August 10, 2011 (JUBA) – South Sudan’s vice president, Riek Machar, has apologised to the Dinka Bor community by acknowledging his responsibility for an incident in 1991 which resulted in the loss of hundreds of lives in the community, announced a deputy spokesperson of the South Sudan army, the Sudan People’s Liberation Army (SPLA).
The officer in charge of the SPLA information department, Malak Ayuen Ajok, revealed on the official South Sudan TV that Machar acknowledged his responsibility of the 1991 incidence in Bor following his defection on 28 August 1991 from late John Garang’s leadership.
At a gathering organised by the Dinka Bor community in Juba, reportedly attended by Machar, the army officer told the TV viewers that a number of Dinka Bor community elders including Rebecca Nyandeng de Mabior, the widow of late John Garang, expressed their forgiveness to the vice president.
Malaak, who did not or quote Machar, explained that the apology was the beginning of a reconciliation process and commended the vice president for accepting responsibility of the incident.
The apology has received with mixed reactions by individuals among the Nuer community in Juba and abroad.
Some told Sudan Tribune that the apology was premature and incorrect, calling it a tactic by the Dinka Bor community in order to use the apology against him in the future.
Others welcomed Maxhar’s reconciliatory tone but said it should have been reciprocated with a similar apology by the most senior leader of the Dinka Bor community or Nyandeng, on behalf of the late John Garang for similar incidences that resulted to loss of hundreds of lives in the Jikany Nuer community.
“I don’t believe Riek Machar apologised just like that to the Dinka Bor community. If it is true and aimed to reconcile with the Bor community, then that reconciliation should have been a two-way process. Who among the Dinka Bor’s top leaders apologized on behalf of late Garang for the killing of Jikany Nuer unarmed civilians in 1985?” asked Deng Gatluak.
“Yes, I heard Malaak Ayuen revealing the apology on television. I think they have set him [Machar] up and recorded his confession if it was true so that they can use it against him as evidence of crime. I have been hearing ordinary Dinka boys and girls talking of wanting to take him to the ICC [International Criminal Court] or any other court over the 1991 incident. They may use his apology as an evidence to present to court or to blackmail him with it as a leader,” said another who asked for anonymity.
He went on to question why the apology did not come directly from the source.
Gordon Buay, the former Secretary General of the South Sudan Democratic Party said he was shocked by the apology.
“I was completely shocked that a man like Riek Machar could apologise for 1991 Nasir Declaration which brought the right to self-determination to fore. It is very sad indeed that Riek Machar should reduce himself to the level of Peter Gatdet,” Buay said, referring to another Nuer rebel who recently rejoined the government.
Lul Gatkuoth Nguth, a member of the South Sudanese diaspora in Canada, welcomed the apology, saying it is a politically astute move, to bring peace and harmony to the communities.
“In my opinion, it is not shame that Riek Machar Teny apologized to Dinka Bor community. This is how the politics work. If you go through peace and conciliation process, this term ‘apology’ has to apply if you are a real good politician who has a big mind,” he said.
In 1991 the vice president, Riek Machar, split from the SPLM/A under the leadership of late John Garang, calling for self-determination for the people of South Sudan to be the main objective of the movement. He and the current leader of the SPLM-DC, Lam Akol, also cited a lack of democratic principles and human rights abuses as factors that prompted their split.
Machar however rejoined the SPLM/A in 2002 with his forces and has been the party’s deputy chairman as well as the vice president of South Sudan for the last six years.

Well, I think the apology was necessary given that Dr.Machar is the VP and potential president of this Country, he ought to apologise to Dinka Bor in particular, comrade in arms and the whole South Sudanese people. I belief it makes sense to apologise for the wrong doing but the question is, is there a substantial evidence indicating that Riek has actually apologised?
If that is true then, there is also a need for many more other people from within the top splm/a leadership to apologised.
My advice to my brothers from Dinka Bor community is that you need to be very objective enough if comes the extraction of the truth from the case study. Who ever was invoved in 1991 Bor incident was not targeting civilians rather the army in Bor.

I have never heard of an organized genocide attack by Dinka Bor to the Nuer Jikany in 1980s, may be SPLA (Anyanya) has to be blamed, if any really happened . And for those Nuer who think Dr.Riek’s apology is not due and worthy, they should not waste their times saving the SPLM the stabbed at the back,instead they should re-form SPLM Nassir/SSIM and have its vision achieved by the Southerne as did the SPLM-Torit.

There is no reason for Dr. Machar to apology to Dinka Bor s’ community only, because of the 1991 war. This war was not weight on the civilian by any one of the both leaders, either Riek or Garang. It was retaliated between their forces and to defend one s’ principle.

Awet, Gier, Pres Kiir are not from Bor. Kuol Manyang was not in Juba during that meeting, so quit lying to the world.
In 1985, Dinka Bor were not responsible for anything happened in Jikany, it was the SPLA/M led by Nuer son William Nyuon. So if you need an apology for that then ask the SPLM party and Dr. Riek will do it in behave of the party. When Gai Tut split from the SPLM, he went to Lou areas and convey wrong message to Nuer people in the village that the movement was taken away from his by Dinka Bor. He told them not to join the SPLM because it is for Dinka. The hostility toward SPLM soldiers was created by Gai Tut. When SPLM came to Lou area to inform them to join the movement, Lou young men ambush them, kill them and take their guns.
After several tried by SPLM to convince Nuer to join the movement, Garang send South Sudan war hero William Nyuon to handle the situation, but foolish Nuer coward keep attacking the soldier (SPLM) for no reason, therefore, Nyuon response in retaliation and that was a right thing to do. Now you are blaming Dinka Bor for that, what a shame.

I was in the movement during the Civilwar, if i go back to point out what others did to certain Tribes, it may bring us nothing but trouble to our New Nation .Dr. Riek appology is not only to Dinka Bor,but to all the Southerners. Such a like of Matip, Gatluak who recently persihed while hunting power, Cibitek who is also reported to have shamefully died in the bushes of Jonglei state and many others, are all illitrates and that is what illitracy means. If I can ask, what have you to do with that big humiliation brought to you by your most illitrate greedy kin rebels who have just decided to come back without an inch of achievement after having accussed Goss of lack of democracy, corruption and tribalism just as does Riek?
It is your assignment to go ahead and mention who among Dinkas holds any senior position without education background. But anyway as usual, all your claims have no grounds and this constitutes the reason why you are perservered like the defication of a baby child on human’s thigh/s.

Therefore, killing all civilians in Dinka Bor areas before decision is made to redeploy SPLA from around Juba was to hurt John Garang and his Bor military officers to relinquish SPLA/M leadership to Riek Machar and Lam Akol. It is a documented case and all minutes of the declaration to exterminate/annihilate Dinka Bor on the face of the earth are clear and still there up-to-date in written form (SPLA/M Nasir Declaration by Lam Akol – this book contains much information for those who talks without knowing the facts).
Dr. Riek Machar indirect apology on crimes against humanity in a visionless war against innocent civilians of Bor is totally unaccepted and rejected. It would have been accepted if Riek Machar apologized in June 2002 after he shamelessly and single handedly came back to John Garang in Nairobi.
Riek Machar is now vulnerable politically and he knows without Dinka Bor and the whole Dinka support on his side, his position of VP is likely to be given to another capable citizen of RSS in the next few years; and therefore, the apology comes at this time to salvage move by President Salva Kiir to fire him in the future.
Riek Machar should withdraw his indirect apology, Bor massacre cannot be used as a tool to keep him in power. Riek Machar must be tried in a competent court of law so that other mindless people should be careful in the future from committing such heinous crimes.

Honestly, I have found myself inspired to write on this topic about Dr Riek Machar apology to Dinka Bor community. All of us, at some point in our lives have felt the desperate inner turmoil and confusion that comes from feeling that we have been “wronged” or betrayed in some way. You fight to understand what is wrong with a person to have done such a thing, or to be such a way. Have I deserved such treatment? The list of inner feelings goes on and on as we try to make sense of our lives. As you well know, the consequences of that inner turmoil run quite deep down. On one end, your life can become filled with resentment and anger.
Forgiveness is a choice the forgiver makes to let go of resentment held in the forgiver’s mind of a perceived wrong or difference, either actual or imagined. As the choice of forgiveness is made in the mind of the forgiver, it can be made about any resentment, whether toward another, oneself, a group, a situation or even one’s God. Forgiveness of another can be granted with or without the other asking for forgiveness.
Forgiveness – whether it is forgiving yourself or others – is a major piece of the puzzle as we look at the elements necessary to create a prosperous and abundant life.
What I want to make clear in this discussion is that, yes, you certainly are “justified” in feeling the way you do – always – whether we are talking about forgiveness or any other issue. Your feelings are always valid. They are always your experience. They are always right, and you have the right to choose how you will feel. You are at choice, and your choices work for you – they protect you. I am not here to tell you that your feelings are wrong. BUT it is important to acknowledge that you have the power to choose your feelings…and if they resonate in a way that is not alignment with your highest good – and what you want for your life – then you get to choose something different! So, as it relates to your sense or experience of prosperity – forgiveness is a must. If you do not choose forgiveness, you may be choosing the lack of it, which translates into anger, resentment, fear, frustration, etc.
To me, no need to keep an account for revenge because revenge or vengeance consists of retaliation against a person or group in response to perceived wrongdoing. Although many aspects of revenge resemble or echo the concept of making things equal, revenge usually has a more injurious than constructive goal. The vengeful wish is to make the perceived wrongdoer go through what they put the victim through or to make sure the wrongdoer can never do what they did again. Revenge is a hotly contested ethical issue in philosophy. Some feel revenge is necessary to maintain a just understanding of things.
HOW do I forgive?
The philosophy behind anger management should be emphasized. Here we say that anger management is commonly referred to as a system of psychological therapeutic techniques and exercises by which one with excessive or uncontrollable anger can control or reduce the triggers, degrees, and effects of an angered emotional state. As the issue of anger varies from person to person, the treatments are designed to be different as well. Here is how one can go through forgiving process:
1. Know that forgiveness is a choice, and even a skill. You weren’t born unforgiving and you shouldn’t beat yourself up about where you are in your ability to forgive at this point. Be good to yourself and honor where you are.
2. Start with a forgiveness inventory and ask yourself what you get out of keeping the pain, hurt or anger. Like it or not, there is a payoff.
3. Know that forgiveness is not about minimizing your pain or others actions, or staying in a situation that does not honor you.
4. Choosing forgiveness is the first step. You need not rush the process, for learning how to forgive and using that in your life is a key prosperity.

Dear Southerners, conciliation and forgiveness is part of lives as human beings. Dinka different clans as well as Nuer different clans fought each other for years and reconcile and forgave each other for years.
The same was also true for Nuers and Dinkas but few educated members are the ones who made this brotherly differences deadly just to reach power they are hungry for and when their wrong preaching by non educated, it becomes destouriuos.
Good Sputherners should welcome the apology and shouldn’t be used politically by either side to serve their interests. Dr. Riek accepted the 1991 incident as the leader of that movement and I don’t think it was Riek intention to kill the very people he fought for their rights for many years and whom he wants to lead as he is doing as we speak. What happened in 1991 meant have been caused by some bad apples within his circle that he must have lost control of and we know our people very well.
Dr. Riek was highly respected by his unit and the overall SPLA before his rebellion but it was the bad apples within his community that robbed him of his respect but that he has shown his willingness to serve his south Sudanese people. Yes Dr. Riek is a Nuer by tribe but he is a national figure that struggled in the past for Southerners and he is now doing due job for the very people.

To a degree, this is a wise decision and it has the potential to kick-start a reconciliation process in South Sudan. For him, it was a fun way of quenching his blood thirst. This piece of murky apology should not be ignored. It is a small step in the right direction. It is the beginning of our national healing. Remember that only reconciliation is what brought national harmony in South Africa after the apatheid horror.
In the beginning, there was no problem between the local population of Nuer and Dinka Bor, the problem was between the leaders and the politicians. And that is what created a mess. In order to clean up this mess, it is the politicians who created it in the first place are the ones that are going to clean it up, so that the general population will feel comfortable with one another.
To those Nuers who are blaming Garang, you need to ask yourselves this question:
Why didn’t Garang order all the SPLA (at least the Dinka part of it) with tanks and heavy weapons to destroy all Nuer wherever they were in the South in 1991?
Only those constantly attacking Bor were repelled and the SPLA was told to stop, though anger people did obscene things in Ayod in 1993. Because Garang knew that the problem was not with little children and old men and women. The problem was with politicians and there was no need to make the Nuer population suffer.
To those Dinkas who are rejecting Riek apology; ask yourselves this:
Why did Garang accepted Riek when he returned in 2002 and did not seek revenge?
Now it is up to Riek to decide whether he has to be remembered for what he destroyed or for what he will built.

Gajaak people were complete outlaws, they ambush SPLA soldier and kill them just to take guns from them. In one instant they kill SPLA soldiers and took RPG. The “New Sudan,” vision and its effects on Southern Sudanese unification

The 1955 Torit mutiny marked the beginning of the 17 year old war that was ended by the defunct Anya-Nya I and by the Anya-Nya II insurgencise from 1975-1983, were fought on the priciples of the right of self-determination-meaning the establishment of an independent and sovereign State in the South. When the Addis Ababa Accord of 1972 was signed as an attempt to bring the country its first civil war [1955-1972] between the government and the rebels’ movement to an end, there were a pocket of Any-Nya I elements who doubted about the implementation of the Accord due to lack of commitment and seriousness from the government side. Those few separatists remained in the bush despite the Accord until many other rebelious soldiers of the Sudanes Army rejoined them after Akobo mutiny in 1975 spearheaded by CDR. Vincent Kuany Latjor, eight years before Bor and Ayod mutinies erupted in 1983 respectively. They became a unified force and carried the name SSLM/A or Anya Nya II, the only well-known name for many people under CDR. Vincent Kuany Latjor’s command, whereas the greater Bilpam became their Headquarters. There were over 7,000 troops behind SSLM/A [Anya-Nya II] and the objective of their movement was for total separation of the South from the rest of the country unlike SPLA/M with its “New Sudan,” vision.
After the arrival of “Newcomers,” in 1983 as Anya-Nya II call them, two camps were formed within “New-arrivals/Newcomers,” Camp A, was under the leadership of Lt. Col. Samuel Gai Tut Yang, Mr. Kuot Atem and CDR. Abdalla William Chuol Deng. Meanwhile, Camp B, led by Col. Dr. John Garang, CDR. Kerubino Kwanyin Bol and CDR. William Nyuon Bany. It is noteworthy mentioned the factious between the two camps and it was due to critical following factors: 1) What should be the sole objective of the movement and its principles, and 2) Who shall lead the movement [SPLA/M?] Camp A, proposed that the objective of the movement shall be “self-determination for South Sudan which mean total separation for South Sudan from the rest of the country, and it shall be led by Mr. Kuot Atem follows by Lt. Col. Samuel Gai Tut Yang,” instead camp B, did not only reject that proposal, but came up with its own ideology, an ideology of “‘United Socialist Secular/New Sudan,’ and the leader of the movement shall be Lt. Col. Samuel Gai Tut Yang follows by Col. Dr. John Garang.”
It took the two camps few months before camp B rushed to use force against camp A due to fact that, the Ethiopian government which sealed a conspiracy and surreptitious deal with Garang against the separatists was acting behind the scene rather than being a mediator between the two rivals. From their last meeting, CDR. Rhino William Nyuon Bany who doesn’t care about the human life pulled out his pistol and hold it with his right hand while pointing it at Lt. Col. Samuel Gai Tut Yang and CDR. Cobra Abdalla William Chuol Deng, and said “from today onwards, anyone who appears to oppose Dr. Garang’s leadership and the objective of the movement must not be silenced by talks, but bullet.” Thus, Camp A, took technical withdrawal from the area (Itang) without a fight to avoid casualties which may result within the town and to give camp B more time to resverse its dead-end judgments toward South Sudan issues.
To make the matter worse, after Col. Dr. John Garang’s group secured its position against Lt. Col. Samuel Gai Tut’s group, the seizure of Lt. Col. Samuel’s group by Mr. Marxist-Leninist Garang’s group did not satisfy Garang’s appetite, but went further and channeled his plan to annihilate the SSLM/A [Anya Nya II] in Bilpam by force due to fact that this seccessionists’ movement shared the same objectives and principles with Camp A. Therefore, to secure the “New Sudan,” vision fully, the “Any-Nya II HQTRs, Bilpam must be destroyed and/or dislodged from its foundation,” Garang declared. And on other hand, Mr. Mengistu Hailemariam of Ehiopia, a man who got separatist rebels’ movements [Woyane & Shabiah] in his own backyard , decided to impose his socialist ideology on southern Sudanese, and that mission must be fulfilled by someone who believes in that vision; “Dr. Garang must be the right person,” according to calculation of Dergue regime base on its interests and bipartisan issues between the two allies.
With no regret, the Ethiopian armed forces along with few elements from Garang’s group launched an asault against the Anya-Nya II position in October 1983 which caught them by surprise. The Anya-Nya II Headquarters, Bilpam was not only smashed down to ground, but also many of its separatists’ fighters were eliminated and those who caught alive were ordered to dig out their own graves before excuted them by firing-squad if they repudiate joining the former Marxist-Leninist SPLA/M. Of cours, many deserters from SSLM/A [Anya Nya II] joined Garang’s group conditionally, amongst them; CDR. John Kulang and CDR. Kuach Kang.
There exist relationship between the Anya-Nya II and Lt. Col. Samuel Gai Tut’s group came in exsistence before and after Garang’s group failed to engage Lt. Col. Samuel Gai Tut’s group in dialogues, but in confrontations in Warfield as he [Garang] declared from his under ground rally. Thereafter, Lt. Col. Samuel Gai Tut’s group merged with SSLM/A [Anya-Nya II] under his leadership since Vincent Kuany Latjor, the Anya-Nya II first leader was caught alive and put into very isolated World (prison) after his Headquarters, Bilpam was burned down to ash by the two Marxists [Mengistu & Garang.] Without Ethiopian armed forces back-up, can Garang’s group alone be attempted to annihilate Anya-Nya II forces in Bilpam?
In war, the skin of Fox is at times necessary as that of a Lion, for cunning may succeed when force fails. Speaking from his undergound rally as mentioned so far, in a message to his disciples, he declared that “the first bullet must be fired against the separatists [Anya-Nya II],” as an attempt to impose his self-claimed “New Sudan,” vision on Southern Sudanese and hijacked the movement from its founders/separatists altogether, coincidence?
A year later, Lt. Col. Samuel Gai Tut’s group, [SSLM/A /Anya-Nya II] who were expelled from Ethiopia came back to engage Garang’s group in dialogues because there exists, the great hope from the separatists’ side in the vision of reunification of unionists [SPLA/M] and separatists [SSLM/A/Anya- Nya II], as it had been the case against “Dergue” regime of Mengistu Hailemariam by two rebel factions [Woyane & Shabiah/separatists and unionists] from his own backyard who accomplished their mission in May 1991 when they waged a war agaisnt the tyranny regime under unified force. What if the Sudan’s rebels [Unionists and Separatists] put their differences aside since 1983 and confronted the common enemy, the Khartoum government[NIF/NCP] as a unified force? I leave the answer(s) for you.
First, they [Anya-Nya II] camped at Mangok, Chatyier and other surrounding areas on their way toward Achua (Itang) where the talks should have been renegotiated. The SPLA/M was reluctant and not fain or serious to deal with SSLM/A [Anya-Nya II] in dialogues, but in warfare instead. While the Anya-Nya II was waiting for talks to resume once again after arrival at Itang, the SPLA/M and Ethiopian armed forces were planning to encircle the Anya-Nya II forces in order to capture their ringleaders alive and/or eliminate/imprison them. This left Lt. Col. Samuel Gai Tut with no other option, but to withdraw his troops from the town which they have surrounded for more than a week after he learned that, Ethiopian government and the SPLA/M were not interested in peace talks, but war.
CDR. Cobra Abdallah William Chuol Deng, a man who fears no man on earth, the human toll was the least of his concerns rejected Lt. Col. Samuel Gai Tut’s order and wanted the whole town to be burned down to the ground, this prompted Lt. Col. Samuel Gai Tut to order some of his soldiers to tie-up CDR. Cobra Abdallah William Chuol Deng. Lt. Col. Samuel Gai Tut did that not only to avoid heavy casualties which may result mainly on innocent people [women and children] in the town, but also to give Col. Dr. John Garang’s group more time to relinquish its poor “New Sudan,” vision for the movement. Lt. Col. Samuel Gai Tut’s last word to Col. Dr. John Garang and his subordinates after the talks failed in 1984. Mr. Samuel said, “Mr. Garang, you have not anchored South Sudan to your ‘New Sudan,’ vision, but you have anchored your ‘New Sudan,’ vision a unified Sudan to South Sudan. In the end, my friend(s) you’ll find it will not work. It will be ghastlier than you can even imagine.”
Mr. Marxist-Leninist Garang’s group viewed Lt. Col. Samuel Gai Tut’s group retreat as a defeat to Anya-Nya II, and as such; “the next step must be to chase them until their ringleaders are eliminated and/or caught alive.” The second engagement between the Anya-Nya II and the SPLA/M at the battle of Thiajack (Adura) was not a big surprise to Anya-Nya II forces and as a result of that clash, the Any-Nya II forces did not only burned down the town which was under the control of SPLA forces at the time, but inflicted heavy loses on unionists’ side, killed many, scattered and pursued those who could run for their safety until they reached Mangok-Chatyier unknowingly. Yet even though, the victory was on separatists’ side, from the battle of Thiajack, a man who loves and value all human being from all walks of life regardless of ethnicities; a man whose vision has been for South Sudan independence; a man who qualified both in politics and military and above all, a SSLM/A [Anya-Nya II] leader, Lt. Col. Samuel Gai Tut’s life was cut short in that ruthless, aimless and epic conflicts between the separatists and unionists just simply because he opposed Mr. Marxist-Leninist Garang’s self-claimed “New Sudan,” vision. This shameful death will never be forgotten for generations to come.
After receiving the bad news, regarding Lt. Col. Samuel Gai Tut’s death, CDR. Cobra Abdallah William Chuol Deng became wild and ordered the Anya-Nya II troops to “fight like mad dogs against the unionists to the last man.” As a result, many lives were wasted from both sides in many engagements, counterattack after another. The SPLA/M activities were blocked by the Anya-Nya II forces across the greater Upper Nile until Lt. Gen. Gordon Koang Chuol declared that, “there is no need for Mr. Garang’s “New Sudan,” vision to keep South Sudan hostage, but to reconcile with unionists and challenge Garang’s “New Sudan,” vision within.”
DK. Koat Matthew played a crucial role in that strategic move, but a man of his words and fearless man, Lt. Gen. Lion Paulino Matip Nhial declined the move and said, “I’ll never united the Anya-Nya II with Marxist-Leninist SPLA/M under Mr.Garang’s leadership with his “New Sudan,” vision. If I do which I doubt, that will be the day when I walk with my feet upside down.” Which mean, over 80% of Anya-Nya II forces under the command of Lt. Gen. Lion Paulino Matip crossed the great Nile from East Bank to the West side, whereas Mayom became their Headquarters, meanwhile, the remaining 20% under the command of Lt. Gen. Rhino Gordon Koang merged with SPLA/M, which gave Garang’s group wide-gauge windows to capture many towns and garrisons from the common enemy [NIF/NCP] including Nasir town itself. Then, what if the whole Anya-Nya II [Separatists] merged with SPLA/M [Unionists] and confronted the common enemy as a unified force regardless of their differences? With no doubt, Mr. Marxist-Leninist Garang’s “New Sudan,” vision was a setback to Southern Sudanese unification since 1983 and its brings many advantages to the main enemy beyond unioinsts’ imagination.

Dr. Riek was compelled to declare Nasir move, not only because Mr. Garang was running the movement like his own property which was acknowledged by Lt. Gen. Salva Kiir after it was already too late in 2004 when he find himself openly at odds with his superior, but due to lack of clear directions, objectives, principles and human rights for/in the movement. Therefore, if the Naath (Nuer) as a community has been hungry for leadership as Jaang (Dinka) always shamelessly claim it, why would Lt. Col. Samuel Gai Tut select Mr. Akuot Atem who is a Dinka by tribe to be the leader of the movement in 1983 if not only because the selection was rejected by Mr. Marxist-Leninist Garang? Why would CDR. William Nyuon Bany aim his Pistol at Lt. Col. Samuel Gai Tut, CDR. Cobra Abdalla William Chuol Deng and their supporters just to secure another Dinkaman, Mr. Garang’s leadership?
In the Garangist mental scheme, all the “anti-New Sudan,” who still believe in Anya-Nya II vision of secession must be eliminated. As far as Garang knew, the SPLA forces of Torit faction under his command had every reason to believe that they had upper hand and that they could make it all the way to Nasir. Garang thought that the SPLM/A-Nasir faction under the command of Dr. Riek was very weak, demoralized and incapable of defending its Headquarters, Nasir let alone taking offensive operations. Shortly after the Nasir Declaration of August 28, 1991 was announced, Garang declared, “the Gang of two Drs,” as he prefers to call them (Dr. Riek & Dr. Lam) “must be given their last blow.” He went further, “we will break them down soon, and it is a question of time before we bring the separatists to the vision of no-return.” After Garang’s statements were intercepted by SPLM/A-Nasir faction, Lt. Gen. Tiger Bol Koang declared that ” the very existence of the SPLM/A-Nasir fation is in danger,” and demanded that “all soldiers stand firm and fight to last drop of blood.”
Not surprisingly, the SPLA-Torit faction forces under the command of CDR. Rhino William Nyuon Bany launched an assault which routed almost instantly against the Anya-Nya II position along with few soldiers who appeared to be from SPLA-Nasir faction forces, burned down some villages from Nuer Genesis homeland Bentiu [Liech/Unity State] including Leer, Dr. Riek Machar’s hometown. What CDR. William Nyuon and his forces didn’t realize at first was that in the second half of September, Lt. Gen. Lion Paulino Matip already redeploying many of his troops [Anya-Nya II] to prepare for “Operation Typhoon.” Instead of accepting their fate, the Any-Nya II fought back with a ferocity that stunned the ill-prepared Torit-faction. Most of Torit-faction troops were ground-up by the Anya-Nya II forces. The Any-Nya II forces under the command of Lt. Gen. Lion Paulino Matip did not only inflicted heavy losses on Torit-faction, but pushed back William’s forces and penetrated deep inside BEG. This campaign against CDR. William’s forces, compelled them to retreat from the area just after Lt. Gen. Lion Paulino Matip sent in more reinforcements.
But the SPLA-Torit faction forces under the command of Lt. Gen. Salva Kiir and Lt. Gen. Kuol Manyang Juuk who were deployed from the direction of Kongoor and Pochalla respectively to wipe out Dr. Riek Machar’s forces as ordered and predicted by Mr. Garang, failed miserably from their suicide attempt, instead encircled and pursued like hunting dogs chase rabbits or deer by Dr. Riek’s forces under the command of Lt. Gen. Tiger Bol Koang and CDR. Tiger Koang Banypiny. As a result, almost all the surrounding garrison-posts under the control of SPLA/M-Torit faction: Duk Padiet, Panyagor, Kongoor, Twic East, Mading Bor … plus some part of BEG were burned down to ash when the “Operation Typhoon,” was launched as the two Heroes (Bol Koang & Koang Banypiny) call it. Garang understimated the SPLM/A-Nasir faction military strength, but his commanders on the ground knew they were often paying a heavier price of them than expected in terms of casualties-and that, in many areas, the Torit faction advance wasn’t moving as swiftly as they had hoped. Garang’s commanders were preoccupied with the more immediate goal: ensuring that their troops would maintain their progress as they prepared to strike Nasir faction from all directions.
Dr. Riek ordered his troops to withdraw after reaching Jumeza in greater Equartoria. The SPLA forces under Torit faction suffered tremendous losses and their mission to bring “the Gang of two alive or dead and trash the self-determination for Southern Sudanese into garbage bin for good,” as Garang declared earlier before the war widespread like a wildfire beyond his imagination, failed miserably rather than vice-versa. A straggering pace that reflected the disarray of Garang’s subordinates encountered in most of the areas under attack. Torit, Kapoeta, Yei … were on the verge of cowardice and panic-mongering evacuation until the common enemy overan almost all the liberated areas without any resistance from Garang’s SPLA/M-Torit faction. Why did the SPLA/M-Torit faction fail to withstand its ground?
Many areas including major towns: Torit, Kapoeta, Mading Bor … were recaptured and/or surrendered to the common enemy without a fight as a result of split. The remaining few garrisons/towns under the control of Torit faction were on the verge of panic of evacuation either to Uganda or Kenya refugees’ camps as well. Garang was blinded by his burning conviction that Torit faction has to depeat and subjugates the Nasir faction, a movement that he contemptuously dismissed as “a Gang of two.” Garang himself suffered a near psychological collapse as his faction looked as though it might implode. Garang’s forces should have been crushed/break down and/or chased up to Kenya/Uganda-Sudan borders if Dr. Riek was for military option rather than reconcilation through peaceful dialogues. Garang’s “New Sudan,” vision did not accomplish anything, but setbacks, chaos, death, subjugation by terror and epic conflics between the separatists and unionists. It was Garang’s ambition in war that compelled Nasir faction to take immediate retaliatory-military countermeasures. The burning questions are: What prompted Garang to be the first to ignite the fire which he could not extinguish? Did Garang’s SPLA/M have the political will and muscles to confront both the main enemy (NIF/NCP) and the separatists at the same time?
There is no connection between the Nuer vs. Dinka and Separatists vs. Unioinsts. Of course, the armed civilians from subject tribes intervened during confrontations between the unioinsts and separatists in those dark days, and their intervention should not justify that the war was between the two big tribes rather than reasons suitable to their own interests. There have been ups and downs between these two big rival tribes since 1800s and it still functioning as we speak. Duk Padiet which was burned down to ash twice by Mighty Nuer Warriors/Jech-in-Bor at the presence of GoSS and its army (SSAF/SPLA), proved beyond the reasonable doubt that Nuer vs. Dinka still exists.
The Nuer ethnic group has never been thirsty for leadership/power as some folks may believe especially the Dinka, as a matter of fact the movement [SPLA/M] from its first two years, it was mainly dominated by Nuer ethnic group. The first two battalions [104 & 105] or Jamus & Tumsah almost all the troops were from Nuer tribe and if in doubts, don’t hesitate to consult someone like Lt. Gen. Salva Kiir, Lt. Gen. James Gathoth Mai, Lt. Gen. Oyiey Deng Ajack, Mr. Governor, Taban Deng Gai, S.G. Pagan Amum, Mrs. Nyandeng Mabior, but just for your information.
Many elements from Anya-Nya II who deserted conditionally joined the SPLA/M within 1983. CDR. Rhino William Nyuon Bany who is believed to be the one to bring Garang to power is a Nuer by tribe. Lt. Col. Samuel Gai Tut and his group wanted another Dinkaman, Mr. Kuot Atem to be the leader of the movement, but Garang and his group did not only rejected the offer, intead wanted Garang to lead the movement after the Dergue regime of Mr. Mengistu Haile Mariam secured the “New Sudan,” vision for them. The blessing day for Southern Sudanese, the August 28, 1991 of Nasir Declaration was not a mean to hijack the leadership from Dinka as many people may assume, but a strategic move to force Garang and his disciples to make a U-turn from “United Socialist Sercular/New Sudan,” vision to self-determination for the people of Southern Sudan. Therefore, base on all the above mentioned factors, it demonstrated that, the Nuer as a community has never been hungry for leadership/power and this must refute Dinkas’ claims.
And of course, as a result of Nasir move, Garang divorced and abandoned the alliance, called the SPLA/M 1st National Convention at Chukudum in 1994 and the self-determination for South Sudan was the first agenda in that Convention. The movement changed from its former name, SPLA/M as it was wel-known back then to SPLM/A. Garang put self-determination for South Sudan to be the first agenda/priority whenever there is a peace talks with Khartoum government and Garang himself eventually signed for it [self-determination for Southern Sudanese] in CPA. Garang gave up his “New Sudan,” vision, a vision he always refers as a “vision of no-return.” This raised too many unsettling questions from his allies especially the inner circle of NDA, Nuba Mountains and Blue Nile who were not only oblivious, but also betrayed by his self-observed “New Sudan,” vision thereafter they realized that Garang shamelessly made a U-turn which left them in illusion.
The right of self-determination has been eloquently championed and ariculated nationally and internationally by the Anya-Nya II and SSIM/A since 1975. The Nasir Declaration on August 28, 1991 has a democratic and an inalienable right to all people as well as conflict resolutions. The National Democratic Alliance (NDA) an umbrella of the traditional Northern political parties, the former Marxist-Leninist SPLA/M and the National Islamic Fundamentalist (NIF/NCP) regime in Khartoum were all asthmatic to cencept of the right of self-determination. Thus, no matter what the so called traditional parties do, they do not have the trust and confident of the South for their deception and unilateral abrogation and dishonored of many agreements. The SPLA/M alliance with NDA was a repeat of the past, which SPLA/M should have not fail to understand its future implications for the South once the so called NDA gets the wheels of the power in Khartoun.
Then, why remain separated if the former Marxist-Leninist SPLA/M led by Garang relinquished its “New Sudan,” vision after it was forced by Nasir move to adopt the only sole objective for the movement, the self-determination for South Sudan? Leadership has never been a big concern from separatists’ political point of view since 1983 as some people may blindly believe, but directions, objectives, principles and human rights for/in the movement. The SPLA/M division between the separatists and unioinsts should not justify the merits to classify the SPLM/A and/or GoSS as a Dinka movement/gov’t just simply because the two leaders; Col. Dr. Garang and Lt. Gen. Salva Kiir hail from that ethnic group. If this is the case, as some folks claim it, Lt. Col. Samuel Gai Tut, Col. Dr. John Garang, should have not joined the Anya-Nya I [SSLM/A] under the leadership of Mr. Joseph Lagu, but viewed it as Baria’s movement.

Nuer occupation/invasions and their effects on other Jurs (Dinka, Anyuak, Burun…)
The vast area appropriated by the Nuer during the nineteenth century was formerly occupied by a Dinka, Anyuak and Burun population. The fate of this population is one of the most interesting questions pertaining to Nuer expansion. How many Dinka, Anyuak, Burun… were killed by the Nuer? How many died of starvation? How many migrated to other areas? And how many were assimilated into Nuer community?
Although Nuer territorial appropriation had virtually ceased by the early 1800s, the Nuer continued to raid/invade the Dinka for cattle, Anyuak and Burun for land until present.
Three large-scale Nuer raids against the Southern Dinka that took place in 1914, 1916, and 1928 are of particular interest. In each of these instances the Nuer Warriors penetrated over ninety miles into Dinka territory and twice captured over five thousand head of cattle. These raids/invasions were, in many respects, comparable to the initial thrusts of the Nuer during their earlier period of territorial expansion, and document the scale of devastation wrought by Nuer aggression.
During the closing phase of Nuer expansion, the Gaawar and Lou Nuer pushed the Ric, Ghol, and Nyarraweng Dinka south as far as Faijing in present-day Twij County. The Nuer progressively gained the upper hand in these conflicts, and in 1906 launched a large-scale raid on the Faijing settlement that forced the Dinka to withdraw about sixteen miles further south to Kongor. Then in 1908 the Gaawar Nuer attacked the Dinka at Kongor, burning their crops and settlements, killing over a hundred people and took over eighty captives mostly young girls.
In 1908-10, the British sought to end the Nuer occupation toward Dinkaland and established control over the area. A new border between the Nuer and Dinka was established at the favor of Dinka at Duk Padiet, fifty miles north of Kongor, and the Ghol, Ric, and Nyarraweng were awarded about four thousand aquare miles of territory they had previously lost during Nuer expansion. Although a substantial portion of this grant represented an uninhabited no-man’s-land between the Nuer and the Dinka, the Nuer were also required to relinquish territory under active occupation. The Nuer undoubtedly viewed the transfer as a government-sponsored Dinka invasion.
In February, 1910, several months before the Duk Padiet post was established, the Gaawar Nuer attacked a group of Ghol Dinka who had precipitously reoccupied Faijing, kill over two hundred individuals and captured ninety captives along with countless cattle. Less than five days later, a large party of Lou Nuer crossed the government-delineated border and overran the Ghol and Nyarraweng Dinka villages around Duk Padiet, capturing five thousands head of cattle and inflicting “severe losses” on the Dinka populace. The police post at Duk Padiet was also attacked, but the Nuer Warriors were repulsed, losing twenty-six men while killing six policemen and wounding three in the engagement.
The Nuer Warriors raiding party pressed south to within a few hours walk of the government station at Bor, ninety miles deep into Dinka territory. In the course of these raids/invasions they captured “large numbers” of cattle, young women, and children (in addition to the five thousand cattle noted above). In the area under attack, the Bor Dinka “suffered very severely” (ibid.). After a span of less than three weeks, the Nuer Warriors successfully withdrew with their spoils.
Elements of the Ghol and Nyarraweng Dinka who fled the Nuer advance were reportedly harried by the Twij Dinka, who “stole all the women and cattle they could lay hands on.” Two other large groups of Dinka refugees moved north into Nuer territory in an attempt to evade the Lou Nuer onslaught.
In May 1916, the Nuer Warriors again struck deep into Dinka territory, penetrating to within twenty miles of the Bor post. At this point, a contingent of 500 Nuer tribesmen was spotted by Dinka scouts sent out to reconnoiter, and a large number of Dinka accompanied by a Sudanese army officer and some soldiers moved out to intercept them. After initial contact was made, the Nuer retreated with the soldiers and Dinka in pursuit. Employing a stratagem they were to use on other occasions, the Nuer thus drew their antagonists into an ambush. Suddenly, the Nuer Warriors were heavily reinforced and attacked in strength, slaughtering, scattering the Dinka and wiping the army detachment and kill them all to the last man.
The following year (1917) the British launched a major punitive expedition against the Lou Nuer, resulted in heavy casualties have been inflicted on both sides. Few days later, the Gaawar and elements of Lou Nuer launched a large-scale raid that penetrated deep into Southern Dinka territory, following the now familiar pattern established in 1914 and 1916. Seventy villages were burned down to ashes and the crops destroyed, over two hundred Dinka were killed, four hundred young women and children were taken as captives and three thousand cattle taken. A Nuer raiding party with an estimated strength of fifteen hundred Warriors also attacked the government post at Duk Faiwil in the course of this raid. The Nuer succeeded in driving off fifty head of government cattle, but suffered heavy casualties: forty-eight men killed and eighty wounded.
Being further removed from early incursions of the Nuer, the Twi, like the Bor, have suffered far less from yearly raids/invasions and have fattened upon their brother Dinka’s misfortunes. There is no doubt that they (the Twi) regarded the yearly flight for refuge into their country by the Nyarraweng and Ric as a chance for profit and were in the habit of annexing a large percentage of the herds of these tribes when the latter retired disorganized upon them for support.
Dinka alliance with the Nuer had analogous effects. The alliance of a Dinak tribal section with a segment of one Nuer tribe provided security against raids by other Nuer only for that particular Dinka section, and only if the latter lived among their Nuer kin and affine. Moreover, the presence of such Dinka elements within a Nuer tribe did not deter them from raiding other Dinka (including, in some instances, other sections of the same Dinka tribe). Since Dinka refugees were often derived of their cattle by members of other Dinka tribes, they were not reluctant to urge their Nuer hosts to raid/invade the latter.
The Nuer Warriors typically attack a Dinka village at dawn when the cattle are lodged in shelters or tethered near the homesteads. As a result of Nuer Warriors invasions, many Dinka families come into Nuer country to escape hunger and the other attendant miseries to which they have been reduced by constant Nuer raiding/invasion that always leave them cattleless. The Dinka seldom offer any concert resistance, but rather sought to escape with as many cattle as possible. Later a counterattack might be undertaken with the aid of reinforcements from other communities. This strategy of initial withdrawal conceded the destruction of the settlement and in harvest season raids, the loss of grain supplies.
In 1912, the Eastern Jikany Nuer and Lou Nuer undertook their own reprisal against the Anyuak. The Nuer Warrios invasion/raid was directed against the Anyuak villages on the North bank of the Baro/Sobat River from the Ethiopian border to Itang/Achua, a distance about fifty miles. Later reports indicated “All the villages in this formerly prosperous neighborhood have been devastated.
Ten Nuer contigents of three hundred men each could simultaneously attack as many communities and later regroup at one or two captured villages with their stolen cattle to await any counterattack that might be launched. A large [Raik Dinka] raiding surprised a Nuer village and, Dinka-like, sat down to a happy day wrangling over the spoil. It was their last, for meanwhile the Nuer Warriors surrounded them, and in the ensuing panic slaughtered them to the last man.
The discipline of Nuer forces is also demonstrated by a remarkable capacity of continues to press and assault while sustaining very heavy casualties. When, the Eastern Jikany Nuer Warriors were attacked early in 1912 by a heavy armed Ethiopian force of Gala/Oromo and Amhara, intent on taking slaves, the Nuer lost over 100 men in the course of overrunning the invaders’ machine gun emplacement. The invaders’ (Ethiopians) mission was not only failed, but also lost over 300 soldiers and 50 missing. The Nuer also made a number of concerted attacks on fortified government posts. In one instance in which a Nuer raiding party was intercepted by a government patrol, the Nuer lost 85 men in the initial engagement but nevertheless counterattacked the same night and again the following day before withdrawing to home territory.
It is also quite clear that Nuer military domination of the Dinka and other Jurs was grounded in their capacity to field a numerically superior fighting force, and in the organizational features through which mobilization on a large scale was effective. Other aspects of the Nuer advantage were secondary and derivative. Nuer Warriors tactics are relatively simple and straightforward.
Systematic Nuer cattle raids/invasions, conducted on an annual basis, created a periphery of debilitated Dinka communities that yielded readily to Nuer territorial appropriation. Seasoned Nuer raiding parties were pitted against famine-ridden Dinka groups struggling to survive through periods of scarcity resulting from previous raids. Under the circumstances it is not surprising that the Dinka were unable to mount any effective resistance to continuing Nuer territorial expansion.
As this expansion proceeded, displaced Dinka groups were pushed into adjacent areas where they came into conflict with the existing population whose land and grazing rights they infringed. These conflicts undoubtedly contributed to a lack of unity in meeting subsequent Nuer attacks. Successful Nuer cattle raids thus engendered conditions favorable to territorial expansion, and the continuation of this expansion was further facilitated by the aftermath of prior Dinka defeat.
Persons of the Dinka decent form probably at least half the population of most [Nuer] sub-tribes. These Dinka are either children of captives or immigrants who have been brought up as Nuer, or are themselves captives and immigrants who are residing permanently among Nuer. They are “Jaang-Nath,” “Dinka-Nuer,” and, it is said, “caa Naath,” “they have become Nuer.”
There must also have been pockets of the original Dinka, Anyuak and Burun occupants of the country overrun by the Nuer Warriors who submitted and gave up their language and habits in favor of those of the Nuer. At any rate, there are today in all Nuer sub-tribes many small Dinka lineages and village are often named after them (Dinka, Anyuak, Burun…)
Nuer raids/invasions always resulted in the capture of substantial numbers of young women and children. Captives taken by the Nuer always includes boys, girls, and young women of
Marriageable age, but the captives always outnumber the casualties inflicted on Dinka, Anyuak, Burun… by the Nuer Warriors. The loss of a single productive female is thus estimated to reduce her natal population by 3.4 individuals several generations later, and to add a like increment to the population she joins.
The capture of 372 young women and girls a year during the period of 1818 to 1905 would remove 32,625 productive females from the Central Dinka and Anyuak population and thus eventually decrease that population by 110,915 individuals. The capture of 125 boys a year over the same period would decrease the Central Dinka and Anyuak population by an additional 5,250 persons. In sum, the proposed rate of capture would effectively transfer 116,165 persons from Central Dinka and Anyuak population to that of the Nuer.
North of the Sobat River, the British faced even more formidable and intransigent opposition from the Eastern Jikany Nuer who lived along the Ethiopian frontier. They were well armed with rifles and ammunitions from Ethiopia and raid neighbors, the Burun and Koma to the North, the Dinka and Anyuak to the South – as well as Ethiopian tribes in the Western foothills.
Under the command of Lt. Col. Bacon a powerful patrol was finally launched against the Eastern Jikany Nuer from Nasir in January 1920, complete with machine guns and airplanes. The three sections of Eastern Jikany Nuer Warriors attacked the advanced troops; sustaining heavy losses conflicted on both sides. The Jikany Warriors were led by Captain of war, Mr. Mut Dung
The Dinka, Anyuak, Burun… had no recourse other than withdrawal. Under these circumstances, the rapid Nuer Conquest/occupation of the vast Western Dinka region [Mayom, Mankien…], Southern Dinka region [Nyuong Nuer territory], Central Dinka region [Fangak, Ayod, Waat…], Eastern Dinka, Anyuak and Burun region [Eastern Jikany Nuer and Lou Nuer territory] is not difficult to understand.
Had the Nuer ever wished to occupy the whole greater Upper Nile, from Renk to Mading Bor and from Ruweng/Biemnom to Buma-Gambella, it seems unlikely that the other coward Jurs (Jaang, Bar, Burun, Chai…) could have stopped them.

July 3, 2008 — Members of the Dinka Bor community around the world have turned the 28th August a day on which they propagate every year claiming that thousands of their community members were massacred in Bor town in 1991 by the then forces of the SPLM/A-Nasir faction led by Dr. Riek Machar Teny-Dhurgon.
Dr. Machar defected with Commander Dr. Lam Akol Ajawin and Commander Gordon Koang Chol with their forces in a historic move for better change from the old SPLM/A led by the late, Dr. John Garang de Mabior, which Garang then re-named ‘SPLM/A-Torit faction’ after the split. The move was declared on 28th August 1991 in Nasir town in Upper Nile region. The reasons for the split were clearly articulated by the then SPLM/A-Nasir faction leadership and were understood and still being understood by the concerned people of Southern Sudan in particular and the international community at large. Before the split, the SPLM/A had no clear objective for which the people of Southern Sudan fought and lost two million souls. There were no proper structures put in place for clear responsibilities, which would also guarantee collective decision making in strategizing for the Movement’s programs and executing its war against the Khartoum government. There were also gross violations of human rights by late Garang’s leadership. Dr. Garang was using the Movement as his own property. I will shed some light on these issues in the next paragraphs below.
Since the inception of the SPLM/A in 1983 until 1991, if you asked any SPLA officer what he was fighting for, he would not provide a clear answer simply because he did not know what he was fighting for – or simply say he was not enlightened on the cause of war. I remember when I was in Itang in 1986 and asked a friend of mine who was also a SPLA officer what he was fighting for, he just replied “I don’t know but John Garang knows”. And he continued to say “to me I think we are fighting to liberate South Sudan territory from the Arabs who dominate us.” Even those who thought to be SPLM politicians were not sure about the objective for which the war was launched. And to inquire that from Garang himself for possible correction was deadly.. Tens of thousands of SPLA soldiers lost their lives in battles while not clear about the cause they died for and the destiny they wanted to reach and achieve. This was the pre-1991 situation in the Movement.
There were no proper structures established in the Movement although there were sufficient educated SPLM cadres who could run every necessary structure if established at the time for better strategies on policies and successful execution of the war. Dr. Garang instead established only what he called ‘Political Military High Command’ in 1980s in which he installed semi-literate personalities on most senior positions in that single structure. Dr. Machar was a member of that structure, but intentionally put in the bottom of the list by Garang. The Political Military High Command was mandated by Garang himself to look into matters related to both political and military. The group’s most powerful personalities lacked any political experience and could not even see what was wrong with the objective of the Movement, let alone the importance of establishing a separate structure for SPLM. The way they executed the war was not also professional and this might explain why they could not capture a single major city among the three capital cities of the three regions in the South for twenty one years until the CPA found a way out in early 2005. Worst of all, members of the Political Military High Command could not meet to decide what to do next as a collective body. Many of them did not even know their faces, they just heard of each other’s existence somewhere. Those who were fighting in the battle fields like Dr. Riek Machar in the early years of SPLM/A were depending on orders from Dr. John Garang without their views being put into consideration on how to effectively wage the war.
Late Garang also conspired against his colleagues he perceived to be a threat to his leadership because of they were highly educated. He used to expose PhD holders to battle fields instead of utilizing them to formulate policies for the SPLM as a political wing.
He ordered Dr. Peter Adwok Nyaba to attack the government forces with child-soldiers in Jokou town. Dr. Nyaba lost one of his legs in the operation and came back with few survivors of his child-soldiers.
Garang also ordered Dr. Riek Machar Teny, another PhD holder in Strategic Planning in Industry to attack Malut in Upper Nile, which Dr. Machar captured in mid 1980s. After capturing Malut, Garang ordered Machar again to move up to Mayom in Unity state to capture it where the present President of the Republic, Omer Hassen el Beshir was the commanding officer in Mayom before he became the President in 1989. Dr. Machar’s forces got into very fierce battles with Beshir’s forces. His forces wounded Beshir in his leg, but failed to capture the town because they could not get reinforcement.
Late Garang also ordered Dr. Lam Akol Ajawin, another PhD holder in Petroleum Engineering to move to eastern Upper Nile to command SPLA forces in the area in 1980s.
Gross human rights violations were committed by late Garang’s forces against a number of ethnic groups in Southern Sudan, which included massacres. One of the worst massacres committed by Garang was the war he launched against the Gaajaak sub-clan of Jikany Nuer in 1985. The war was launched against the whole sub-clan simply because of an argument over fish between a villager of the sub-clan and a SPLA soldier. The villager went fishing with some of his colleagues, caught a fish and was ready to take it home. Some SPLA soldiers came to the river, and as it was common behavior among the forces at that time, wanted to take the fish by force from the villager. The villager resisted and was then shot dead by one of the SPLA soldiers. Villagers from a nearby village heard the gun shot, rushed to the scene and found their colleague dead. They immediately retaliated by killing a number of SPLA soldiers on the spot. The remnants of those soldiers ran for their lives back to Bilpam, which was the then SPLA General Headquarters on the Ethiopian border. They reported the incident at the Headquarters. The SPLM/A leadership was furious and decided that the whole sub-clan be disciplined by wiping them out of their villages. This was how the war against the Gaajaak sub-clan of the Jikany-Nuer started in 1985, resulting in untold massacres of human beings and their cattle.
Many people who used to hear late Garang’s ambitious comments on the territory occupied by the Gaajaak sub-clan before the war knew that the fish incident was used as a pretext for war against the Gaajaak. Dr. Garang used to tell his Bor intellectuals that the territory occupied by Gaajaak was in fact a Dinka Bor land. He used to explain that the Dinka Bor community was displaced from the land during the Nuer expansion from Bentiu in Western Upper Nile hundreds of years ago. Perhaps by wiping out the Gaajaak from the territory, he would have encouraged the Dinka Bor community to resettle in the land so that they border Ethiopia and resolve their current status of being landlocked in the Bor’s tiny territory in Jonglei. He was not happy also with the way the Nuer inhabit a huge territory without being isolated by other tribes – their land which extends from Western Upper Nile bordering the Nuba Mountains in Southern Kordofan in the north across the River Nile in Upper Nile region up to the Ethiopian border in the East.
Dr. Garang dispatched both late Kerubino Kwanyin Bol and late William Nyuon Bany to personally command that war against the Gaajaak sub-clan. For those of you with short-lived memories, late Commander Kerubino Kwanyin Bol was the Deputy Chairman of the SPLM and Deputy Commander-in-Chief of the SPLA forces. He was number two to Dr. John Garang. Late Commander William Nyuon Bany was the Chief of Staff of the SPLA forces; the post previously occupied by Comrade Salva Kiir Mayardit and currently occupied by Comrade Lt.. General Oyai Deng Ajak. You can imagine how Garang was determined to entirely wipe out the Gaajaak by letting loose those powerful military commanders to massacre the unarmed Gaajaak sub-clan. Both Kerubino and William went to the battle fields to personally command the fighting. The war resulted into untold losses where thousands of people were killed, several villages completely wiped out and burnt to ashes. However, the SPLA won some of the battles but lost the war against the community! Dr. Garang failed to get the territory back to Dinka Bor community. In that war against a sub-clan, the SPLM/A lost a highly educated son of Southern Sudan, Dr. Francis Ngor, a PhD holder after late Garang ordered him to command a force against the community and his forces were annihilated. He was captured and killed by the villagers on spot.
The two parties finally decided to stop the fighting and came back to the peace table and forgave themselves for the sin. That crime against humanity committed by Dr. Garang against the Gaajaak community might have been forgiven but not forgotten. Of course the Gaajaak community may not file criminal cases in The Hague against those three most powerful leaders of the SPLM/A at the time because they are no longer with us on this earth. I personally ask God to forgive late Garang and his colleagues.

Similar atrocities were also committed against other ethnic groups in the South such as the Toposa, Murle, etc. by Dr. Garang’s forces in the 1990s. All are documented!
The claim by the Dinka Bor community intellectuals that the 1991 SPLM/A split resulted in the massacre of Bor by the then Nasir faction leadership was and still a propaganda campaign against personalities like Dr. Riek Machar. Of course, there was a fight over Bor town which actually resulted in the lost of, maybe, thousands of lives. This cannot be disputed! But who can the Bor personally hold responsible? The fight over the control of Bor town to my best knowledge was not ordered by the leader of the then SPLM/A-Nasir faction, Dr. Riek Machar Teny-Dhurgon. These were some of Dr. Machar’s military officers who felt very angry after hearing the news that Garang’s forces were killing in cold blood Nuer officers who were on Garang’s side in Equatoria region. Dr. Garang’s forces, particularly from the Dinka ethnic group decided to kill in cold blood every Nuer officer on their side in Torit town simply because a Nuer leader has challenged Garang’s leadership in Nasir town.
These angry Nuer military officers from the SPLM/A Nasir faction mobilized some of the Nuer armed civilians who are neighbours to Dinka Bor and attacked Bor town. They had fierce battle with Garang’s forces stationed in the town. After several hours of fighting they overran the town, which resulted in lost of hundreds or thousands of lives and massive displacement of Dinka Bor population up to Equatoria region. I personally feel sad about the incident. But the Dinka Bor community members should not use it as a propaganda campaign against Dr. Riek Machar for reasons best known to them. This is a pointed finger at the wrong person. They should learn the truth about the incident, what provoked it and who organized the attacks.
The same was true with the attack on Malakal town in 1993 by the armed Nuer civilians organized by the late Wurnyang Garkek. Late Wurnyang claimed to have been possessed by God’s spirits and that the spirits directed him to help liberate the South. He successfully organized a force that was popularly known as the ‘White Army’ from the Nuer civil population and ordered them to capture the capital of Upper Nile region, Malakal. They attacked the town and captured about seventy-five percent (75%) of the town. The Sudan government forces held certain positions in the outskirts of the town. Because Wurnyang’s armed civilians were not trained soldiers and had no supplies of ammunitions, when they realized that they were running out of ammunitions, they started shouting in the town calling on their individual colleagues to supply them with some bullets if they had plenty. The government soldiers came to realize that these were just armed civilians and that they had run out of ammunitions. The government forces gave them a final full thrust and chased them out of the town. The town again fell under the full control of the government’s forces. The government forces first thought it was Dr. Riek Machar’s forces attacking the town, but this turned out to be somebody else organizing and ordering the attack on Malakal town.
To me, as a person who has been in the SPLM/A since its inception in 1983, I see the 28th August 1991, split as one of the most blessings the people of Southern Sudan have received from their creator. Of course, the split resulted into setbacks when it came to military activities against the Khartoum government, but has revolutionized the SPLM system and set a clear objective for the satisfaction and achievement of the aspirations of the people of Southern Sudan.
The 28th August 1991 Nasir Declaration, which was code-named ‘The Creeping Revolution’ under the then leadership of Dr. Riek Machar Teny-Dhurgon, called for Self-determination for the people of Southern Sudan to determine their political destiny. This is to be determined in a referendum on vote for separation or unity and to be supervised internationally in Southern Sudan. This patriotic call by the people of Southern Sudan was resisted by late Dr. Garang until the year 2002. Garang was instead calling for a United New Socialist Sudan in the 1980s (a vision he copied from Ethiopian President Mengistu Haile Mariam’s New Socialist Ethiopia). After Mengistu was overthrown, he then changed the vision in 1990s to a United Secular Sudan (or New Sudan as he called it). The viability of this big dream or vision was in question as many people saw and still see it as just a beautiful dream but unrealistic in its achievement and was meant to confuse the cause of the people of Southern Sudan given the complexity of the problems in the Sudan and their deep rooted origins. Subsequent American administrations in Washington DC dream of a ‘New World Order’ which they now find unrealistic to achieve for the whole world. Every body can dream beautifully, but making the dream come true is the question. We need to be realistic in our visions!
The 28th August 1991 Declaration also called for democratization of the Movement by putting its structures in place, particularly the arm of the SPLM which was treated subordinate and incorporated into the arm of the SPLA by Garang’s leadership. This explains why in the old days of the Movement, Dr. Garang put the SPLA first by calling the Movement the ‘SPLA/SPLM’ instead of the ‘SPLM/SPLA’. This was corrected after the 1991 historic move for better change. The Movement was also lacking its legal institutions. Garang was every thing! After being challenged reasonably by the Nasir faction leadership on these issues, he reacted by organizing and calling for the First SPLM National Convention in Chukudum in 1995. Before the Convention, and in the months leading to the time the Convention was called for, Garang felt much pressure on his leadership from within his faction and began to understand the need to establish structures for the Movement. There were voices who called for change on how the Movement was being run by one man.
For fear that many more intellectuals and military Commanders would continue to defect to Dr. Riek Machar’s faction, Dr. Garang found himself toothless and could not resort to his old ways of either murdering his political and military opponents from within in cold blood or silencing them in prisons without trial. His leadership survival at that time after the split significantly depended on how Dr. Machar would handle his coup against him. If Dr. Machar were to choose to overthrow Garang militarily as the last resort by attacking his positions in Equatoria region, Garang’s leadership would have come to pass in those years. Machar instead chose to engage Garang in dialogue to resolve the issues that caused the split and would only fight in self-defense if Garang attacked his positions. This helped Garang to re-organize his forces that were in the state of panic. Luckily and by chance, Garang used Machar’s peace talks with the Khartoum government to accuse him of collaborating with Khartoum. This also helped him to regain support from those in the region and Western world who wanted the war to continue in Southern Sudan. Dr. Machar’s position not to escalate fighting by removing Garang using military might in Equatoria region, where he shifted his bases and fighting force, resulted in sharp disagreements with his colleagues which also resulted in further splits within the Nasir faction. Can you see this dilemma which was not completely taken note of by Garang’s faction?
The 28th August 1991 popular Declaration prompted its leadership to strategize on how the liberation struggle could be achieved. The leadership chose the path of peace as the way forward. They engaged themselves in a series of peace talks with the present government in Khartoum in Abuja One and Abuja Two and subsequently signed the Khartoum Peace Agreement in 1997. Dr. Riek Machar incorporated other factions which also defected from late Dr. Garang’s faction and became their overall leader. These factions included the Bahr El-Ghazal Group (BGG), led by late Kerubino Kwanyin Bol, the Bor Group (BG), led by late Arok Thon Arok, the Equatoria Defense Forces (EDF), led by Dr. Theophillus Ochang Lotti, and some other groups. Dr. Machar signed the famous Khartoum Peace Agreement (KPA) on behalf of all the factions that joined his Movement, the South Sudan Independence Movement (SSIM) with its military wing, the South Sudan Defense Forces (SSDF). For the first time in the history of the Sudan, the Khartoum government conceded the right of self-determination for the people of Southern Sudan in the Agreement. This was also enshrined in the National Constitution of the Sudan in 1998, which clearly articulated that this right would be exercised in an internationally supervised referendum after four years from 1997. The referendum was to be exercised in Southern Sudan in the year 2001 about seven years ago.
Dr. Garang at the time vowed that he would not sign any agreement with the Khartoum government under President Omer Hassen El – Beshir. He used to say that the Khartoum government was too deformed to be reformed and that he wanted it removed by military force. He called the Khartoum Peace Agreement a sell out despite the inclusion of the clause ‘self-determination’ in it plus many more achievements including Southern Sudan retaining a separate army. The significant thing I personally feel was missing in the Khartoum Peace Agreement was the involvement of the international community, which distanced itself from the Khartoum Peace Agreement on a number of interests that I don’t want to write about here. The Khartoum Peace Agreement, like any other agreements signed in Sudan, was violated by the Khartoum government in the year 2000. Dr. Machar, after championing self-determination in the Agreement, decided to resort to other strategies back in the bush to bring late Dr. John Garang to the developing peace process and indirectly revive the Khartoum Peace Agreement in a comprehensive form based on self-determination!
On 6th January 2002, the two factions of Dr. Machar and Dr. Garang merged in Nairobi. This time with bold declaration that the two groups agreed to resolve the issues that led to the split within the SPLM/A on 28th August 1991.. The right of self-determination for the people of Southern Sudan as called for in the Nasir Declaration was officially accepted and became the official objective of the Movement to determine the future political status of the people of Southern Sudan. Democratization of the Movement and respect for human rights were re-affirmed because Garang had already adopted these principles after the 1991 split and before the merger in 2002. But the Merger Agreement recognized that more work needed to be done on these principles. The Nairobi Merger Agreement also called for a Second SPLM National Convention to be held within three months to elect the leadership of the ‘new’ SPLM. Dr. Garang delayed the convening of the Convention indefinitely for fear of being defeated in the election by Dr. Machar or any other candidate. The Merger Agreement also called for serious revival and resumption of peace talks with the Khartoum government.
As a result of the Merger Agreement between the two leaders with renewed spirit and quest for peace, just after six months from the merger, the first protocol of the CPA on self-determination for the people of Southern Sudan was signed in Machakos, Kenya in July 2002. Commander Salva Kiir Mayardit, the then Deputy Chairman for Military Affairs signed the Protocol on behalf of the SPLM/A. The road to peace became irreversible!
On 9th January 2005, the SPLM/A and the National Congress Party-led government signed the Comprehensive Peace Agreement (CPA). Dr. Garang signed on behalf of the Movement while the then First Vice President of the Sudan, Ali Osman Mohamed Taha, signed on behalf of the Sudan government. If you read the CPA in comparison with the Khartoum Peace Agreement, you would be convinced that the CPA is not more than a revised text of the Khartoum Peace Agreement with the exception of the international support and the United Nations Peace Keeping Forces in the South. However, the effectiveness or not of the international support and the UN Peacekeeping forces in Southern Sudan is another thing one may evaluate.
The clear message I want to send to those who might have been blinded by tribal sentiments and cheap propaganda against leaders who have greatly contributed or actually revolutionized our way forward as the people of Southern Sudan is that they should get realistic and honour these great leaders like Dr. Machar with utmost respect.. 28th August 1991 Declaration should not be used for negative propaganda, but instead be remembered as a blessed birth day on which a clear path for the liberation and freedom of the people of Southern Sudan was set. The road to our freedom is still long and painful! We need to get united as one people with one objective that will lead us to our desired destiny. Propagating on the so-called Dinka Bor massacres with fabricated negative stories attributed to innocent and great leaders like Dr. Riek Machar will not help the cause the Dinka Bor want to achieve in Southern Sudan or in a united Sudan.

It is the feeling of the past wrong doing not to happen against. It is a good sign; Riek should educate his Nuer people not to fight the tribal war again in the south.
The wise Nuer will accept that apology way not the tribal war way. Nuer Militants have intention to sweep out all Dinka from Junglei and UpperNile Ngok. Some family are closed down with no single survival in Ngok

Machar’s apology resonates with what I have recently argued in an essay about the need to establish a truth commission to address the past in order to reconcile the present as South Sudan seeks to move to a peaceful and prosperous future. I entitled the essay “South Sudan: The Case for a Truth Commission.” I am pasting the full text of the essay below, but because it is a bit long, it will be pasted in several segments under the nickname southerner. As a disclaimer, this essay is meant to generate civil and informed discussion, and not trigger uneducated, ethnically charged empty accusations!
Introduction:
In January 2011, Southern Sudanese stormed polling centers in multitudes, to exercise their right to self-determination by casting ballots as stipulated in the Comprehensive Peace Agreement (CPA), which in 2005 concluded the protracted second civil war between the Arab and Muslim North, and the Christian and African traditional religionist South. Except for limited violence in the oil-rich north-south border areas, the plebiscite conduct was largely peaceful and orderly, and resulted in a landslide vote for secession of South Sudan, a result which was endorsed by the international community as legitimate, and officially recognized by Khartoum. For overwhelming majority of Southern Sudanese, this was “our Kairos moment,” and so the referendum was merely a process that was to determine an already almost unanimously determined fate—an independent state in South Sudan. “We, the southern Sudanese have already decided to vote for an independent Southern Sudan where we will live as first class citizens,” stated Southern Sudanese Youth Forum during the plebiscite run-in.
And yet, current political and economic reality in South Sudan is rapidly diminishing people’s high expectations, hope, and optimism of finally receiving the much coveted restoration of human dignity and equal citizenship status. Political violence is rapidly spreading throughout South Sudan. And the all encompassing sense of unity, and euphoria among Southern Sudanese which characterized the post-signing of the CPA is being replaced by a destructive social disintegration along ethnic lines, as fear and suspicion of the dominant Dinka ethnic group intensifies. And so the question nags, is South Sudan about to witness another episode of an all-out violent intra-ethnic conflict? If so why? Could South Sudan be suffering from ancient ethnic hatred syndrome? How can sustainable peace be promoted in this country, which has known little but wars?
In this essay, I address these questions, and make the case that in the interest of a sustainable peace, a truth commission mandated with addressing political crimes committed by Southern Sudanese against each other, during the protracted North-South civil war must be established to restore reconciliation, and advance democracy, human rights and the rule of law in the new Republic of South Sudan. Ideally, and especially as both the North and the South prepare for life independent of each other, and both undergo a transition from war to peace, the mandate of the truth commission should also include addressing atrocities committed by Khartoum against Southern Sudanese during the same period of North-South armed struggle, in which more than two million people died. However, the time and space does not permit us to argue for the creation of such a commission; the situation in South Sudan is more pressing for a truth commission than North-South relations, which at the present can make do without a truth commission, but which should be a topic for a future consideration. For this reason, I confine my argument in this essay for the creation of a truth commission in the South to help purge the Southern house of standing grudges borne of past political atrocities committed across ethnic divide by Southern Sudanese themselves, and which in part may account for the current political turmoil, and proliferation of violence in South Sudan.
Consequently, in this essay, I embark as follows: in the first half, I acknowledge by demonstrating that yes, with the current state of affairs South Sudan betrays strong signs of a nation rapidly sliding toward a full-fledged violent ethnic conflicts. Against this background, staking a claim for the creation of a truth commission as a mechanism to not only prevent the eruption of violent ethnic conflicts motivated by revenge, but also to foster a smooth transition to democracy and sustainable peace is all the more desirable. In response to the second question of whether South Sudan suffers from ethnic hatred syndrome, I argue that no, South Sudan is not prone to ancient ethnic hatred, because despite seemingly the case, ancient ethnic hatred is a myth, which makes the success of a truth commission in South Sudan feasible, especially if such a commission is properly mandated and deliberated.
In the second half of the essay I make the case for a truth commission to be created in South Sudan, briefly outlining criticisms as well as praises for truth commissions in general. I argue that the pendulum still swings toward the establishment of a truth commission in South Sudan. I then elaborate on the mandate of this truth commission, and conclude by reiterating that sustainable peace founded on principles of representative democracy, human rights, rule of law, security sector reform, free market, and hope for a better future in South Sudan largely depends on the creation, findings, and recommendations of a truth commission, if properly implemented.

Violent Ethnic Conflict Looms in South Sudan:
Following the relatively peaceful and successful conduct of the referendum, violent ethnic conflict looms in South Sudan. This threat of violence is particularly posed by those ethnic groups who feel marginalized and not meaningfully represented in the Dinka dominated Government of South Sudan (GoSS). Even before the eagerly anticipated nation is to be born in July 2011, scores of defection by army generals and their soldiers, and resort to armed struggle against GoSS, is increasingly common, which reinforces the concern about an impending full-fledged ethnic violence. Southern militia groups, which have previously been used by Khartoum in its “divide and conquer” strategy, to fight Sudan People Liberation Army (SPLA), but which have been rendered inactive following the CPA have already resumed violent activities in several areas of South Sudan, some led by the defected generals, and others by Khartoum’s proxy warlords.
Opposition political parties are decrying what they perceive as the beginning of another era of authoritarian regimes and one Dinka dominated party rule. They argue that the SPLM has reneged from a political agreement to consult other Southern political parties concerning South Sudan’s interim constitutional review, a constitution which the SPLM almost unilaterally reviewed and passed the final draft of the interim constitution, while bestowing significant power to the SPLM chairman and the current president of South Sudan, Salva Kiir. To this end, vehement political accusations highly charged with ethnic hatred rhetoric are exceedingly becoming salient in political as well as public discourse in Juba.
In addition to defections in rank and file of the SPLM, which have become a common practice in recent months, as well as the reactivation of previous militia groups, and disgruntlement of opposition parties for the perceived marginalization from political participation, opposition to Dinka dominance is taking rather unsettling twist of what is perceived as tribal federalism.
At the time of writing, a conference organized by the Baria ethnic group was convened in Juba where a confederacy of tribes known as Equatoria tribes participated to discuss current political issues facing South Sudan. The conference, which was entitled “Unity, Equality, and Prosperity,” generated a lot of negative reactions from Dinka political analysts who perceived it as tribal conspiracy and threat to non-Equatoria tribes. And while the purpose of the conference was to discuss issues pertaining to representative governance, and security, it quickly invoked the memory of a previous political campaign also led by Baria in the early 1980s, and was known in Baria as kak kokora (the land must be divided), or in English “Equatoria Region Now.” At the time, the purpose of the kokora campaign was to end Dinka hegemony in the regional government, by expelling them from Juba—a city the Baria consider to be their ancestral fortress, and which they refer to as Juba na Bari (Juba is a Bariland). However, this campaign, which would have resulted in massive ethnic violence, was interrupted when the second civil war broke out, and Southern Sudanese decided to put their differences on a halt and rally behind the rebel movement to liberate South Sudan from the common enemy up north.
On the whole, Adam Branch and Zachariah Cherian Mampilly in a recent study summarized the current ethnically tense and emotionally charged atmosphere in Juba accurately. They pointed out that some of the discontented tribes “who belong to the smaller Equatorian ethnic groups—the Baria, Zande, Acholi, Madi, Moru, Kuku, and others—view the SPLA as a vehicle of Dinka domination and complain bitterly about their treatment at the hands of the SPLA.” Likewise, some sections of the Nuer who are represented by at least seven ministers in South Sudan cabinet, and occupy the post of the Vice-President, remain discontented with what they continue to perceive as Dinka hegemony in the government. This is strongly reflected in the increase in defection by some Nuer generals and their followers from the SPLA file, and resort to armed struggle, and indiscriminate attack on Dinka villages. Of the several armed groups that have defected from the ranks of SPLA in recent months, at least seven of these groups are led by generals from the Nuer ethnic group, which leads us to addressing the second question, is South Sudan then suffering from ancient ethnic hatred syndrome?

The Myth of Ancient Ethnic Hatred:
While the current unfolding political events in South Sudan may be defined as traditional ethnic conflicts, they should not be construed as manifestations of ancient ethnic hatred, understood here as a primordial ontologically designed state of ethnic anarchy. Ancient ethnic hatred as such is a myth. Ample studies show that the whole categorization of African societies into tribes is a colonial construct devised to consolidate colonial control of the African continent. South Sudan like its African mother suffers from this colonial legacy. When African ethnic conflicts are historically discussed, part of the blame for these conflicts is squarely placed on the shoulders of African colonial masters, particularly on their divisive policy of “indirect rule,” or “divide and rule” employed to control the African continent. The core of this argument is that ancient ethnic hatred is a myth. Ethnicity in its current hostile form, was a colonial product, in which tribes were incited against each other, to enhance the process of control, and exploitation of resources, as well as to bolster the booming colonial slave industry. “Tribalism solved the colonial dilemma of how to dominate and exploit vast numbers of indigenous inhabitants with limited number of colonial agents.”
The 1994 Rwandan genocide is another prime example of the impact of the legacy of colonial incitement of ethnic hatred. In their ploy to consolidate power, and exploit resources, the colonialists used preferential ethnic treatment of the Tutsis at the expense of the Hutus, which later resulted in the horrendous Rwandan genocide as ethnic hatred reached boiling point. “The veneration of the Tutsis and the bias towards Tutsi officials and chiefs,” writes David Keen, “inordinately inflated…the Tutsi ‘cultural ego’ and simultaneously gave many Hutus an aggressive ‘inferiority complex,’” which created space for the subsequent genocide.
Differently worded, ancient ethnic hatred discourse is best explained as a devastating foreign ploy to consolidate power, which continues to foment conflicts to the present. “The legacy of the past has certainly had tremendous impact on persisting current violent conflict.” Moreover, for pragmatic reasons, perceiving these conflicts as ingrained in ancient ethnic hatred is undesirable, because it entails employing geographic distancing of the ethnic belligerents, as the favorable conflict resolution mechanism. For this reason, ancient ethnic hatred discourse should be strongly discouraged, particularly when it comes to dealing with African conflicts. It is “pessimistic about ethnic conflict management and about establishing lasting peace. Only separation will ensure lasting ethnic peace. Mixing or remixing (after ethnic cleansing) the ethnic groups in the same territory invites renewed violent conflict.” Perceived within the Nuer-Dinka conflict context, such an understanding entails creating two independent states within South Sudan to separate the Dinka and the Nuer belligerents. Moreover, the same scenario might also be true of other Southern Sudanese, who in the future might engage in ethnic conflicts against each other, which makes geographical separation as a conflict resolution method not only unfeasible, but also threatens international peace and security, when more tribes begin to request independent and sovereign geographical spaces.
In sum, the foregoing analysis is not intended to present African or Sudanese ethnic groups as saintly, far from it. The purpose is simply to highlight some of the damaging stereotypes, which do not contribute to constructive handling of conflict situations wherever they may be found, to the preservation of the invaluable asset of human life. To be sure, it is precisely because ethnic groups have experienced bitter ordeal of violence that they have devised traditional self-preserving peaceful mechanisms to address conflicts. Sudanese tribes are not at all immune to violence; rather they have had their differences, mainly over economic and natural resources, such as pasturage, water and arable land. They have raided and counter-raided each other for cattle for centuries, and have used violence to settle other scores which were often fatal and may continue to perpetuity. And yet, most ethnic groups whether in Sudan, Africa and other parts of the world without exception, have also found peaceful and diplomatic means to settle their accounts. Thus, in order to protect and preserve human life, ethnic groups utilized traditional methods of conflict resolution to coexist in peace.
Again, a prime example can be seen in Nuer-Dinka violent conflicts in the wake of a split in the rebel movement in 1991, where both ethnic groups inflicted heavy atrocities on each other. The scope of Nuer-Dinka massacres are reported to have even exceeded the mass killing visited upon them by Sudan Armed Forces (SAF), during the over four decades long North-South civil war. Nonetheless, both communities were ultimately able to utilize traditional conflict resolution mechanism, accompanied with rituals of reconciliation under the aegis of the New Sudan Council of Churches (NSCC) to resolve their conflicts, and live with each other in peace. Judging by the current instability in South Sudan, the view promoted in this essay is that there seems to be loophole with this “people-to-people peace process.” Partly because, it did not lead to a holistic restoration of human relationships between the two communities, because with modern weapons involved, the atrocities were unprecedented in the scope of its gravity. The other reason for the insufficiency of the peace process is that, the peace process did not include political leaders of both communities, such as the sitting President and Vice President of South Sudan, Salva Kiir and Riek Machar respectively, both of whom were implicitly or explicitly complicit in those atrocities. And it is precisely here that I think a truth commission needs to be established to address some of the standing bitterness of violence, which people harbor in silence, and which I think at least in part accounts for the almost arbitrary resort to picking up of arms by some of these groups as is currently practiced in South Sudan.

The SPLA was only after criminals who embrace a barbaric culture of murdering innocent soldiers. Yes those who protected and defend the outlaws were as guilty as the outlaws themselves and deserve punishment. Those fathers whose sons had killed soldiers boasted in the village saying that “gatda ee ce mac noong”. Not knowing that the guns were for liberating southerners, not for killing our own brothers.

I am not trying to be tribal, but it is Nuer that has done more destruction to Dinka, Southerners and even greater destruction to themselves around the oil fields in the late 90’s in the course of our struggle. Yet some people back then called it “fighting for freedom”, not knowing that it was not your brothers who denied you freedom, it was Arab and that who we were suppose to fight. Anyways, it is time to move forward and think about how we can all live together and build South Sudan to be a better place.

The Case for a Truth Commission:
To elaborate on why I think the creation of a truth commission in South Sudan is desirable, it is helpful to further pursue what I have called “standing bitterness of violence” as a primary driver of the current political instability. Daniel Philpott best conceptualizes what is being discussed by the phrase “standing bitterness of violence.” In his framework of “wounds of political injustice,” Philpott argues that “a wound of a political injustice can be defined as some respect in which a political injustice ruptures right relationship in or between communities and diminishes the human flourishing of those who are involved in that injustice.” Standing bitterness of violence understood within this framework is then the rupturing and diminishing processes of right relationship caused by a political injustice or violence. And thus this framework vividly reflects the current state of affairs in South Sudan, which expressively represents a society in rapture and diminishing process of right relationships between its various segments. It is a society with a dwindling prospects of a human flourishing, precisely because it was involved in a prolonged armed struggle, that meted out egregious political violence on its people, both from within and from without.
Put differently, the whole Southern Sudanese society are stakeholder in the conflict, and therefore are all partakers of the wounds of injustice that Philpott describes, and not just the primary parties involved in the political injustice. The fact that all are at stake necessitates the creation of a truth commission not just as an exercise in the politics of reconciliation, but also as a foundational step toward promoting democracy, human rights, security sector reform, rule of law and free market.
Conversely, wounds of political injustice, if left unattended have the potential of becoming cancerous and destructive, permeating the whole fabric of the Southern Sudanese society, eroding and weakening it from within and thereby inflicting pain and ruin to the whole society in various capacities and degrees, exposing vulnerabilities that can be easily exploited by foreign agents of ill-will, and ultimately culminating in an undesirable state of complete social decay and disintegration to the vicious abyss of violence.
As Philpott nuances it, participants to the wounds of injustice, or those who are victimized by these wounds include, the victims on whom the injustice has been directly perpetrated, or whose human rights have been infringed. Then the perpetrators or the guilty ones who have executed the act of wrongdoing, followed by all the members of the community as a whole, or the commoners. And finally, “there is the governing institutions of the state, who may at different times, in its very different modes, represent any of these parties, coordinate among them, enforce the rule of law, promote practices of reconciliation, or sanction or carry out political injustices. Each of these parties plays a different role in each different kind of wound, inflicting it, suffering it, sanctioning it, standing by and watching it, or remaining oblivious to it.” In other words, the whole Southern Sudanese society is responsible to discharge efforts for reconciliation, or alternatively sanction injurious political practices, and in the process deepen an already existing wound of political injustice, which is fragmenting communities across hostile ethnic group, with the result being further perpetration of political crimes as is currently happening in many parts of Southern villages, where militia groups have resumed their activities.
Framed this way, it is the moral and political responsibility of GoSS and Southern Sudanese at large to discharge their duties, by promoting and creating political space for justice, here broadly defined as reconciliation. This was the underlying motive for why Southern Sudanese voted overwhelmingly for secession, namely to restore their human dignity and citizenship, which for half a century was robbed by Khartoum. Ample studies have shown that one of the primary functions of a truth commission at least as a democratic project is to restore dignity and civic status robbed by political injustice or human rights violation of a political community.
In this context establishing a truth commission is a strong political statement of the government’s intent to inculcate a democratic culture to mark the end of anarchy and chaos, and the beginning of law and order society, where the protection of human rights and restoration of civic status is the natural course of affairs. This I argue should be the first objective of the truth commission, namely to pave the way for a beginning of the process of restoration of equal rights to citizenship, which as noted is a core desire shared by the majority of Southern Sudanese, including those who chose to rebel.
However, it is also useful to note that a truth commission is no panacea. There are no magical solutions to restore a flourishing humanity in contexts where there have been prolonged exposure to violence, and human rights violations. In this regard some have raised concerns about the contribution of truth commissions to swift transition to democracy. An oft-cited critique of truth commissions is that they are substitutes to prosecutorial justice. They are toothless in that they never prevented the occurrence of genocide in Rwanda, for example. Or truth commissions are accused of being inept to recover the truth of what happened in the past, at best they can only “narrow the range of permissible lies,” as Michael Ignatieff phrased it. Truth commissions are charged with “moral overreach,” by liberal critics as Daniel Philpott points out, these critics contest that first “it is naïve to think that a single notion of truth about the past can attain common agreement among the members of a society. Second, when a government commends a single truth as a collective value for an entire nation it violates the norms of liberal democracy, one whose basic purpose is to preserve space for debate about truth, justice, and collective values.”
In post accord countries or countries transitioning from authoritarian regimes, truth commissions may contribute to a “possibility of disagreement among citizens,” which may lead to the resumption of violence. Truth commissions do not effect healing. They raise empty expectations of the populace, who have suffered past crimes. Knowing the truth can sometimes undesirably create space for reliving the bitter experience, and therefore opens up the “wounds of injustice” all over again. And finally, in the case of the South African truth commission, a study shows that 50 to 60% who described their experiences bewailed testifying before the commission, especially as punishment of the perpetrators was forgone, reparations not forthcoming and socioeconomic inequalities prevail.
On the flip side, despite the apparent limitations with truth commissions, the pendulum still swings toward the establishment of a truth commission in South Sudan. “Both the process and the product of a truth commission can make a critical contribution in the midst of a difficult transition.” As Priscilla B. Hayner rightly argues that:
Common wisdom holds that the future depends on the past: one must confront the legacy of the past horrors or there will be no foundation on which to build a new society. Bury your sins, and they will reemerge later. Stuff skeletons in the closet, and they will fall back out of the closet at the most inauspicious times. Try to quiet the ghosts of the past, and they will haunt you forever—at the risk of opening society to cycles of violence, anger, pain, and revenge. By directly confronting the conflicts of old, it is surmised, these conflicts will be less likely to explode into severe violence or political conflict in the future.
In furtherance, truth commissions are generally regarded as the genesis of transitioning to democracy after the fall of an authoritarian regime, or the end of a civil war in a negotiated settlement. It is thus a political and ethical demand to rectify past crimes. Truth commissions improve the longevity of a peace settlement. It is the first step toward acknowledgement, and toward restoring national reconciliation, flourishing human relationships, and healing both on the individual as well as on the societal levels. It does not substitute, but complements trials. Truth commissions precipitate public apology, through acknowledgment. Truth commissions can serve as a platform for addressing root causes of conflict. They are mandated with uncovering, illuminating, and acknowledging past political injustices; they address the needs of the victims; contribute to justice and culpability of perpetrators, and their recommendations can be used to bring about institutional reforms; and promote reconciliation. Mutual recognition is the base of reconciliation, which in turn is the base of peace, as the philosopher Hegel argues; peace is a condition where there is mutual recognition in a society. It is “a feature of the justice of right relationship in the present but [also] as a mode of repairing right relationships that have been wounded by past wrongs,” Philpott argues. Truth commissions’ task and findings serve this purpose.
However, the challenge for creating a truth commission within the Southern Sudanese context is that there is no discussion of forgiveness and reconciliation between the different tribes. Worst yet the SPLM and the National Congress Party (NCP) who negotiated the CPA, deliberately and consciously refused to include a provision on a creation of truth and reconciliation commission in the peace accord to redress past injustices. Compliance with international human rights norms, as well as reconciliation is only mentioned in passing and broadly, and not emphasized as one of the core provisions in the CPA. Only once the current President of South Sudan urged Southern Sudanese to forgive, but only with reference to Khartoum, while everybody knows the scope and degree of antagonism between Nuer and Dinka, for example, which is often reflected in contradictory statements between the President and his Vice. On more than one occasion the president accused the Vice President at least implicitly, of promoting “a parallel government” in Juba. Needless, to mention the hostility between the two camps of Dinka, Nuer and Shilluk, who are also known as the Nilotic tribes on the one hand, and the Equatoria tribes on the other. Moreover, unlike many transitional cases around the world, the first draft of the interim constitution, which have just been passed as the final draft by the legislative assembly seems to hardly make any reference to issues pertaining to power sharing, human rights, and reconciliation at least in any meaningful manner.
Indeed this is the strongest of all possible challenges, namely how to mobilize perpetrators of past injustices who also happen to be the policy actors, to support a legislation for the creation of a truth commission, let alone compelling them to testify before the truth commission? Hayner forcefully and accurately captures the challenges surrounding the creation of a truth commission, which may apply to South Sudan. She writes:
There are many factors and a range of participants that help shape each country’s transitional possibilities and constraints, and thus its posttransition reality. These include the strength of those groups or individuals who were responsible for the abuses and their ability to control transition policy choices; how vocal and organized is a country’s civil society, including victims and rights groups; and the interest, role and involvement of the international. In addition, the transitional choices will be affected by the type and intensity of the past violence or repression and the political nature of the transition. And finally, there are often aspects of political and social culture—an undefinable set of preferences, inclinations, beliefs, and expectations—that help to shape the parameters of whether and in what manner the past is confronted.
In my view, South Sudan meets all the above mentioned criteria for promises and challenges of the establishment of a truth commission. As mentioned above, SPLM constitutes the dominant force in South Sudan politics, and have established almost a one party rule, and almost unilaterally maintains a tight grip on key transitional policymaking, including the drafting of the interim constitution. In Naivasha, they were the only ones represented on the CPA negotiating table along with the NCP, Intergovernmental Agency on Development, and the Troika Guarantors, namely the United States, United Kingdom, and Norway. Civil society organizations were not invited nor were other armed groups, such as the Darfur rebel movement, or other political parties from both the North and the South. Currently Sudan, including the South lacks a vibrant civil society to lobby for a truth commission, except may the Church. Both major tribes in South Sudan perpetrated abuses against each other, which make them both victims and perpetrators. The culture seems increasingly secretive, highly militarized, and ethnically conscious. Together these factors make the creation of a truth commission difficult, but not impossible.

It is in this context that I propose a truth commission as one mechanism to foster sustainable peace, by promoting democracy and human rights, impartially enforcing the rule of law on all, and conducting institutional reforms. Mindful of these challenges, the truth commission that will be formed will have a limited but open mandate. It will solicit public hearings, have access to governmental documents, publish their results, and make recommendations to the government. However, as pointed out earlier, the primary task is really to begin to cultivate and educate the public about the culture of democracy. The truth about the past atrocities is known to all, it is acknowledgment that is missing. In their recommendation, the commission will strongly encourage the government to embark on the institutional reforms and issuing a public apology. The incentive that will be generated from this act is hopefully a small step forward toward national reconciliation, but which will also enhance public legitimacy of the government. Preceding the issuance of public apology by both the President and the Vice President, it is preferable that both political leaders set an example to the people by public testifying in a spirit of a dialogue before the commission. Rituals of reconciliation will then follow these public confessions in a manner reminiscent to the “people to people peace process” of the 90s, which was correctly a reflection of cultural practices of the Southern Sudanese communities. Judging by the culture, such a public display of reconciliation by the political leaders will motivate others to come forward and testify, including the commoners, who in traditional societies are known for their unswerving loyalties to their leaders. The process will then be expanded to include other tribes such as the Equatorian camp. But there should be no reference to trials, since under the current conditions prosecutorial justice, and accountability for those atrocities are inconceivable, a topic better left for another occasion. In sum, if carefully and properly done, the truth commission will be a success, and may generate acknowledgement, and apology, which may then lead to national reconciliation, healing and recognition of all the diverse ethnic groups as equal “first class citizens” in a new, independent and peaceful Republic of South Sudan.
Conclusion
Thus, in order to avoid sliding into violence, and restore unity and reconciliation—the basis of right relationship and peace in South Sudan, the government should establish a truth commission to conduct nationwide hearings into these atrocities, as well as other injustices committed by and against the Equatorian tribes. By the end of the proceedings, the commission should compile a report of their findings and publish it with concrete recommendations for GoSS to implement. As a first step both the President and the Vice President of South Sudan should acknowledge these crimes, and utter a meaningful public apology to the Nuer and Dinka communities respectively. Then they should embark on implementing the recommendations, which should include upholding democracy and the principles of inclusive governance that guarantees genuine political representation, service provision, and grievances alleviation of all the different concerned groups without exception, and without regard to ethnic or religious affiliation. The government should also be strongly encouraged in the report to embark on rigorous security sector reform to uphold human rights and the rule of law, and provide impartial justice to all, and may sustainable peace reign in South Sudan.

Dr. John Garang knew self determination was good right from the beginning of Anyanya 1 and that was why he joined Anyanya 1 but the support (both internal and external) that could make self determination be realized was not there.
Self determination was unwise vision to champion because SPLA/M would have been branded a separatist movement. Self determination as a vision at the formation of SPLA/M would have put the SPLA/M in the same putting with Anyanya I and denied support the Ethiopian government gave to SPLA/M.
Remember Ethiopia was fighting its own separatist movements at the time; Uganda was at war too, DR Congo was not stable either with separatist movement in Katanga Region, Kenya was reluctant to be seen supporting a rebel movement in another country.
So, where do you think support for self determination would have come from when neighboring countries were not happy to support such causes as self determination for minor groups in any African country?
Remember South Sudan did not have factory for guns and ammunitions to fight its own war. Therefore, external support was critical for SPLA/M vision and mission success.
Self determination/separation was tried by Anyanya I and II but failed to mobilize people within Sudan who were marginalized by Khartoum but not part of South Sudan. The Anyanya I and II civil wars were largely confined to South Sudan territory due to their separatist vision, therefore, making waging wars against Islamic Fundamentalists’ injustices exclusively a South Sudan versus North Sudan affair. With South Sudan tiny population and ill equipped rebel movements (Anyanya I and II), a third war that pitted South Sudan versus North Sudan was not helping South Sudan cause at all, and could not be repeated by SPLA/M wise leadership.
In addition, self determination /separation leaning vision during Anyanya I and II also failed to gain popular support from neighboring countries that saw it as a bad precedent for Africa.
When John Garang started SPLA/M, the first group to be destroyed was Anyanya II staunch champions of South Sudan separation who did not want a sugarcoated vision to achieve popular support for South Sudan cause.
SPLA/M as envisioned at formation managed to gain popular support which Anyanya I and II failed to gain through their narrow vision plainly put as separation of South Sudan from rest of the Sudan.
In simple term, SPLA/M vision of united secular democratic Sudan was meant to get support both within and outside Sudan to bring military and political pressures close to the centre of power in Khartoum to force them to accept comprehensively negotiated settlement to the civil war in Sudan. SPLA/M leadership knew at the negotiating table, issues that could have scared away SPLA/M groups in the north and supporters in the diaspora but benefits the south could be tabled for consideration. That is where self determination idea was to be brought up and agreed upon.
Idea of self determination was not a new thing to South Sudan during SPLA/M liberation struggle but it was unwise request to make without strong political and military standing for South Sudan to force that interest through as the best way of settling civil wars between South and North Sudan.
Anyanya I asked for self determination but it was denied because they had no serious power to force it through.
SSIM of Riek Machar asked for self determination but it was denied because there was no strong political and military standing to force it through.
SPLA /M asked for self determination and got it because SPLA/M had both the political backing and military standing to force self determination for South Sudan through.
In conclusion, self determination for separation was known to be the best option of settling none ending civil wars between South and North Sudan but the modality of reaching it had to be changed since two attempts (Anyanya I and II) were made for that goal but failed to achieve significant results.
Separatist movements hardly get support globally; examples are the Cabinda movement in Angola, Bakassi Peninsula group in Cameroon, Katanga group in DR Congo and many others in Africa and the world over. These groups had fought for several generations and now still fighting for independence from their mother countries but they are not getting their demands, at least in a foreseeable future.
If SPLA/M had changed its vision to fight exclusively for self determination of South Sudan as Riek Machar wanted, South Sudanese would have not gotten independence by now.
Just ask yourself why Riek Machar failed to get bullets for the guns he took from SPLA/M mainstream, leave alone securing new guns. It was because no one wanted to be seen supporting separatist movement in another country while suppressing their own diversities that require greater autonomy or independence from their central governments.
SPLA/M liberation struggle under united secular democratic Sudan exit strategy was to carefully apply military and political pressures to force Islamic Fundamentalists in Khartoum into serious and meaningful political negotiation and settlement of the civil war. The success of and how long to reach the exit strategy depended on SPLA/M military and political strength to force NIF/NCP to the negotiating table. SPLA/M military and political strengths finally forced NIF/ NCP into meaningful political negotiation and settlement of the civil war in August 2002 to January 2005 in which self determination option was tabled for negotiation and agreed upon as envisioned at the SPLA/M formation.
Therefore, CPA self determination had nothing to do with Drs Riek Machar and Lam Akol 1991 disastrous visionless split of the movement; but it was an option kept close from public by SPLA/M leadership not to scare away supporters before the war was to be brought to an end.
John Garang de Mabior, Martin Majier Gai, Karubino Kuanyin Bol, Williams Nyuon Bany, Salva Kiir Mayardit, Arok Thon Arok, and Joseph Oduho were wise when they agreed to launch SPLA/M liberation struggle under United Secular Democratic Sudan vision.
Always think big, narrow worldview always achieve none or little success in complex issues such as dividing nations’ territories.
Learn from Nasir gangsters’ failure in achieving their vision of independent South Sudan through the easy way of concluding shallowly thought-through agreements.

Regarding the politics of killing of innocent people by southern politicians or SPLA/M leaders is not only centered to certain individuals, that is to say non of them is a virgin ever Garang himself. The death of Samuel Gai Tut (Nuer), Abdalla Williams Chuol (Nuer), and Akuot Atem Mayen (Dinka Bor) at the formation of SPLA/M had nothing to do with unionist or separatist vision of the movement.
Those folks opposed John Garang’s leadership of the movement just because John Garang was younger than them.
After differences with Dr. John Garang group on who to be a leader of SPLA/M, those guys formed their own breakaway faction and moved to Fangak in Jonglei State. With their Nuer supporters in Fangak, they began killing SPLA recruits on their way to training camps at the border with Ethiopia. After they became threat to recruits routes, SPLA attacked their forces and they were killed in different battles. So Samuel Gai Tut was an enemy killed in action. His killing had nothing to do with SPLA/M vision but leadership only.
There were no 15000 or so recruits killed from Bhar-El-Ghazal by anyone in SPLA/M. That is a white lie, how could somebody killed 12 battalions of potential fighters when you are in desperate need of more people to champion cause for South Sudan? You should have even judged that to be a lie.
John Garang was a highly educated leader who knows the importance of human beings in achieving his goals in the Sudan. How could he then order a killing of such a large number of people?
John Garang ordered killing of some people like Martin Majier Gai (Dinka Bor) and Martin Makur Aliyou (Dinka Agaar), but those were politicians who could not agree with him on certain issues.
John Garang had never ordered a killing of a foot soldier in SPLA/M. Never, those senseless killings were done by people like Riek Machar and Lam Akol who were division commanders by then.
