SSRC denies intention to delay referendum in some south Sudan areas

December 15, 2010 (KHARTOUM) – The Southern Sudan Referendum Commission (SSRC) has denied it has any intention to cancel or delay the referendum in some areas in south Sudan, the SSRC’s media secretary Gorge Makuer said on Wednesday.

Makuer further said that the commission, which is organizing South Sudan vote on independence, was on schedule to hold the referendum in all areas and as planned in January 9, 2011.

The SSRC’s spokesman also said that the commission did not receive any notification from Sudan Constitutional Court to the effect that it had accepted a motion put forward by a legal team against alleged violations in the voter-registration process.

However, Makuer added that the commission does not object to dealing with all judicial authorities regarding the legal aspects of the commission’s work.

News of the motion was reported on Monday December 13 by the government-run Sudan Media Center (SMC) which reported that the constitutional court had accepted the motion “in form and content.”

Quoted by SMC, the head of the legal team Haj-Hamad said that the next step would be for the court to consider their request and also order the SSRC to file a response to the motion after hearing the arguments and then issue a final ruling.

Haj-Hamad said they had asked the court to annul all procedures arising out of the voter registration and immediately suspend the work of SSRC until the court reaches a decision on whether the commission should be dissolved and have a new one established that would adhere with the Referendum Act of 2009.

A decision by the court to suspend the commission will almost certainly result in delaying the politically sensitive plebiscite which is already encumbered by logistical obstacles.

Voter registration for south Sudan referendum on independence ended last week, with almost three million people signing up to vote in the south, electoral officials said.

The vote is the final stipulation of the Comprehensive Peace Agreement (CPA), the 2005’s peace deal that ended decades of civil war between north and south Sudan.

    To whoever edited/published this article,

    The SSRC Media Secretary is not called Gorge Makuer,take note that it is called George Maker Benjamin Bil.We don’t accept a delay,even for one minute,leave alone days.The plebiscite should start on the 9 of January and by delaying it for a single day,will be violation of the PACT.

    Folks,

    Some of the postings looks interesting but at the same time somebody thinks Southern Sudanese are still foolish to be played with like this.

    Just wanted to add my thoughts on some of the recent developments which started with some so called lawyers filing a petition to the constitutional court against the SSRC. However, the funny part of it was that these petition was crafted by some Egyptian lawyer…imagine!! What do these foreign actors want us to do?

    When Sudan moved a motion for independence, southerners had wanted federation as the form of governmenance; this was a pre-requisite for southerners to support the independence motion. However, southerners were deceived that the issue of federation would be handled internally after attaining independence.

    When Sudan attained independence, our northern brothers had to go for “a second thought” of hiring some Palestinian lawyer to advise on federation and the result was that Sudanese was still young for federation…whatever that meant.

    Similar under-hand tricks are being employed today! It is my humble request that GoSS be prepared to execute the “plan B” for the referendum; that is, organise our own referendum through the Southern Sudan Referendeum Bureau (SSRB).

    Why am I saying all these!

    1- During the elections, NCP won 73% of the seats in the national assembly and SPLM won 22%. Meaning that NCP had all the quorum to carry on business in the assembly based on their majority seats. If so, then why did they drag their feet in adopting the necessary referndum laws in time?

    2- Seeking court guidence at this time is intended to delay and cause the postponement of the referendum which is in itself a violation of the CPA provision on the conduct of the referendum. Besides that, postponing the referendum at this time is re-negotiating the CPA…what the hell are the so called lawyers saying?

    3- The cost of postponing the referendum will be far greater that the benefits; expect loss of lives including property and to avert that, GoSS should step in and facilitate the timely conduct of the referndum on January 9, 2010 through the SSRB.

    Less than that, then expect a full scale war for which southerners are well prepared for.

    We the southerner will not accept fool proof, of saying referendum in some areas of south will be delay. That is absolute wrong unless is confirm by “we” Southerners togetherness we can do.

    NCP activities to block our independence is always a tactic and we should all not take them serious, remember we are holding peace in our left hand and a Russian AK47 in our right hand, the moment the let go the peace, we will not hesitate to tell them that, Hey! you have exceeded your limit, let them keep on Joking, for how long are we going to be their “abid” slave.

    my message to mr.khail is that please khail be ware that if you delay referedum GOD will deal with you one by one because referedum was brought by world leaders which were chosen by GOD to do southern sudan will.delayment of referedum will not make us peacful at all in sudan as wholly.we know referedum has got a tail from u but don’t try dat because war will not stop in wholly sudan.remember if we go back to war again we will be inside capital-kto and that will be the end of u. by freedom fighter son

    We don’t care if they are lawyers or NCP members it doesn’t matter referendum will be on time no matter what happen in Khartoum, its not our problem its their problem.
    Do we really care a bout Sudan constitution, personally I don’t think so.
