Airbus sued in US over doomed Sudan Airways 109 plane crash

January 13, 2010 (WASHINGTON) – The families of the victims aboard a Sudan airways flight that crashed more than a year ago in the Sudanese capital filed a lawsuit against the France based Airbus company alleging that the plane was “defective and unreasonably dangerous”.

The 49-page filling made at in the Circuit Court of Cook County, Illinois Cook County said that the plaintiffs representing the victims “suffered a loss of support, loss of net accumulations, loss of household and other services, loss of care, comfort, companionship, guidance and society and mental anguish, sorrow and grief”.

The attorney said in his brief obtained by Sudan Tribune that he is bringing the action under the Illinois Wrongful Death Act.

In June 2008, the Sudan Airways Airbus A310 coming from Amman via Damascus went off the runway after landing at Khartoum International Airport during a thunderstorm and burst into flames killing around 30 people.

At the time, Airbus said the A310 involved in the accident was 18 years old and had been operated by Sudan Airways since September 2007.

The Airbus A310 is a twin-engine, wide body plane used by a number of carriers around the world. Typically configured with about 220 seats, it is a shorter version of the popular A300.

The plaintiffs recount a number of technical defects in the aircraft including engines “susceptible of igniting and exploding”, “deceleration mechanisms…not capable of slowing the aircraft under all reasonably anticipated conditions”, Ground Proximity Warning System (GPWS) that was “inadequately inspected and tested, provided false or nuisance warnings which interfered with the safe operation of the flight”.

Other defendants named on the filing include United Technologies Corporation, Goodrich Actuation Systems, Eaton Corporation, Parker Hannifin Corporation, GE Aviation which manufactured components used in the plane.

Montrose Global Capital, MGC Leasing Inc and Bank of America were accused as failing to “use reasonable care in the entrustment, sale and disposition of this deadly instrumentality so as not to entrust and sell this deadly instrumentality o an unsuitable, unfit or irresponsible use”.

Bank of America had ownership of the plane prior to selling it to Sudan Airways through Montrose Global Capital and MGC Leasing Inc, the documents show.

The attorney asked the court for unspecified compensation and reimbursement of costs under the 39 counts he is pressing against the defendants.

Two weeks after the incident, Sudan’s Civil Aviation Authority suspended Sudan Airways flights because it failed to undertake measures outlined by the authority in an annual audit making it non-compliant with international standards.

Sudan has a poor reputation for air safety, especially on domestic flights.

    Imagine what happened in Lakes state electoral college. The semi illiterate Chairman called man kuc just rigged the nomination in his devil heart. yesterday another crap and Ugly monkey like, called Mabor Kau another guy that was bribed talking rubbish that the selection creteria is based on what you have done/achieved in the movement.if that is the case, how can deserters and late comers to the movement scored highly, this is laughable. The Ugly Mabor mentioned that Paul Mayom Akec and William Ater drew, it was the semi illiterate chairman’s vote that remain to be cast, when he casted his vote, it altered all the 24 members votes by bringing the last person (Deserter or Nyagat by Name Magok Manyol) that got 3 votes out of 25 to be in the reserve list while the one of those who drew takes the third position votes. this is amazing and shameful to State SPLM Secretary Mathing Ker, who is suffering from Ma’ngurek in my dialect or (what shall i do, in direct translation) (that is cronic wound that does not heal no matter what. that is cancer of cours) I would like you guys to take bribes and do the right things than confusing the whole state by the filthy mouth of yours that do not know boundries of where and what to eat from whom. SPLM in Lake State is in a complete failure coming the April General election.
    Lakes State is the worse state in South Sudan in term of nomination where people with chicken brain are involved in Electoral College. The guys are bribed like hell, the worse part of it is the chairperson of the 25 people that make up the college, Mr Abraham Meen Kuc, is a beggar who have not attained certificate of any Educational level being a primary or high school. Philip Marol Mading and Mathing Ker are the crooks of all that will cause disaster in the state. I don’t understand why the Electrol College was formed in the first place if Abraham Meen Kuc, Mathiang Ker and Philip Marol Mading altered what 24 people came out with. Meen Kuc, when you are assigned to a national obligation, you need to be careful and do the right thing for the state and the country as a whole. you were not given the task in order to get rich over night of (V8 car)Miith Apuol, the luxurious car that will reached Rumbek today from Juba as a promise by Paul Mayom Akec and Deng Athorbei just to alter the original work of the committee in Palm Tree Hotel. Shame on Meen Kuc and Mathiang Ker
    In simple calculation, for example, if people draw 81 to 81, and chairman votes,
    Then it will be 82 to 81 which is very clear if bribery is not put into consideration as you did. In that simple Arithmetic, the nominee of 82 will be number then followed by nominee of 81.
    Then it should have been like this if Meen Kuc did not take bribery into consideration.

    3. And bala bala….
    But since Meen and Mathiang Ker are bribed heavily, the money blinded them to the point of heart Attack.
    Meen Kuc and his step father Mathiang Ker contradicted themselves when they were trying to defend their defunct Decision.
