates the fundamental rights of his party granted by the interim constitution of 2005.

“This letter is incompatible with articles 29, 31, 33, 40 of the Transitional Constitution” dealing with fundamental rights, akol told the official SUNA, adding that the SPLM-DC is demanding the constitutional court to declare null and void the contested decision because of its unconstitutionality.

He added that they further ask the court to order the right of the party to engage in political activity in southern Sudan.

Yesterday minister Monoja refused to comment on the southern Sudan presidential directive.

The southern Sudan ruling party, SPLM, is accused by opposition parties and the National Congress Party of intimidating and arresting their membership as well as hindering their political work.

The Constitutional Court may ascertain the unconstitutionality of an act of public authority, declare a law null and void, or overturn an unconstitutional decision and refer the matter back to a competent court.

    There is no doubt that if SPLM will not handle SPLM-DC wisely,there will be lots of troubles. One thing I doubt if SPLM-DC is the only problem why did all 8 Southern political parties nominated Lam Akol Ajowin the leader of the change to be the presidential candidate for the South in the next coming 2010 election?

    SPLM need to study very well their business with SPLM-DC, you cannot refuse the main vehicle while recieving its contents, these parties are the content of SPLM-DC they have a huge influence to the people on the ground though SPLM-DC is in Khartoum.

    My advice to dear main SPLM party is that agression against SPLM-DC will never heal any wound at all, the only way to weaken SPLM-DC is improving the nation’s social issues such as security and corruption. Corruption will lead SPLM remain like a bone with out flesh, no matter complain against SPLM DC or blocking it out by force, never it won’t prevent SPLM-DC access to South Sudan political influence.

    Ladies and gentlemen, I know no any intelectual and decent southern citizent would be happy with killing of innocents and enormous day to day loss of public revenues, if GOSS under SPLM can not improve this failure, there will be continuity of leaking.

    I know many of you will call me SPLM -DC, but what I am saying is purely supporting our dear party the SPLM but hard to support some times any body who doesnot support him/herself.Good to SPLM!

    Dear brothers & sisters,’

    Kiir is showing an alarming lack of self-confidence with this latest defective directive.
    The question is how should Kiir use his last months in power, instead of spending it issuing this useless, defective directive against oposition parties? Just because he rules by degrees & directives doesn’t mean there is absolute monarchy in south sudan. Yes, Kiir is a dictator, but absolute monarchy rule does not exist in south sudan. Kiir needs to remember this!!

    Kiir must be feeling in the dark indeed, but he will soon find out that his directives & degrees are not constitutional, especially on this particular case. This particular discriminatory political directive against one particular political party is not binding, and thus voided!! This would be like introducing absolute monarchy in south sudan or sudan. Try to defeat SPLM-DC at the election booth through ballots, not bullets or defective directives!!

    Parties difference are not the same as personal difference. Kiir needs to learn politics 101. Kiir took Dr. Lam’s challenge personal, but Dr. Lam has a right to raise criticism against SPLM as one of the opposition party leaders. This should not threaten the ruling SPLM party at all. If the letter is indeed written by Kiir, then Kiir needs to learn how to be a leader in sudan because letting himself taken over by personal emotions before facts & constitution only confirms his poor leadership.

    It doesn’t really matters how much Kiir dislikes Dr. Lam Akol. Kiir needs to be guided by reason, logic and the rule of law not emotions. Therefore, Kiir’s shows of emotions before the constitution or rule of law does not trike political progress at all in south sudan. This is not personal dispute between Lam & Kiir. Political parties are supposed to be competitive based on their platforms. It is always politics at best.

    If this is true, then Kiir just handed Dr. Lam’s SPLM-DC a sounding victory at the constitutional court. This is not good for SPLM at the court of law. Dr. lam will grow horns over this judicial politics victory over SPLM. This would indicate SPLM is not really politically mature.

    I can see Dr. Lam is doing the victory dance over this defective directive. The court will rule on SPLM-DC’s favor. Another political victory for Dr. Lam/SPLM-DC on his way of gaining legitimacy and popularity among the electorates. I am waiting for a new article disproving this news story. It is unbelievable!!

    SPLM-DC have to stop being stupid, why don’t they get complain against NCP who has killed millions of Sudanese and have not implemented the peace and it still dictatorship in the country, referendum is coming and no one has time for this nonsense, be quite and prepare for referendum instead of making loud noise on behave of Arabs.

    Take them to the court. This is CPA violation. SPLM acts like they do not heard something called rule of law before. Nobody above the law. Even though SPLM-DC keep silent today, civilians will not silent.They will fight you like they fought war with north for their right. The funny part is that SPLM spent twenty one years in the bush with democracy word or new Sudan against North. What happen now?. Waw, people need to clean up metals again.

    It is a shame that the government of southern Sudan (head by SPLM) wanted to speak on my behalf. That is where and when dominant political parties and government go wrong. They put themselves in a position convincingly that they are the best judges and that they ultimately know what is good for people. Democratic elections are about giving people the opportunity to decide for themsleves. If that is the case, why SPLM-DC from participatiing? Are you doing this to protect us or yourself?

    If you believe that SPLM-DC will defeat SPLM-OYEE, maybe you should be defeated. Because if that is the case, that mean SPLM-OYEE do not truly represent the aspiration of people of Southern SUDAN.

    Could just leave us a long and decide–who represent the best interest of southern Sudan? If Lam Akol is a traitor, then why do you have to go out on your way to restrict his political activities?

    I believe the move to stop SPLM-DC from exercising his political rights is a serious problem and would be the beginning of undemocratic south Sudan. Just leave us alone and we will make the choices for ourselves.

    It is now high time to shame the SPLM nationally and internationally on its violation of the CPA, Interim Constitution and Liberal Democratic Principles with the 9/11/2009 letter directing the 10 Southern States not to allow the unbeatable SPLM-DC from political activities in the South. How comes the SPLM is shamelessly meddling into the business of other registered political parties in the country? Where is the Council of Sudan Political Parties and National Elections Commission? They should warn the incompetent and dictatorial leadership of the SPLM to respect themselves and the credibility of this historic movement.

    The Sudan Constitutional Court should act immediately to teach Salva Kiir and his cronies the sense of respect to the rule of law. Let Salva Kiir and his cronies go back to military barracks if they are unable to adopt to civilian politics of multi-party democracy in the Sudan.

    Civilian multi-democracy civilian competition must be free and free without blocking any single legally registered political party. If Kiir is shivering from democratic competition for Presidency of the GoSS let him resign honourabley and leave politics to those who know the rules of the game.

    What goes around comes around. Now the light and the truth of the SPLM-DC leadership is expelling the lies and darnkness of the SPLM leadership. God is watching!!

    The SPLM is the one the lodge a complaints against the so called SPLM DC in the constitutional court on the intellectual right of branded name. Dr. Lam infringed the name of SPLM and added his letters which has too caused him trouble. he has first committed this crime in early 1990s where he named his party SPLM United which eventually failed because of his political incompetency as well known by the Sudanese. he is playing with the fire. SPLM should immediately sue him in court on this criminal counts
    1- faking the SPLM names in 1990s
    2- Infringed SPLM name again on August 31 August 2009
    3- Inciting civil and militia groups in Malakal which led to the death of more than 1000 early 2006 upto date.

    Now, Dr. Lam is having SPLM as an excuse to his widely known betrayal background which can not be telorated by the Southern Sudanese at large. they will not vote for him given his historical background therefore, knowing this in his mind, he just want to brand SPLM so it becomes like his party SPLM DC.

    Shame on you Dr. Lam and the fools who are following you. beaware the followers are there to ditch your NCP money out of you for they know very well that anything you do always fail.

    The problem with Dinka is that they don’t advice each other when a person like Mr. cowboy is making fake decisions like banning SPLM DC from running its political affairs in south sudan. You should examine the baleful consequence of an act before rushing for a conclusion. Biong should not behave like his uncle Kiir simply because he came from the same tribe.

    Mr. Cowboy, it is not a time to introduce tranny in the South. you must be a dictator because you Do read ‘transitional constitution’ articles and you are not contented with its contents. you should not revive your popularity that way!
