South Sudan president says he can only dismiss elected governors if convicted of a crime – Bakosoro

July 19, 2011 (YAMBIO) — South Sudan’s president said Saturday that he only has the right to dismiss elected officials in the newly independent country if they have been convicted of a crime.

The South Sudan Interim Constitution which was criticized for giving excessive powers to the President of the new state. The article 101 (R), allows the president to dissolve the state legislative assembly and relieve elected governors.

The governor of Western Equatoria State Bangasi Joseph Bakosoro who met Kiir recently said Tuesday that South Sudan’s president had dismissed interpretations of South Sudan’s interim constitution that would allow him to sack state governors and elected state level MPs.

“The president said he has no mandate to dismiss any elected leader from the government unless convicted into criminal act or activities,” decried Bakosoro, who was the only independent candidate to win a gubernatorial seat at last years elections.

South Sudan transitional constitution had proved controversial with opposition groups and senior figures within South Sudan’s ruling party – including the vice president and speaker of parliament – expressing reservations that the power was too centralised.

Kiir signed South Sudan’s transitional constitution on July 9, in Juba during South Sudan’s declaration of independence. Secession from the North was achieved through a referendum, which was a key part a 2005 peace deal ending decades of war.

Bakosoro said he also discussed the future of the states in terms of development for the local population to feel the total freedom and benefits of being a sovereign state, in his meeting with Kiir.

The governor further mentioned that the president revealed that he will form an inclusive government and will increase the seats of the National Assembly to allow more political parties to take part in the parliament in August house.

He further said that in the meeting with the president Kiir disclosed that he will call for the SPLM national convention in order to look at way to iron differences amongst party members.

Governor Bakosoro called upon all the people of South Sudan to remain in harmony and unity as time has come for the development and nursing of a new nation.

“The development of the new nation is our collective efforts therefore we should leave out segregation and division of races and stand as one people for the success of our country” asserted Bakosoro.

    Thanks Governor Bakosoro for clearifying that issue out. Otherwise, Mr. President was given too much powers even to dismiss the public icon. I don’t think either he’ll have power to dismiss dismiss the state legislative because those pple in the parliament are being elected by the people for people to represent them in the goverment.

    What happen to the democratic government that we were fighting for whereby everything come by majority votes and not single minded people like presidents and his advisors to make decision for majority. It was mean for majority to make decision for minority and not the other way around.

    “South Sudan Constitution deserves to be rectify to fit majority needs and not minority needs,” I decry for that because I’ve read & I’ve understood it.

    Power should be given back to the people so that they can elect somebody else if their governor is dismissed. This will bring democracy back to life.

    Dismissing governors will make them to be seen but not to be heard because voicing their opinions may cost them their jobs since it will be difficult to determine what is a crime and what is not. They will do their best to establish best working friendship with the top like Taban has done and start to forget the people.

    Mr President you are right,but some issues are more dangerous than crime like a governor who does not make any development in his state how can you see on this?

    and the big question is that no body knows including governor Bokosoro what may constitute or amount to a ‘crime’ in the mind of the president.

    the transitional constitution was not clear about that. it just give the president a blank cheque to dismiss governors or dissolve parliaments without specifying on what matters or charges.

    if a governor tells to the president or advises him that he should not do this or that in the state then the president may say that amounts to a crime and dismiss that governor.

    mr. governor, you better worship benydit kiir because he is still the one to judge and tell you whether you made a crime or not.

    There are governors who are anti-development of South Sudan. Those ones against development of South Sudan and especially those that are hindering development of urban centers must be fired.


    South Sudan can only afford to have 26 or less Ministries with less than 10 independent commissions if we really need money to go to development of badly needed infrastructure in South Sudan.

    Increase doctors and lecturers salaries so that many people are attracted to those careers other than politics.

    Presidential advisors should be reduced to four only.

    Government size may be increased by creating parastatal institutions that are run exclusively on business principles.

    This might include

    2. South Sudan Produce and Cereal Board
    3. South Sudan Postal Services
    4. South Sudan Public Utility Corporation (this can further be divided into South Sudan Electricity Corporation and South Sudan Urban Water Corporation and South Sudan Public Transport Corporation – to create three managerial positions to accommodate three executive directors or CEOs)
    5. South Sudan Tourism Authority (to work closely with Ministry of Wildlife and South Sudan Wildlife Services) to develop both domestic and international tourism market.
    6. National Social Security Fund (NSSF) to deals with pension contribution of all working people in South Sudan

    These parastatals are all self-financing institutions – they just need government set up after which they will be making their own money.

    what if the president asks a governor to give him some part of his 5% of oil revenues to develop his village of akon in warrap state and the governor refuses, would he consider that a crime and dismiss that ‘elected’ governor?

    somebody told me that the president doesn’t respect the governors because he knew that they were not elected by the people but rigged the elections for themselves and for him, the president. so the votes of the people they had stolen and claimed should not be respected by the president this time.

    we are in big mess and confusion.

    Your State was the first in South Sudan to bring the racist issue against Dinka after signing peace agreement.

    There were unusual things the people did to Dinkas in your State and if you talk about diversity you better to told those against Dinka in your State. Against the people who tried to help Southern Sudanese out of Khartoum ruler was a bad Idea for Zande and others tribes to do it.

    Let the president use the powers given to him but he is bound to suffer lose should he dismis any equatorial MP or even the speker general.
    With this mentality in Dinka even a dinka bone in the 2006 still tells guys arround that he fought the liberation war and I pondered! when will these people wake up and quite this brain mixed of blood and milk to begin to think critical things?
    What does inclusive governace mean? because I hear this word from even the Governor of the WBGs and now the Horn of the bull.

    Dear Readers,

    The execissive powers given to the President can be justified. Our elected governors, members of parliament are not honest or familiar with public policies thus they are always committing mistakes that are avoidable. One of the governors that was elected recently became millionare in less than two years. Is it not a crime?

    State legislative assembly is blind to see what that particular governor is doing whether the speaker has been bribed or they cannot define the mandate given to them by the Public. there are defineable circumstances why the president is given execessive powers.Governors are not supposed to celebrate the word spoken by the president.

    And who convicts elected governors? The courts in the States I believe, yet these courts are manned by people who are accustomed to bribes.
    Suffices to say that no governor will ever be convicted of any crime as long as he/she has the resources at his/her service.

    The excessive powers given to president of the Republic of South Sudan to dismiss or fire any elected governor is right simply because some of the governors in other states of South Sudan today have forgotten entirely the objectives of the Liberation struggles from the successive Khartoum regimes.
    We the people of South Sudan aggressively fought the Khartoum regimes to free ourselves from marginalization .Though we are now free at last we equally at the same time still witness marginalization of other communities in the South by some of these so called governors.
    Those Arabs-like governors should not rule in the new Republic of South Sudan and should immediately be fired by the president using the powers given to him in transitional constitution of the Republic South Sudan.

    benydit kiir is cleverly improving every day. with that blood-red constitution he is holding up with his two hands mounted with excessive powers to dismiss elected officials, he has already injected great fear into the hearts and minds of the governors and mps in parliaments.

    by sending such shockwave fears to them, benydit kiir wants to create absolute loyalty and allegiance to him by the governors, or else he will every time by himself interpret what constitutes a crime committed by governor, since it is not specified in the constitution, and dismiss the governors one by one. clever kiir may start by luring some governors to the cabinet appointments in juba so that they draw their powers directly from him and not from people in states, before he finally removes and dumbs them into the dustbin.

    so, the governors have to go home after meeting benydit kiir in juba and preach the gospel news of ‘absolute loyalty’ to the president kiir first then to the nation second.

    is that not a very clever president?

    My brother , not all the Equatoria governors and MPs are good.Some of them are tribalistic as is the case with non-equatorians and therfore ,we dont need just to protect our tribalistic leaders just because they are equatorians.

    To me ,the powers given to the president of the Republic of South Sudan should actually be applied to those governors who think that they are every thing in their respective states regardless of being equatorians or not.

    If some of the governors in Equatoria region still marginalize their fellow equatorians ,what is the difference between them and the Arabs whom we bitterly fought with for the last two decades or so.

    The president of now-Republic of South Sudan should exercise the powers given to him and fire any convicted governor as said by the Governor of WES.We do not need to just ”small a rat” that the president will fire the independent governor that is not true.The convicted governors are there.I dont want to mention any name here.

    Are you really sound in mind? Did you think your state of WES was peaceful since 2005 to present?

    Let me ask you more questions. Who were LRA killed and abducted hundred of people in Western Equatoria?

    Were it not YOU people who crapped to the bush and joined LRA rebel group of Uganda in order to loot people goods and enjoyed they beautiful wives of others?

    If not so, why no more LRA in Central and Eastern Equatoria after signed the CPA?
    Don’t disturbed us with foolish talk of admired yourselves as peaceful.
    Also Western Bahr Al Ghazal is recently adopted your criminal action against your own people. That was why we heard LRA attack in Raga.

    The Peaceful state I would accepted is Northern Bahr Al Ghazal. The people of NBEGS had been shown hospitality to anyone, whether black, white, brown or red without opposition or threats.

    For the issue that President can dismissed the state governor who caused some crimes in the transitional Constitution of the Republic of S. S is absolutely correct.

    I can say, if possible, let the governor of NBG, Lake, Unity, and Jonglei states be dismiss from their position of governorship.

    If you ask the society of these states they can gives hundreds of positive reason reasons that fits dismissal.

    I have agree with the article 101 (R), that allows the president to dissolve the state legislative assembly and dismiss the elected governors so that we have one government system.

    Secondly, all elected governors should work hand in hand together with the president of the Republic according to the will of the people as far as respect is concern.

    guess what! without governor Taban Deng gai in Unity state,the state would be a militia state in the South.You can see when they all cry after the loser in the april election. He must be relected to rule unity for more years or the population should elect his deputy because he is doing excellece in the state.

    Mr. Governor, U have always shown your people U like them but do consider others views like not insulting them.
    Triblisim is no. 1 and it is U to removed from them but don’t worry that U will be removed by Dinka dominated Constitution.

    All those who support U have start complaining that Bocosoro is bussy doing his own thing even those who use their money for your compaign are doing the same.

    Try very hard to do some thing on your way of doing things now as many people are not happy with your current way of doing things and see where U when wrong ,but adjust from there.

    Dinka cant go along with Nuel, Dinka cant go along with Dinka of BAG, Dinka cant go along with Shurku, Dinka cant go along with Equatorian. Guys I’m asking you to calm down at this point. Dinka so far has killed dazens of Nuel civilians. I can smell the next war of ROSS just on my tip nose. I know Dinka wont take Refugee to North neither else where. Dinka just need to start giving equatorians Head job. A time ‘ll come and a day ‘ll come when things ‘ll come into shit. Bakosoro is a hero in Equatoria not only among the Azande but the whole region, think twice before coughing his name in your belly. If Kiiri want to be in blood trouble let him stick his *** behind equatorian leaders.
