LAKES: Court reduces life imprisonment of former county commissioner to 10 years

January 31, 2011 (RUMBEK) – The Court of Appeal for Greater Bahr El Ghazal in Rumbek, the capital of Lakes State has reduced the life imprisonment imposed on September 9, 2010 by Lakes state High Court against accused former Commissioner of Yirol West County Agok Manyiel Dhieu.

Manyiel was accused of masterminding the killing of his bodyguard in Anuol Payam of Yriol West County of Lakes state in 2008. On Friday the appeals court changed the sentence of life imprisonment into ten years imprisonment and raised the compensation from 31 to 51 cows to be paid to the relatives of the deceased.

A family member of former commissioner speaking to Sudan Tribune on condition of anonymity alleged that this case have a lot of political motivated but his decline to details more behind.

However, Manyiel has rejected the court verdict saying that the court’s decision and saud his advocate Monyluak Alor Kuol will lodge an appeal.

The former commissioner strongly denies being behind the killing of his bodyguard saying that he was asleep at the time.

On September 9, 2009, Sudan Tribune reported that Justice Noah Gabriel Kau, of the Lakes State High Court in Rumbek passed sentence saying: “Manyiel was sentenced into life imprisonment charged and convicted under section 52/140/206 of the Penal Code Act, 2008. He was sentenced to life imprisonment and was also ordered to pay 31 H/C or its equivalent of 29,500 SDG to be procured by civil proceedings to the relative of the deceased Ahon Kerkon Takping”.

FINAL ORDER SIGNED BY president of the Panel judge Alexander Muludyang Jada:

1. The payment of the dia by the convicts is altered from 31H/C to 51 H/C to be paid by each of the convict to the relatives of the deceased as ruled by the Lakes state High Court.

2. The sentence of life imprisonment imposed by the Lakes state High Court on the accused Agok Manyiel Dhieu Alam is commuted to only (10) years with effect from the date of passing the sentence.

3. The sentence if fine of 5,000 SDG is hereby imposed on the accused Agok Manyiel Dhieu Alam and in default of pay fine to be imprisoned for six months to run consecutily with the first sentence of imprisonment.

4. The sentence of 10 years imprisonment imposed the accused Achil Abal Acuil is hereby confirmed with the effect from the date of sentence.

    Dear Readers,

    This is a clear message to people in authority that they are not immune to prosecution and that the era of impunity is gone.There is need for Anti-Corruption to expedite investigation and arrest,charge and prosecute the high profile figures involved in rampant corruption.Moreover,those who tried to take the life of BOSS Governor,Elijah Malok,should be apprehended and investigated thoroughly as the plotters might be the GOSS corrupt officials who wanted eliminate witnesses and deflect attention from their dealings.The GOSS should accord Elijah and Pauline special security,and must not be drawn from the SPECIAL BRANCH as they are from one ethnic community and highly politiced and a bunch of criminals.

    That is at least fair,because an effective leader like Agok Manyiel can not be in a life imprisonment.
    But if the story is still the same the way it was posted last time,than still it is no laws.there must or may be some thing is wrong,because it was clear that mr Agok Manyiel was not around when the incident occur or instructed the so call Acuil.

    Therefore,reduction of laws aganist people is more important
    The bias in the perception of laws wasn’t in the fact of humanity,Micheal Agok would be free in the fact of lake state.compensation wouldn’t be used, because of his bodyguard,”Bodyguard is life protection”. if he killed him, what do you think he will found or achieved?
    Micheal Agok had experience of civil autheriths that he cann’t work differently among his people.The concepts of discriminatation wouldn’t be encourage to leads the position of Micheal Agok look negative to his people.Micheal Still love his people via people to him.
