Jonglei signs Interim constitution

August 14, 2008 (BOR TOWN) – Jonglei State Interim constitution has been signed Thursday August 14; a development seen as a legal turning point in the State to the respect of law and order.

Juuk_signing_the_Constitution.jpg The launching of the state constitution marks a first legal document developed independently by Jonglei government and approved by; Government of Southern Sudan (GoSS) and Government of National Unity in the 103 year-old State capital Bor town.

Commissioners of the eleven counties also attended the ceremony as well as State Ministers, State Members of Parliament, army generals of organized forces and various community and traditional leaders.

Twice East County commissioner Diing Akol Diing, who represented Counties leaders, says Southern Sudanese hope to self determination and developmental governance won’t be smooth without and progress and peace in Jonglei.

“We are the political scientists in Sudan….and we must embark the rule of law, transparency and decision making in a legal manner,” he says adding “the constitution shows us the direction we are going”.

Outlining articles of international concern, State Attorney General Justice Mayen Hoka said the constitution’s bill of rights spelt out clearly women rights and their 25% representation in all government’s organs and the child rights to education, health facilitation and protection (by parents and government).

The strong customary norms however, may not be interrupted as the constitution caters for them, the State legal chief says. Jonglei constitution encompasses the Comprehensive Peace Agreement and GoSS interim constitution legal guidelines; this the State authorities claim will avoid confusion.

The over joy head of legislators, Speaker Jodi Jonglei Boyoris said history is better than possession.

“A hundred years …..it will not matter what my bank account was, the car I drove or the house I live in but that the world will be different because I was important in the life of people,” he said.

State Ministers, army and police generals, and all influential State authorities, who feel to be above the law, are not immune constitutionally (should they go wrong), the constitution affirms. All this is to empower the people and allow room for democracy, transparency and amicable coexistence without barriers.

Since the adoption of Sudan, southern Sudan government interim constitution the federal ministry of justice refused to endorse constitutions of the 10 states in the south, saying they were unconstitutional.

The federal ministry has requested that references to state boundaries, state capitals and the right to self-determination to be removed form the constitutions before it issues compatibility certificates.

    This is a great way forward. But i believe having a constitution is one thing and enforcing its contents is another. So i would urge the concerned authorities in Jonglei to make those laws practical rather than theoretical stuff which wouldn’t help people at all. See the GOSS and GONU have constitutions but still top officials in both governments are yet engulfed in corrupt dealings.

    The stance of federal ministry of justice towards constitutions in the southern states show how arrogant and out of touch the arabs are in recognizing the rights of our people to govern themselves and to decide if they ought to be an independent country. It shouldn’t matter if they don’t endorse our constitutions because sooner or later we ‘ll part with them. The struggle isn’t yet over.

    Whistleblowers are here in jonglei state, people with the courage to put the truth fisrt, those who alert the public to scandal, danger, malpractice or corruption. we want to be in a corporate state and corporate authority.

    i appreciated this wonderful development in this state, and i wish you should keep on doing this good job, next week jonglei will be a well development state. By Biar M Bul

    Congratutions Gov. Kuol Manyang, Jonglei’s MPs and the citizens of Jonglei state on achieving the historic move in the history of the modern jonglei, I hope with the stroke of your( Gov. Kuol Manyang) pen, the interim constitution will be respected,followed, and enforced accordingly no less, no more. I think it sends a very clear signals to those who used to entertain false assumptions of them being above the law and prey on the vunerable citizens. I think the next challenging task is to undertake a comprehesive,complete,and full initiatives to educate the public about this interim constitution, so that they aware & know theirs rights and the state’s rights.I hope hypocrisy wouldn’t be practiced when implementing the laws because my people,the law abidding people in the state of Jonglei would fall in the cracks if attention is not taken seriously throughout implementations.

    The Jonglei state has taken a bold and huge step among the states in the south, and credit should go to steadfast and courageous leadership of Gov.Kuol Manyang Juuk.The people of Jonglei state need to co-operate with Gov.Kuol in order to deliver a good gornance which would help to facilitate supplying the basic needs, which include security, clean drinking water, health facilities,and education. As a concerned citizen of that great state,my message to Gov.Kuol is that you ‘re moving the state in the right direction,good job, keep up,though we ‘re far a way, we ‘re watching!

    Thank you very much Gen. Kuol Manyang for the effort you are trying in Jonglei state of southern Sudan. Interim constitution in jonglei is the only way we can move a head. The remaining part is the implementation.

    Jonglei comrades, your thanks-giving towards governor is somewhat fair, but I reckon it has to be extended to Jonglei publics and more especially to members of parliament within Jonglei community. Kuol is not doing the job in isolation there are great men and women behind him, and for that reason, their contribution should not go unnoticed.
