Attack and Destruction of Toray Village

At 6am on 29 February 2005, over 500 armed militias supported by the armed forces allegedly from Nama military camp, west of Kass town, attacked and destroyed Toray village south of Jebel Marra, Kass province, Southern Darfur state. Reportedly, at least 17 civilians were killed, three women were raped and 11 wounded during the attack. Following the attack, the militias occupied the village and prevented those wounded from leaving to seek medical assistance despite the severity of some of the injuries.

SOAT has the names of 16 of the people reported to have been killed and 11 wounded during the attack. The names of the women reported to have been raped have been withheld for confidentiality.

The continued attacks on civilians in Darfur are a clear violation of the ceasefire agreement, United Nations Security Council resolutions and international humanitarian law protecting civilians. SOAT calls on the government of Sudan (GoS) to respect its obligations under the Abuja Protocols, which under Article 2 (‘Protection of Civilians’) of the humanitarian accords require all parties to the agreement to “Take all steps required to prevent attacks, threats, intimidations and any other form of violence against civilians.” Furthermore, under Article 5 (Security Protocols) the GoS is obliged to “expeditiously implement its stated commitment to neutralize and disarm the Janjaweed/armed militias”.

SOAT condemns the continued violations of the ceasefire agreement and all attacks on civilians. In light of the serious and ongoing nature of attacks on civilians by both militias and government forces, SOAT strongly urges the international community and the GOS to:

i. Immediately investigate the attack on Toray village

ii. Immediately cease attacks on civilians and adhere to it commitments under the ceasefire agreement

iii. Ensure the protection of all civilians, including displaced persons

iv. Disarm the Janjaweed militias immediately and all outlaws operating in the Darfur region

v. Facilitate the immediate delivery of emergency supplies such as food and medicine to the severely affected population in Toray village

vi. Guarantee respect for human rights and fundamental freedoms throughout the country in accordance with national laws and international human rights standards.
