Beech 1900C: The flight that killed GoSS officials (1)

May 25, 2008 — On May 2, 2008, the ill-fated flight, Beech 1900C with a Kenyan registration, 5Y-FLE, departed the town of Wau in South Sudan for its capital of Juba with a quick stop in Rumbek. At about 0710 UTC, the flight experienced a loss of power in both engines, and crashed at about 15 miles away from Rumbek. On the point of impact, the airplane went into flames and was completely destroyed; killing the 2 Kenyan flight crews and 18 Southern Sudanese passengers on board. Among the fatalities were 2 high ranking South Sudan Government (GOSS) officials; Dominic Diim, the South Sudan Minister of Defense and Justin Yac, Presidential Advisor on Decentralization. Since the incident involve government cabinet ministers and has heightened the risks of flying in South Sudan, many concerned people cry foul, including the South Sudan President, Salva Kiir, who literally shed tears profusely. He alleged that South Sudan has become a “dumping ground” for junks by those who are exploiting the newly found business opportunities in South Sudan, the Wild West of twenty first century.

It is worth mentioning that this is the first part in a series of investigative reports under the title “Beech 1900C: The Flight that Killed GOSS Officials” to uncover if at all, any company, individual, or group of individuals in the process of exploiting business opportunities ended up using South Sudan as a ‘dumping ground for junks’ and by implications responsible for the crash of flight 5Y-FLE.


Beech 1900C, a twin-engine turboprop airplane is an improved model series of Beechcraft 1900 airliner, manufactured by a United States company, the Beechcraft Division of the Raytheon Company. It was until 2006 that Onex Corporation and Goldman Sachs acquired aircraft manufacturing assets of Raytheon to change the company’s name into Hawker Beechcraft Corporation. Beech 1900C was first introduced in 1983, however, the production of the craft is said to have been stopped in 2002.

The craft is fitted with special radar for weather and designed to fly in all weather conditions. It can take off and land safely in relatively short airstrips as well as on grass and rough runways. The craft can operate at a maximum altitude of 25,000 feet and cruises at a maximum speed of 525 km/h. It is capable in flying an excessive distance of one thousand miles, nonstop. However, for the purpose of fuel efficiency, it is normally scheduled to fly shorter routes of one hundred to six hundred miles, which takes from 20 minutes to 2 hours. Its pressurized cabin takes a crew of two and 19 passengers.

The craft is primarily designed to be used as a regional airliner. Several airliners from around the world deployed the Beech 1900 for commercial use. It is also used for military operations by several countries as well as for corporate transportation. The craft can be fetched at a market price that range from 1.6 millions to 4.6 millions US dollars.


Beech 1900C, the flight 5Y-FLE that killed GOSS officials is said to have been sold, leased, or donated by CemAir (Pty) Ltd, even though the company is claiming to reserve its rights of silence—refuses to confirm or refute either of the allegations. Nonetheless, other sources indicate clearly that the origin of this flight is none other than CemAir (Pty) Ltd.

For starters, CemAir is a South African based aircraft leasing company, specifically located at Lanseria Airport near Johannesburg. The company specializes in the supply of commuter turboprop aircraft to operators across the African continent and the Indian Ocean Islands. According to the statement by the company, it focuses on the United Nations and Non-governmental Organizations where it established charter and airline operators, and places “aircraft on short, medium or long-term leases.” Not surprisingly, the company has in its fleet, the Beech 1900s and Cessna Caravans, essentially the only two types of aircraft in its fleet.

CemAir is headed by a notorious, Miles van der Molen, a gentleman with a proven track record, which have been the subject of several investigations by the South Africa Civil Aviation Authority. For example, on December 6, 1999, a flight carrying 9 computer company employees en route to Oranjemund in Namibia crashed near Rand Airport, killing all those on board including the pilot. It was found to be “engine failure, compounded by the aircraft being overloaded and negligence on the part of the aircraft charter company, led to the fatal aircraft crash.” That flight belonged to the charter company known as Flightline Charter Services and Miles van der Molen was the chief executive of the company. According to the inquest of South Africa Civil Aviation Authority, which was concluded in 2002, Molen in particular and in his capacity as the chief executive plus the company as an entity was found to be in violations of series of rules and regulations indicated as follows:

- Miles van der Molen, did a test flight with the plane shortly after it was bought by the company, while he was not a registered test flight pilot.
- Miles Van der Molen also inserted documents into the aircraft’s operating manual which did not reflect the correct maximum take-off mass allowed. The papers he inserted were photo-copied from another manual and reflected information for an aircraft fitted with specialized equipment.
- The time for the aircraft to undergo a mandatory periodic inspection, as stipulated by aviation legislation, had also expired at the time the flight crashed.
- The Flightline Charter Service was found to have deviated significantly from the South Africa Civil Aviation Authority approved Operators Manual in terms of the critical issue of weight and balance of the aircraft. Actually, the aircraft was more than 800 pounds overweight when it crashed.

Once again in 2000, the aircraft that belonged to Flightline with registration ZS-NGV was taking off from Inhambane, Mozambique to South Africa , however, it was reported to have hit a high tension wires where it crashed, killing the pilot and the technician who were on board.

Investigating fraudulent issuance of license to the pilot involved in this fatal crash incident, the South Africa Civil Aviation Authority, found:

CN Delacovia, the pilot of the aircraft did not hold a valid CPL with instrument rating.

Since then, the Flightline Charter Services has long been closed down by South Africa Civil Aviation Authority. Now, with the emergence of CemAir, under the same management, people begin to wonder whether it is the same Flightline and the old Miles van Der Molen, emerging under guise. Also, considering that CemAir has just been formed in 2007, the guise seems to be more apparent. Perhaps, the pilots who are putting their lives into the line by taking to the skies understand the gravity of this situation more than others. Listening to them will make the rest also understand what they go through. One of the pilots who is familiar with Miles van der Molen’s established track record can just “wish the South Africa Civil Aviation Authority would go after all the companies that send young guys off outside the limits.” Another pilot warns that one would “think South Africa Civil Aviation Authority would do something about this guy (Miles van der Molen), like have him shot if he comes within 500m of an airport.” And a pilot who claimed to have worked for Molen wonders that “some people just keep on getting away with killing people while better ones like Nelair gets stopped.” At any rate, the story is far from over, especially due to the fact that young guys are continuing to be sent “off outside the limits” for their demise.

    Thanks a lot for these findings. I hope all what you wrote has a legal defence outlet for all of us who are appreciating your findings. Committeed the findings might not be but they look researched giving you a thank you for what you are pursuing. Sometimes we fail to go a direction and we go directions in decisions. I see you have a point here which may be taken in as a national decision. I hope you were a member of the Committee formed to look into what happened that let the Beech 1900C became more expensive than its price.

    Dear Paterno, Our major problem/disease in South Sudan is the “BLAME” syndrome. In reference to your article “The first part in a series of investigative reports under the title “Beech 1900C: The Flight that Killed GOSS Officials” to uncover if at all, any company, individual, or group of individuals in the process of exploiting business opportunities ended up using South Sudan as a ‘dumping ground for junks’ and by implications responsible for the crash of flight 5Y-FLE.
    I find the claim by many concerned people who cry foul, including the South Sudan President, Salva Kiir, who literally shed tears profusely very hypocritical and not an excuse to refusing to learn. He alleged that South Sudan has become a “dumping ground” for junks by those who are exploiting the newly found business opportunities in South Sudan
    There were often two (2) unfortunate hallmarks of things to come on “Air Safety Procedures and Regulations” in South Sudan today than before. First, the South Sudan Civil Aviation Authority policies are not representative of the requests and realities of the rest of the Aviators/Aviation fraternity and second, the government that is the Ministry of Transport and Roads seems to have a real bad memory in running the “Aviation Section” because they took to titles and positions but with little know how of what Aviation was all about.
    Some remarks go begging and I term President Salva Kiir’s remarks as “Random Risks.” Whoever prepared President Kiir’s speech, knowingly or unknowingly spared not even President Salva Kirr or himself on why “KNOW WHAT” matters than “KNOW WHO” while dealing with issues of interests.

    My comment will be with lots of questions to all of us from these questions will we see where the real problem is NOT the planes or ORIGINS of the planes.

    1. Is this the first air crash claiming lives of South Sudanese prominent figures? Is it the second, the third, the fourth etc? What has been done so far to minimize such incidents happening??????????????????
    2. It’s until there is a plane crash which claims lives of prominent figures is when the Government of South Sudan (GoSS) leadership begin to question the status of some of the aircraft that have been flying them all around South Sudan? What a very unfortunate wake-up to realities. What measures does/did the Civil Aviation Authority of South Sudan (SSCAA) do regarding Air Safety Regulations and Procedures since its formation/creation???????????
    3. What a begging remark!! But again does the Civil Aviation Authority in South Sudan have personnel who are well founded in the Aviation Industry to regulate and oversee the air operators and the worthiness of the aircraft flown in their airspace? These remarks by even President Salva Kiir are self accusing.

    4. Who gives permits to these air operators to operate in South Sudan?

    5. Who proofs that these operators operate airworthy aircraft?
    6. Who in the Government of South Sudan (GoSS) especially in the Civil Aviation Authority (CAA) regularly inspects some of these aircraft to assert that they are airworthy?

    7. What Air Safety Precautions are taken by the Government of South Sudan (GoSS) through the South Sudan Civil Aviation Authority regarding all the Commercial flights flying in and out of South Sudan airspace?

    8. Why is aviation the only mode of transportation in which there is a hands off policy in South Sudan where all are capable of managing and running it as a soldier, tribesman, nephew, brother, cousin and in-law of the well placed? It is indeed even more regrettable that our transportation policy makers at the GoSS/South Sudan Aviation Administration and the Ministry of Transportation that have been unresponsive to those voicing concern.

    Paterno, why would you go as far as South Africa when the real rot is within our home yards our own the South Sudanese in the Government of South Sudan (GoSS) importing the virus of vice. You did a great deal in your finding, just read this piece. Who is/are South Sudan Air Connection Limited (SSAC)?????

    South Sudan Air Connection Limited (SSAC) is a South Sudan airline company which was registered on 31st.January.2007 under the Southern Sudan law. Their claim “They are professionals committed to cutting edge technology and perfection in services. They have flown heights of success and are still raring to go.” Prominent persons in South Sudan and GoSS are behind this Charter Company and most of them had shares with a Charter Company in Nairobi, Kenya.

    Who are the directors of South Sudan Air Connection Limited? Paul Yash Thorgow is a CEO, Bona Panak Bier is a Director, Kwany Mayom Deng is a Director etc, etc. What aviation background do they have? Where do they hail from? How long have they been in the business? What is the composition of the Management? This Company besides doing other schedule flights solely is doing flights for Government of South Sudan Officials and what would we call this??????????????????????????????

    Indeed if there was ever an accident waiting to happen, this is it. It has been long over due if the Aviation Safety Regulations and Procedures were not taken into account. God forbade this happening for long but our unforsighted unskilled individuals with responsibilities demanded this so much by their ways of dealings and running things.

    The more often we do something dangerous and get away with it, the less we perceive the danger. Eventually, our mind fools us into thinking there’s no danger. A risky activity done many times begins to feel safe. This is a human trait that is in all of us but now mostly with some in the Government of South Sudan (GoSS) and the Civil Aviation Authority.

        I have just read your article in the Sudan Tribune

        I find it interesting that you can write a whole
        article dedicated to this crash, perported origins of
        the aircraft, and it’s owners various wrong doings
        within South Africa and Mozambique.

        Your multi-part, investigative piece has hit upon a
        snag from the beginning

        BECAUSE -

        The plane which crashed in Rumbek is NOT 5Y-FLE, but
        is in fact 5Y-FLX, owned by Flex Air Cargo not CemAir,
        based at Wilson Airport, Nairobi and formally owned by
        Rossair 5Y-ROS, it was reregistered after been sold at
        an auction sale after the demise of Rossair

        I know the owner of the plane and have flown on and
        shipped cargo with the same plane many times.

          I am glad you read my article, more over with interest. I suggest that you read it again.

          1) Never anywhere I mentioned that the flight is own by CemAir. I was only establishing the origin of it. An investigation that ignores such background is no investigation.

          2) Mark that this is not the "whole article" just a first in the series of the reporting.

          3) You may be right that the flight is 5Y-FLX, however, the 5Y-FLE is not my creation, it is from a US government investagtion document. If interested, I will provide you the document.

          Please, if you have any useful information with respect to this flight, provide it to me.

            Dear Writer,

            I think it is very unprofessional for you to indulge in the complex aviation accident investigation industry without having the necessary experience, background, facts and knowledge. I am a pilot and have flown in S. Sudan for years and even I can not speculate on what could have happened. There are professional aircraft accident investigators who are mandated with this heavy task and its not even the duty of the committee ( which you don’t qualify to be part of as our learned friend Bol Joseph Agau suggested) to investigate the accident.

            I have flown the B1900 type for thousands of hours and a lot of the information such as quote "However, for the purpose of fuel efficiency, it is normally scheduled to fly shorter routes of one hundred to six hundred miles, which takes from 20 minutes to 2 hours" is WRONG and you should not post it without confirming its credibility not withstanding your source. The same applies to the registration and the date of the crash which you have wrong as well. If you are an ambitious investigative journalist trying to impress and make it up the ladder, I think you might as well take time to counter check the authenticity of any information before you post it on line.

            If you will allow i would like to educate you a bit on the complexities of aircraft operation and lease.

            An aircraft owner such as Mr Miles Van Der Molen is not responsible for the aircraft operation if aircraft is leased onto a company duly licensed and that company is involved in its maintenance, crew and insurance. What if he had already sold the aircraft???? will you still drag his name into the equation? If I owned a piece of land with a dam and sold the same land to you and your cattle drank from the well and fell ill am I responsible? I hope you realise that this is defamation of character and you can be charged in a court of law for the same and either sentenced to jail term or fined.

            You can not judge Mr Miles Van Der Molen based on the past. A lot of airlines such as Kenya and Sudan airways have had crashes in the past. Does this mean any crash in the future is automatically related to the previous one or the CEO who was in charge when the previous accident occurred? I really don’t think so.

            All said and done this is a very difficult time for the families, relatives and friends of those who lost their lives as well as the company that owned operated the aircraft and it would be my strong suggestion that you maintain your cool and let those mandated to carry out investigations (SCAA,KCAA,SSCAA and NTSB) do their work and present their findings and recommendations to any such committee or Minister or the president of S. Sudan instead of you indulging in baseless and unfounded speculation which can only lead to unnecessary anxiety and unrest to those affected.

            As Hauwuikeenbay Zzeggo and Ian Cox said, blame game will not lead us to any solution to any problem at hand.
