SPLM-IO rejects unilateral creation of 28 states in South Sudan

November 5, 2015 (ADDIS ABABA) - The opposition faction of the Sudan People’s Liberation Movement/Army (SPLM/SPLA) said it has rejected the unilateral creation of 28 states in South Sudan by president Salva Kiir Mayardit, raising doubts whether the peace deal signed in August will be implemented without addressing the matter.

President Kiir, who signed the peace agreement with the opposition leader and first vice president designate, Riek Machar, in a presidential order on 2 October, announced the creation of 28 states, expanding the number from the current 10 states in the country.

In its 2nd meeting on Thursday in Pagak, the headquarters, the opposition faction’s national liberation council deliberated on the matter and passed a resolution condemning the act by president Kiir, calling on him to revoke the order.

The leader of the opposition SPLM-IO, Riek Machar, on Thursday issued a strong worded press statement calling on president Kiir’s government to revoke the decision so as to save the peace accord.

“The Sudan People’s Liberation Movement/Army (SPLM/SPLA) has rejected the unilateral creation of 28 States in South Sudan by President Salva Kiir Mayardit. This is a clear violation of the Peace Agreement signed in August on the Resolution of the Conflict in the Republic of South Sudan,” partly reads the statement signed by the opposition leader and a copy of which was extended to Sudan Tribune.

Machar said the presidential order and endorsement process by the national legislature were both in violation of the peace agreement, saying even the current Juba parliament had no power to amend the constitution alone after the peace agreement was signed by the rival parties.

“The Peace Agreement was signed on the basis of the current 10 states, Articles 15.2 and 15.3 Chapter I,” he said.

He further explained that after the ratification of the agreement by the National Legislature in Juba and the SPLM/SPLA National Liberation Council on 9th September 2015 respectively, “none of these institutions has the competence to legislate or amend the constitution in matters affecting the peace agreement.”

He said the national constitution amendment committee established under the peace agreement is the only body that will initiate the amendments in the constitution.

The meeting also called on IGAD mediation and its international partners to put pressure on the government to respect the peace deal.

    Machar you will negociate on since your prosal was 21 states additinal 7 you will talk on and can not stop the implementation of the peace signed, please see the suffering of the local communities in south Sudan.

      Kiir has to decide whether he wants peace for South sudan or to carry out the 28 state implementation.

      28 states breaks the peace agreement. It beaks the Constitution. It will cause more conflicts about land and borders.

      Kiir tends to make bad decisions instead of good ones.

        The African Union Report clearly shows that government forces started the whole cycle of revenge killings. The African Union Report destroyed the myth of an attempted coup.

        Kiir creates conflicty where he should provide unity.

          Nobody has yet given any good argument as to why 28 states is a good idea or how it will actually work.

          Already there are many stirring against this unworkable decree. It is no good for South Sudan.

          Ambrose Riiny Thiik, Jieng (Dinka) Council leader, was unable to defend 28 states in front of Luka Biong. Even the father could not defend his own baby!

    South Sudanese are proceeding with implementation of the order and Nuer don’t want their states then it’s upon them. South Sudan can’t wait for Nuer to get organise and South Sudan begin its dev’t. The country is big and Nuer can’t prevent it

    If the decisions by drunkard president will not revoke, it will make a December dead day to be alife and turn to be death day to dinka instead of Nuer.
    Let the Jieng council of thieves looters to revoke it before our coming to Juba or we will turn this peace to red line instead of green one.

      Ngundeng, look at how your people are suffering before calling for another war. you know vividly that your nuer rebellion will never succeed in thousands years. the opposition should talk about refinement of 28 states not abolishment of 28 states. also for those who do not understand the creation of 28 states, it is solely meant for administration not land demarcation.

            Jubaone correctly sums up some reasons why 28 states will not work. It is too many politicians and too much cost.

            For the same reason I oppose 21 states.

            Now, why is it that Kiir supporters keep saying that Kiir is right but can not put forward any good argument to support Kiir’s proposal?

    Certainly Dr Machar doesn’t require a whole month for him to reject this nonsensical decree about the 28 states!!! We don’t need leaders who are like sloths!! Kiir’s government doesn’t have the money for implementing the just signed peace agreement let alone the stupid idea of 28 states. I think Kiir is rarely sober!!!

    Guys, Machar and his butchers need to come back to Juba first before we will hear his argument. He doesn’t have valid argument why because he was the one proposed federal system and 21 more states. Now, the government gave him 7 additional states. He doesn’t want anymore.

Nuer needs to rethink again about Machar leadership. As long you support fail leadership Nachar, you will destroy Nuer leadership.

      Guys, Me. Point, Jieng Council of Elders are rational and thinkers. They evaluate every move Machar makes, but with ideas and strategies not war. They never promote kiir because he is Dinka. They only promote rational ideas and country constitution. What are you promoting?

    Salva Kiir is not as same as traitor, power hungry Dr Riek Machar. This is not to question Gen. Kiir recorded failures but approval of 28 States was was one where Kiir got it 100% correct. Those fighting it will be against odds.

      Kiir betrayed South Sudan when he massacred its citizens in Juba.

      Kiir betrayed the economy when he started Kiir’s wars against political reformers like Pagan Amum, Deng Alor. That is why the SSP is 20 to the dollar.

      Kiir supporters can’t even give reasons why 28 states are needed!

    Dinka are the only people are who supporting kiir alhawir but not all dinkas, only dinka of gungorial and aweil.The 63 tribes of south sudan stand with Dr Riek.The rise of dinkas in 2005 and the fall of dinkas is 2016. long live Dr Riek Machar.
