Sudan SPLM to submit proposals to ruling NCP on ICC row
July 26, 2008 (JUBA) — The deputy secretary general of the Sudan People Liberation Movement (SPLM) Yasir Arman disclosed that they will submit a “roadmap” to the ruling National Congress Party (NCP) to deal with the issue of the International Criminal Court (ICC).
Arman said the proposals will remain confidential until discussed in a high level meeting between SPLM and NCP leadership.
However he hinted that the NCP must deal with the ICC directly in a legal manner.
“The leadership of the SPLM clearly stressed the need to deal with the international community and the ICC to strengthen the national interests”.
Prior to Al-Bashir’s indictment the SPLM have been calling on the NCP to cooperate with the ICC angering its officials.
This week the SPLM’s Secretary general Pagan Amum in an interview with the UN sponsored Miraya FM, said that there was genocide in Darfur, one of the counts being brought against Al-Bashir. He further said that this is the view of SPLM, adding even the late SPLM Chairman Dr John Garang described what is happening in Darfur as such.
“So this is SPLM’s point of view since before the war, genocide has been taking place in Darfur as it had happened in Southern Sudan” Pagan said.
However this week the SPLM chairman Salva Kiir called for deferral of the ICC indictment by the UN Security Council (UNSC).
“There is no need rushing to take the Sudanese president to the ICC” Kiir told reporters late on Tuesday during a trip to Uganda.
But Amin Hassan Omar, a leading figure in the National Congress Party (NCP) and a state minister said in an interview with the Egyptian Voice of Arabs radio that Kiir’s request “is totally rejected”.
“We believe that referral [of president] to the ICC was a mistake and the whole file should be withdrawn from the court. This is a legitimate demand” he added.
Article 16 of the ICC Statue states that “no investigation or prosecution may be commenced or proceeded with under this Statute for a period of 12 months after the Security Council, in a resolution adopted under Chapter VII of the Charter of the United Nations, has requested the Court to that effect; that request may be renewed by the Council under the same conditions”.
The African Union (AU) this week asked the UNSC to invoke article 16 of Rome Statue and suspend any indictment of Sudan’s head of state.
It is widely expected that China and Russia would back such a step but neither have tabled a formal resolution.
However to gain an agreement within the UNSC, Sudan’s allies China and Russia must ensure that US, UK and France will not use the veto power to block a resolution on suspension.
Sudan has not ratified the Rome Statue, but the UNSC invoked the provisions under the Statue that enables it to refer situations in non-State parties to the world court if it deems that it is a threat to international peace and security.

Yet again another despicable move by the SPLM and their biggest dog/traitor issuing a pointless proposal that is bound to be rejected.
Not only do these southerners have no intellegience in recognizing that Sudan DID NOT ratify the Rome Statute and will evidently not cooperate, but this also highlights the prospect of what if Kiir should be rightly charged with War Crimes along with his Dinka hero the ex slaughterer John Garang, should Sudan hand them over?
This clearly shows the incomptentence and the utter idiocy of the SPLM and this actual SPLM thinking along with all its supporters.
