Kiir summons N.Bahr el Ghazal Governor over return of political rivals to prison

March 31, 2011 (WAU) — General Salva Kiir Mayardit, President of the semi autonomous regional government of South Sudan on Thursday summoned Governor of Northern Bahr El-Ghazal State, General Paul Malong Awan Anei, over the arbitrary detention of nine opposition figures.

On March 23, 2011, over 20 political opponents who are members of the southern ruling party, the Sudan People’s Liberation Movement (SPLM), were arrested in different locations in the state by the state police and security elements over allegations of a suspected demonstration. State authorities say they discovered a document written by unknown groups calling for demonstration in all the five counties, against the incumbent governor Paul Malong Awan Anei.

Some of the detainees were released without charges after spending two to three days in local custody between 23- 25 March 2011. Most the detainees are from Aweil East, a home county to the incumbent governor Anei. Oyai Kuek, Akot Nyang and Akuei Garang Deng were among the first detainees to leave prison without charge Others were released four days after they were arrested but nine — reportedly targeted opponents — remained in custody at Machar Kunyuk in Aweil town, capital of the State.

On Wednesday 30, March the court announced the release of releasing nine political rivals after they had appeared twice before court without charges being presented against them, nearly two weeks after detention. However, on Thursdays 31 just a day after their release was made, Sudan Tribune received reports from individual officials within the state administration as well as immediate family members and relatives that the nine officials had been returned to the prison.

The president of southern Sudan government, Salva Kiir Myadrit, called the governor and asked him to meet him in Juba to elucidate the situation after being reached by many people to denounce the unrestrained exercise of power by the state governor.

A highly placed source in the office of the president from Juba confirmed to Sudan Tribune that governor Malong has been summoned by the president.

“Yes, governor Malong came today from Aweil. He is in Juba now,” further said the official declining additional comments.

Police and judicial officials in the state today told Sudan Tribune that they were ordered by the state governor to return the nine political opponents in the prison after their release.

“They have all been returned to prison. All nine of them are now in the prison. The governor ordered their immediate return to the prison else we replaced them and ordered us to write statement of why they were released without his approval,” one of the senior legal counselor, who requested to remain anonymous told Sudan Tribune:

“Some of us were threatened with dismissal from our jobs. Others were arrested. Police officer who was on duty yesterday, has already been arrested for allowing them go to the court and released. We were asked to write either an apology letter or accept to go. Above all, we were accused of collaborating with those the state government accused of sabotaging peace and security of the state.”

He further said they have communicated the situation in which they have fallen to higher authorities in Juba.

“We have communicated the situation in which we have fallen to higher authorities in Juba and they said they have communicated this to office of the ministry of the legal affairs and constitutional development.”

“We, also, at individual levels, have communicated with officials in the office of the president of the government of south Sudan,” he said, adding the feedback from the office of the president was positive.

“The feedback from the office of the president has been positive. They said they have passed the message to the president. And of course, we believed they have passed it to the president because we have heard rumors that the governor has been called by the president today over this issue,” he said.

Abuk Athian, a wife to Lieutenant Colonel Garang Joong Akoon, speaking to Sudan Tribune from Wanyjok, an administrative headquarters of Aweil East County, also said that her husband and the eight other detainees had been sent back to prison.

“I am now going back to Aweil. I have just come from there to see someone here and will go back now. Garang has been returned to the prison today. He is arrested with eight others. These are the same people, with whom they were released yesterday”, said Abuk, adding that she still does not understand the reason why her husband is arrested.

“I still do not know why he is arrested. Nobody told me the reason of his arrest and Garang (her husband) also says he does not know the reason of his arrest,” she explained.

Bona Makuac Mawien, minister of information and communications in the state administration, in a separate interview with Sudan Tribune from Aweil town, capital of the state, said he was aware of the arrest but does not know the real cause.

“Yes, I am aware of their detention but I cannot confirm the reason of their arrest because I do not have the details. So, I cannot confirm anything because I do not know the real cause,” said Makuac.

Minister Makuac who acts as the official spokesman of the state government said he has summoned security elements he believed involved in identifying of those suspected to have written a document calling for demonstration against the governor, for an explanation.

“I have asked security officers I am told participated in identification of people suspected to have written this document. I wanted them to come for explanation so that I know what exactly happened because I do not want to issue statements on rumors,” said minister Makuac.

    We encourage your seriousness about all what is happening in the young nation South Sudan.

    It isn’t only by figure pointing that will ease the situation but with orders.

    You need to be more vilgilant with what are so called SPLM’s members b’se they’re always members when in power but turn against the party when power is given to another SPLM member.

    What kind of membership is that?

    Malong Awan deserve capital punishment because he is almost causing political and chaotic weakness to the party (SPLM) as well as South Sudan.

    So if you do not see and look after them properly they will join Athor and his associates.

God bless the president for questing for democracy to prevail in N. Bahr el Ghazal. Governor Awan was denounced by his electorates but he forced himself in and is now fearing people to speak out their grievances thats why he wants them to remain in prison so that people have the fear to stage any demonstration. He even went ahead to intimidate the police and lawyers who made the law to prevail. MAUMAU

    Dear Southerners,

    I’m not against President Salva, but I disagreed with him regarding this issue, This is strictly the governor job, because the governor is in charge of his state’s affairs.

    President, Salva, however, needs to focus on significant issues that has federal nature such as rebellion and security in South Sudan. Non significant issues such as this should be left for the state government to handle them.

    Since rebellion broke out,President, Salva and his Vice, Reik never came out officially to addressed the people regarding the security situation in the nation. At least they should come out ones and tell the nation how they feel regarding this important issue of insecurity. But they kept quiet without even acknowledging that the nation has insecurity problems.

    I don’t know for how long they continue ignoring the people and let people deal with rumors and confusions. Leadership is about leading the people on the rough and tough times. A good leader should come out and address the nation and tell the people the facts regarding the situation facing the nation.

    A Leader should possess the charisma and courage to face and address the nation without fears. We are living in an information era. Confusions and disinformation are easily available and obtained through venues such as Internet, Radios, Newspapers, and Broadcasting Journalism. Therefore, is very essential for the president to come out and address his/her people and sets the records straight, defuse the situation if possible, and most importantly show the people the right direction to follow and how this situation should be resolved.

    I’m not sure why the President summons the governor of NBG over minor issues such as this, and failed to summons the governors of Jongaly, Unity, and Upper Nile States for the rebellions that killed hundreds people including women, children, and elderly men.

    Also, I was stunt to find out that he did not do anything when six SPLA soldiers got ambushed and killed by unknown gunmen in one of the greater Equatorial States. Did he summons the governor? Why a commanders in chief failed to summons the governor who let six SPLA’s soldiers murdered in cold blood? I leave you to think about that one.

    Is President, Kiir worries about these political rivals prisoners more than his innocent people and soldiers? As Brother Ahmed said ” Kiir, you have to proof that you are in control, not the general or the governors.” What a joke!

    I vehemently disagree with this statement because the first priority for the President Salva is to provide security and protection to his citizens from aggression that’s currently taking place in more than five states.

    His people are being killed by rebels everyday while he is in Juba doing nothing;I think this is the area he needs to be in control. Making security as a top priority.

    The second priority is to feed your people with accurate information. Transparency is very effective tool to utilize so that the president would fill the information gap that people are in dire needs.

    Finally, The President should leave issues like this for the states. States have courts and I think states has the needed capacity to handle such problems. President Salva, should focus on issues that have immediate impacts to the people of South Sudan. Issues like security, food shortages, Inter-States border disputes and cattle robberies, and International Relations. Thanks

    What these people have in com mon? well number one they all are non-Dinka and all are staunch separtists and the only strong leaders God spare during the cold blooded years of Garang.

    Now, they haven’t mentioned any Central and Eastern Nue figures in the plot. that is because the Central and Eastern Nuers have lost most of theirs strong Military leaders during the war and most of which were murdered by people like Kuol Manyang in Equatoria or else this plot wouldn’t reach this stage. it couldn’t been nip in the bud long ago.

    Now, the goal for this plot is to re-unite South Sudan & North after the elimination of these strong figures.

    God has reveals this to general public by in a murky way. but now, its will be ugly because all of those people tribe are the majority in the South and were the front line warriors during the liberation war for South independence.

    This plot will have the opposite effect and also grave repercussions beyond South Sudan.!!!

    Your believe is just a barbaric ones. If you have studied carefully, the contribution of Northern Bar El Community to this struggle- they are the one who suffered immensly in the hands of arabs as well in the hands of the incumbant Governor. Malualjiernyang community were acquiring arms for two reasons
    1. They were to defend themselves from Bagara attacks;
    2. They were deviated to fight for the liberation- National duty.

    For these two reasons, the community can not be regarded to be cooperating with Ayii Akol. Ayii Akol is an alien- a muslim who is so selfish and want to survive alone. He does not care about his tribe, culture and traditions.

    It is me who believe that the arrested officials were innocent and they were planning to carry out demonstration against the Governor, then it is a particular case with the Governor and it should be treated as the Governor is not delivering service as expected.

    Do you know they qualities of the Incumbant Governor? He is a womanizer. He has huge family more than 120 wives and 500 Children. It is good to have that number of family size in the war torm country like this but that doesn’t means you have to feed them from the State Budget. That does not mean you need to dictate your own people.

    Malong has made delivery of goods to other states very difficult by imposing high taxes. These taxes goes to the feeding of his family.

    President Kiir is right to summon him for introgation. There is arrest without warrant. In a constitutional State, there is arrest warrant that has charges and should come from competent authority. The section of the law has to be quoted. Governor is just a mere officer and he does not have sections of the law.

    He has no rights to arrest people if they are not contented with him. He is to be opposed. He wanted all NBG Community to muscians who can sing songs to praise him. He is happy with muscians who praises.

    Malong should not take laws in to his hands and abuse them.

    He should give proper explanation otherwise, we hope, he be removed though he was an elected Governor. This is where we need change to be imposed.

After all, since you took office on Thursday, 08/11/2005 you had never show seriousness. Your office was alleged of corruption and until this time you did not make any substantial changes. In my own opinion, only God will determine the status of the Southern Sudan. I and others people we were hoping you that you will carry the visions of those who were passed away and those who are still now with you. As a reality, you fall.

    Our right we Southern Sudanese people is not in your hand, but in the hand of God. I can repeat again that pointing the finger is not an adequate reason to help you for brainstorming those extremists.

    Give me a Brake! How can this issue be a national issue? What makes it a national one? And can you tell me who amongst these rivals is a national figure? The governor has the all rights to investigate these people. These rivals lost a free and fair election in April, 2010. What makes them again to demonstrate against the will of people of NBG in March, 2011.

    Chaos and political violence are unacceptable and should be discourage by all means. The governor did ” investigate” what he supposed to do as a governor of NBG. These folks intentions were to create political disturbances in the state. Unfortunately, the president felt for their tricks to destabilize the security of the state.

    Again, this is strictly state issue, is not a national issue as you falsely claimed it; and Salva have no ground here to summoned the governor who try to political chaos in his state.

    The president needs to concentrate on national issues such as insecurity that’s taking over the country by storm. the president just want to divert attentions from the insecurity issue which he failed to deliver security and protection to South Sudanese people.

    I’m not against President, Salva, but his constant failures are many, just take the time and go back and read my first comment to find out the facts about his political shortcomings and random decision making.

    The president fumbled many issues “down the road” including security issue, which is supposed to be his top priority in his agenda; and that’s why his VP, Machar is sweeping the glamor and political stardom from his feet.

    I totally respect your opinion and I always like your comments, but I don’t agree with you when you said that the Governor Malong Married to more than 120 women and more than 500 children. I’m not sure what sources have you used to conclude that.

    I, personally, don’t know anything about the governor, but more than 120 wives is mere illusion to me. You are suggesting the governor has more wives than the entire government of South Sudan officials.

    I don’t know! update me with the sources so that I can believe your allegations are true. Let me remind you that I intent no harm at all, but I am just curious to know about this thrilling and intriguing story. So please, provide me with proof (example his marriage records) supporting your claims. I would be delighted if you do so. Thanks

    That is good Mr President.
    Keep on giving subpoena to the governors who are creating room for dictatorship. Tell him that being a governor does mean to treat people anyhow.We are tired of detention of innocent people.
