SPLM-DC wins appeal at Supreme Court against South Sudan president

December 3, 2009 (KHARTOUM) — The Sudanese Constitutional Court ruled in favor of the appeal submitted by the leader of the SPLM-DC Lam Akol against the Government of South Sudan (GoSS) president, Salva Kiir Mayardit.

Lam Akol revealed that he has received a letter from the highest legal authority granting his appeal from a decision taken by the GoSS president banning his party in southern Sudan.

On November 9, Dr Luka Monoja Tombekana, GOSS minister of cabinet affairs, ordered the governors of all the ten southern Sudan states instructing them to allow the activities of all political parties “except the so called SPLM-DC”.

In a filing he lodged to the court, Lam Akol said the directive is incompatible with articles 29, 31, 33, 40 of the interim constitution “dealing with fundamental rights”. Akol added that the SPLM-DC is demanding the constitutional court to declare null and void the decision because of its unconstitutionality.

Dr. Amin Mekki Medani, legal expert, said the Constitutional Court would address a letter to the President of Southern Sudan asking him to allow the SPLM-DC to operate,

If Mr. Amin wish to give Lam a position, let him appoint him as a govern of Khartoum state. Not to allow Lam to lunch his deadly political idiology in south sudan.     There is no any party in Southern Sudan that can win except only the SPLM/SPLA. How many parties were formed against the SPLM/SPLA and still there is no any party win its strategies. Dr Riak Machar form SSIM, Paulino Matiip Nhial form SSPF, Dr Lam Akol form SPLM/SPLA United as well as Gordon Kong formed his own part and no one have ever come in true sence of turning SPLM/SPLA down.

    Dr Lam Akol and many other people whom I know are all dangling around for they knew nothing about what they are campaigning for. Arabs will use Dr Lam and many others of Nuer people such as Tanginya just to mention few of them for the benefit to deteriorate the move of the SPLM/SPLA. I know that the majority number of the people in Dr Lam Akol’s party are Nuer, Equatorian and Shilluk where the absent-minded host of the SPLM/DC belong.

    Shame to all of them.

    WTF IS “Sudanese Constitutional Court”????. This court has no right to suggest that Lam’s cloned party be allowed to operate in the South. We have our own Judicial System in the South. This Northern court can fuck off.This Traitor Lam Akol will not be allowed to operate in Southern Sudan because his intentions are against the will of South Sudanese. This guy is an agent of NCP. His intention is to ruin south. All Those tribal clashes are fueled by Lam. THERE IS NO WAY HE SHOULD BE ALLOWED TO OPERATE IN SOUTHERN SUDAN.

    Stop vomitting your raw milk without realising the smell and crying when people are criticising Kiir himself alone, Kiir can be criticised without linking him to his tribe or background. But in some case connecting him to his background will enchance the actually meaning of the logic, just like how blacks in America are still linked back to Africa because everyone knows that the black gene orignited from Africa. The same that the culture of GOSS has a great link to the leadership and its background. Any leader particularly poiliticans can be cricised. Kiir, Igga, Riek and Amum can be called dog, hyena, lion, Slave, monkey and many more. Not just for being politicans but also they are public servants. To prove this jump on vewvision and you will see horrible cartoons and words been used aganist Museveni. The same thing is happening in USA, NewYorkTime. Obama is been called nigga, slave, blackdog, blackgovernment but anyone is not concern since the words are been used in political manner to damage his individual image and influence others.

    This Lam Akol must shut his mouth. Hiring jallaba attorney for your nonsense can not help you in the South. You are different person since 1991 in the South. The constitutional right in Northern Sudan has no room in the the South. You have spoiled your credibility ever since,and in fact, Riek Machar plus his alikes will blame you till death. This court is not going to be liable for the ban of your ill party in the South.

    i am glad that the ruling party party has delayed the activities of the so called SPLM-DC what democratic change is Lam fighting for other than arming and distabiling the south in order to gain money for his greedy expenditure.

    Lam can win in the court but on the ground he shuold not be given chance to campaign by the ruling party in the south since has hidden agenda other than democracy. Lam is fighting for leadership. The court must have been given some rasua from the zakat which he is receiving from the arabs to win the court case. Lam though the court ruled you right we especially in Equatoria will not compromise with this party. thanks

    what is it about SPLM-dc, is there differenT with NCP i MEAN DO NCP AND SPLM-DC HAVE DIFFERENT, if so then what is their diferents.the SPLM HAVE RIGH TO BARN SPLM DC. It is very clear in CPA that there is no other part which will be founded after or no registeration of new part in anyway. the registeration and formation of new plitical part will be allow after 2011 in southern Sudan and that will be the right that Dr Akol will have right to partcipate in politic in south. but as per now the SPLM DC is not clear whether he is alone or need to be using by NCP.Am worry that after election government of Sudan may used Dr Akol for the unity of Sudan.
    but if AKol could learn from the lesson of former governor of uper nile states.Arab can be your friend to achieves his Goal. there is no good Arabic.

    Why don’t we give him freedom to compaign and lose since many Southerners don’t like him. Also Lam is from small tribe while Kiir is from the biggest tribe that ensure him of way-head win. Yes Dinkas alone are more than all southerners, so why worry now?

    Stopping Lam from compaigning will let him think that Kiir is scared of him. Again the world will see SPLM as unpopolar that is why it refused Dr. Lam Akol and his SPLM-DC access to compaign. Is also again the rule of democracy which entails the freedom of choice, speech, and elections such as this.

    please let not obstruct justice.

Hey guys I have learn about u boys and girls and about ur fragile country, U guys have better politicians I would like to make my comment in this sense, When I met Salva i was amused to see such an African hero who fought for the freedom of his people but let me tell u that, that can’t make him Legitimate for the System of South Sudan untill he gets the blessing of his people by votes. That is for the Big man and for Lam Akol I don’t think he will be successfull if he keep preaching about the wickness of SPLM in Khartoum but not Juba. Well he has the right to express himselves to Southerners and if he is capable enough then he will win the election otherwise my analysis lam need to changed where he lives where he practice his politic and come back to his people. “he who wants to save his people must always sacrifice” for his sacrifice shall be his success. Therefor I would like to say something about ur comments as commentators of this web site. ur are damn tribulistic and u don’t say something that can make u feel united to cite examples, people like Most Famous, Dinka boy, Oshay just to mention but a few.     Congragulations to SPLM leadership for banning SPLM-DC in South Sudan.It is not a first time for Dr Lam Akol to alleged against SPLM since the formation of the splm/a in 1983,So the NCP is behind that appeal and is the one who influenced Dr Lam Akol to form aparty as anti-Splm,s vision of Southerners’freedomand. We all know that one day one time there neither be NCP nor SPLM/DC in entirely Sudan.

    The doctorate of comrade Akol will not longer work in Southern Sudan in they way i see it, because Comrade Akol fail to remember he did to SPLM during the war regime, that why all leaders in Southern Sudan are against SPLM-DC party.

    SPLM-Dc is a bonifide of SPLM like COP and ANC of SOuth Africa, otherwise Akol should leave Southern Sudan politics because he is a triator of SPLM.

    Being chosen as foreign Affairs minister in GONU was not simple post, I regret why comrade Akol still betrayal SPLM and the attrocites he did are forgiven.
