South Sudan parliament directs executive to prosecute culprits involved in dura corruption

August 26, 2011 (JUBA) – The newly transformed national parliament for the independent Republic of South Sudan has passed a resolution directing the executive branch of the government to seriously investigate and prosecute any individual that has involved in the dura corruption since 2008.

Billions of US dollars worth of contracts were signed by the ministry of finance with some fake companies to deliver the grain to the ten states as government’s response to the hunger in the region.

The dura was supposed to be sold to the hungry population at a low price and the money remitted to the ministry of finance.

However, many individuals secured the contracts with fake papers claiming to be companies and ended up getting away with hundreds of millions of dollars without any grain delivered to the states.

The dura saga has earned the government a bad reputation in the eyes of the international community.

On Thursday the national legislative assembly summoned the current minister of finance, David Deng Athorbei, as well as the former minister of finance, Kuol Athian, under whose tenure the contracts were signed to explain how the situation came about.

Kuol Athian defended himself before the parliament, saying the companies he contracted were legally registered by the former ministry of legal affairs and constitutional development, now ministry of Justice, under the leadership of the former minister Michael Makuei Lueth.

Athian further explained to the parliament that he paid the companies who brought with them certificates of acknowledgement from the states that they had actually delivered the dura to the states in accordance with the contracts signed.

He said in the certificates the states officials including their governors, ministers of finance and the store keepers all signed, testifying that the dura reached them. He however lamented that the amount of money purportedly collected from the sale of the dura was never remitted to the ministry of finance.

However, other officials and the ordinary people on the ground in the states refuted the claims, saying most of the dura never reached to the states or the intended destinations.

The newly formed Council of States is now charged to summon and investigate the governors of the ten states on the malpractice.

The MPs who were visibly angered by what they said was one of the worst corrupt incidences in the previous semi autonomous government said those who would be found responsible must be brought to books.

    Let us learn to be objective rather than subjective. Tribalizing issues will not help here. Inciting tribal sentiments will lead us no where. Look at what is happening in Jonglei State currently. Is that not a product of tribal incitement through irresponsible writings like yours?

    If the instruments of the law are properly abided by, I am pretty sure the people involved in this scam will pay dearly for the crime they commited.

    Finally do not mistake me. I have nothing personal against you. And I do not either hail from the tribes/sections/clans you have a pick with. I am a South Sudanese full stop.

    Makuei Lueth, has to declare himself clean by summoning those companies that he contracted as minister of Legal affairs. There is no way criminal companies were contracted only to make away with public funds.

    He who involve in this embezzlement must be brought to justice no matter where he hail.

    as expected.I want us to solve any problems as nationals and not as tribes though there are really tribes who deserve to be blamed for corruption practice in the country like the claimed to be rulers,the dinkas.The dinkas should stop under valuing the other tribes for because they are watching what is taking place, and therefore,be aware of.

    listen here, Governor Kuol is not among those corrupted in juba; he is simply the victim of hate from certain people who doesn’t like him. Kuol Athian the former finance minster and the current minister of finance Deng Athoriba are to blame for this lost of dura, every Governor from tens states are to prove themselves innocens before the Goss house and prove the two minster wrong for stealing from their citizens at the end of investigation. If indeed governor Kuol received his dura delivery, then all citizens are welcome to say whatever they wanted to voiced the opinion for. In court of law, people are presumed innocent until prove guilty by court of the law, anyway we needs to differentiated between one person and the whole community, Kuol is only person in dinka abor community and many dinkas even those Dinkas from president Kiir side are suffering like many other ordinary citizens of south Sudan . When blaming someone for wrong doing, we need to pointed our finger to that particular person because is the only one who misused the public fund but not his community. I hope this message help those with hatred to gain spirit to notice the true then living on racial dividing.

    I’m from those who started this movement and faced the consequence of it until the end; I never, never betrayed my people and never betrayed my country. I saying this because heroes are those who never when to fight alongside with northern government until the end.

    Guys stop judging whole tribes because of individual culprits, what they have stolen they will not share it with any tribe either their relative. There was no law even to judge them since there were no constitution. But the good option is to sack them from party for good.

South Sudan attained its independent because of all its tribes, I warn you to erase that mentality. You look at the Republic Of South Sudan money, head of the late, name of Deng Athor and the Signature of the former Governor of Bank Elijah Maluok, what is that? Is the money belong to one tribe in the South Sudan or it’s the gov’t money?. To me as South Sudanese citizen, that money is valueless.     you people seemed not to be educated. The Ministry of Legal Affairs is obligated to licensed every Southerner who claimed to have the cappacity to do the business in South Sudan. You cannot do the business without having obtained the license permitting you to do so. Otherwise it will be a land of thugs.

    Giving the contracts is a responsibility of the Ministry or company concern to define it’s criterias; the comapny financial position, the expertise that the company possess, how long it has been to business, the previous contractual contacts and so on. SO if you award the contract on the basis of cerificate, then it renders you incompetent and less educated.

    I want to make myself clear that the ministery of Finance lacks competency and qualifed staffs who understand business., secondly, the States authorities who confirmed the deliveries also are part of the scandal. So it is a chain of thing nwhich need to be study. They call it successive events in legal terms. I am not a lawyer anyway but am a South Sudanese with MBA. Any body who did not fulfilled his/her obligation in Dura and even in the independent celebration which embrassed us need to be investigated and prosecuted regardless of where they come from.

    Otherwise we will have the Country of enrich my tribe and set the social-economic classes like what am seeing happening in South Sudan. So let not be mypoic in this case. We mean it and it must be done otherwise it will cause them positions after 4years from now.

    I can said the new assembly is good. It will be very easy to trackdown thevies now, went the assembly asking for the money. If governor recieved Dura then is going to pay money, if not, jail. Or his contractor.
